Do I Qualify For Unemployment Benefits?

Individuals who are considered out of work through no fault of their own may be eligible to receive unemployment insurance benefits.

Minimum qualifications for eligibility include, but are not limited to:
  1. Sufficient earnings within the base period of a claim to qualify monetarily for benefits;
  2. Must be wholly unemployed or employed less than full-time and have earnings less than their weekly entitlement;
  3. Must be found to be out of work through no fault of their own;
  4. Must be available to seek and accept work customary to their normal occupation;
  5. Must be physically and mentally able to work at the time they initiate a claim for benefits; and,
  6. Must not refuse suitable work when offered.

How Do I File For Unemployment Benefits?

Unemployment Insurance (UI) benefits is temporary income for workers who are unemployed through no fault of their own and who are either looking for another job, have definite recall to their jobs within 6 weeks of the last day worked, or are in approved training. The funding for unemployment insurance benefits comes from taxes paid by employers. Workers do not pay any costs. Eligibility for benefits is determined based on past wages, reason for job separation, and availability and job search requirements. Claims for unemployment insurance may be filed at any Georgia Department of Labor Career Center.

When filing a claim, you should bring:

  • Your social security number. A claim cannot be filed without a social security number.
  • Employer-issued separation letter or notice, if one was provided.
  • Names and addresses of all employers for the last 18 months and the dates worked for each.
  • Proof of immigration status if not a U.S. citizen.
  • Personal check with account number and bank routing number if you want benefits deposited directly into to a checking or savings account.

If I get laid off for lack of work and business partially terminating will my unemployment be based on hours worked per week of pay period or salary ? My hours varied per paycheck approx 30 hrs a week. Will it be determined from my last employer who states I was a part time employee in Florida or does it go back to my full time employer that I retired from in Florida?

I filed a claim that was denied 7/05/09 based on determination section 34-8-194. I have been re-employed and about to be laid off. My income with the new employer is under $500.
Am I able to re-apply since I have not earned $3300 which is the amount that stated to me? or
Is there a time period in which you can re-apply?

I will be layed-off in March with a small severance package. my research as to whether or not I can coolect UI benefits along with a severance has been inconclusive with most sites stating that I won't know if I am eligible until I file a claim. What are the guidelines for severance income? I need to plan my finances carefully and would like to know if I can count on the UI income or not. Thanks

I worked for my job for 3 yrs and 2 months and had a verbal agreement w/my boss that it would be ok to come in 15-20min late while my child was at school so I could get her on the bus everyday. All of a sudden on 4/5/11 I was told by my same boss that I have been late for several months and needed to be in at 8 or I was not needed. I told her that I could not and she has been aware of this over 3yrs. Well she let me go and when the UI DOL called her she told them I quit. That is a lie. On my separation papers she put attendance and punctuality. I was never reprimanded or written up nothing negative in my employee file. Now I am having a hearing next week to try to get my unemployment. I need any help or hints to assist me. I would appreciate any and all responses.

If you have been laid off and within the same week, your employer asks you to work part-time for a few weeks to help the office catch up on admin work. The employer has not yet honored my request for my Separation Notice, but chose to offer me part-time work for a few weeks. I have a lumbar fracture and am in a great deal of pain. I work in a call center ten hrs per day, 4 days per week & my back pain is so severe that I have missed a lot of work and have received a final, written warning about attendance. I recently found out that a project I'm working for a large corporation will end at the end of the year. As such I am getting laid off at that time.

I signed a contract with the US Army a few months ago to report for training in March. Does this fact exclude me from collecting unemployment? I fully plan to look for work leading up to then.

My son, can only find work intermittantly and when he does it is usually temporary and short term in nature. This has been particularly bad in the past year when he had income of less than 1,000. So he is effectively totally dependent on me. It would seem that despite being unemployed he does not qualify for unemployment benefits because he does not have the required "insured" wages but are there any state benefits or supplements to which he might be entitled ?
