New York Unemployment Requirements

In order to start your unemployment, NY unemployment requirements include the following:

1. You are totally unemployed. Depending on your vocation and industry, you may qualify for unemployment if you have had your hours reduced.
2. You have worked and earned a minimum amount of wages in work covered by unemployment tax during the past 18 months.
3. You have lost your job through no fault of your own. If you were laid-off you will qualify for unemployment. In most cases, if you were fired for cause - you will not be eligible to collect unemployment. If you were fired for cause, you SHOULD apply for unemployment anyway, just in case you are eligible to get it.
4. You are able and available for work. If you are unable to work because of disability or medical condition, you may not meet the New York unemployment requirements, but you should apply anyway. If you are not eligible for unemployment, you may be eligible to collect disability benefits, and the case worker at the unemployment office will be able to direct you on how to apply for disability.
5. You are registered for work at your local Workforce Development Center. You must do this when you apply for unemployment, and every week when you certify your weekly claim.
6. You are actively seeking work. You must apply to a minimum of two jobs per week.

To continue receiving weekly unemployment benefits, NY unemployment requirements state that you must file a 'weekly claim' by doing the following:

1. Meet all of the NY unemployment requirements listed above.
2. Apply for at least two jobs each week.
3. Contact the New York unemployment office to file your 'weekly claim'. You can do this via phone or on the internet.

No I believe have have to work for at least 18 months but not all at the same job it carries over from your past job, then you will get a percent of your wage. But if you are fired from your own fault you dont quilify.

I was fired for failing a random drug test. After working for company for 8 yrs they gave me no chance to prove the test was wrong. I told them I don't do drugs,never have never will, something OTC I was taking or something else had to have caused a false positive. Told them I will take a drug test every week take a lie detector test, whatever it took! Still fired, would I be able to collect unemployment?

My child had er surgery I didnt know that she wasnt going to be to return to school until 1 or 2 maybe more I was ok for 3 day then i need more time because she is still healer and in pain i cant leave at home alone my job does not offer me sick or personal time it you work you get paid you dont work you dont get paid if im fired because i cant return to work until a later time and my child is better can i get unemployment

i was fired due to "not putting forth enough effort" as my previous employer put it. However, leading up to my termination I was working the nikght shift and my main duty was to supervise another employee while also taking care of any tasks that needed to be completed around the factory. Shortly before I was terminated there was very few of these tasks around the shop which resulted in the appearance that I was not doing my job. And while I cleaned the shop and helped with everything I could, none of my supervisors were present (they all worked on the day shift) to see me putting forth an effort. Does any of this qualify me for unemployment benefits?

I'm standing up 8 1/2hrs a day everyday at work 1/2 hr for lunch which you be lucky to get a few minutes to get your food & sit down & enjoy it. At my job we are not allow to sit at all or lean on anything which causes my feet & knees to really hurt at times. I seen a foot doctor & got shot injected into my feet which which cause more pain & didn't do anything for me, i need my job to support my two teenagers & pay my bills don't know what to do at this point this job is really taking a toll on my health would like to hear your advice on what i should do

My sister has been working for the same company for several years. Her company, a state run medical facility, has been having financial as well as other problems to the extent that the employees have not been paid at times. As of tomorrow (5/11/12), she will again not receive a paycheck, making this their fourth consecutive week of straight work and no pay. This cannot be legal, but her question is can she or does she qualify to collect unemployment benefits? Please advise. Thank you.

I have been working full time for two years and now must quit my job to complete my student teaching for my masters degree. I work 24 hours per week and have been working for my boss 10 weeks.
I also worked 3 years for a previous employer for the same hours.

I am having lots of problems with my new boss, she is verbally abusive. If I get fired this week am I be eligible for unemployment? or would I receive it from my last employer?

I got fired after only working for 4 months and for not meeting their expectations versus not working hard an long for the company. They claim they gave me verbal warnings but sitting down and asking how it's going doesn't generally qualify as warnings. Would I qualify?

I am inquiring about unemployment due to i am enrolled in a college as a fulltime student in the three year program for my RN i will work at my job on holiday breaks and vacations but the program is a very stressful course i am a cna and the program frowns upon working while in the program because what it consists of, any information concerning this matter would be helpful, been employed at the county nursing home for almost six i qualify?

I have Been working for one company full time for four years. This past year I worked another job simultaeously from Jan until April but was terminated due to lack of shifts/availability. the company informed me that I could apply for unemployment, but I didn't because I was still working the four year job. Unfortunately, I am having problems at this job and it may come to an end. Can I still file unemployment from the job I was terminated from a few months ago if I am not able to resolve issues at the job I am presently at?

I don't know what to do!! I just had my little girl back in May and my plans for child care this fall have fallen through. My husband is in college full time during the day as of this September and I work at the same time. I cannot afford day care and I can't afford to not work. My friends and family either live out of state or work close to the same schedule we do. My position at work does not offer a schedule that would coincide with my husbands. I would only be out of work until he graduates this December and will get a job. A friend of mine told me that she was aproved for unemployment because she had no options for her 4 year old daughters care. Is there any way I can quit my job and temporarily collect unemployment until I return back to work? Or are there any other options that should try?

I have been at my current job for just under 3 years and its been nothing but a headache.I have been actively looking for another job but have had no luck.The reason I am looking is due to my employer cutting hours and not being able to cash our checks on payday due to insufficent funds (which I have several emails stating this) , since about 2 months ago I have been doing the job that three people once did as my two other co workers fouund jobs and left. They have not hired anyone else and I do not take a lunch as I am lucky to have 10 mins to eat with out answering the phones ,helping doctors or taking care of patients.I have voiced that we need another employee and they still have not hired anyone .When I asked they said the owner does not feel it necessary to hire another employee. Would I qualify for unemployment if I quit?

I worked at one job for two years and left for a new job. After three weeks at this new job I was informed that the company was out of funds and couldn't afford my salary and was laid off. I live in NJ and have had my current job in New York for 10 months. A have an offers for work in NJ and am wondering how that will affect my eligibilty for unemployment if I get fired.

Although the job is quit appealing, the company has a history of firing employees (some do not last more than a month)and I am a lttle concerned.
