Kentucky Unemployment Fraud Penalties

REMEMBER:

IT IS NOT ILLEGAL TO WORK WHILE YOU ARE COLLECTING UNEMPLOYMENT BENEFITS.

You are able to work at a job and make a certain amount of money while still collecting unemployment benefits. When you apply for unemployment, this amount will be determined, and how this works will be explained to you by your unemployment counselor.

ALSO REMEMBER:

IT IS A CRIME TO COLLECT UNEMPLOYMENT BENEFITS WHEN YOU ARE NOT ELIGIBLE FOR THEM

If you willingly collect unemployment benefits when you are not eligible for them, and when you don't meet all the requirements - this is considered unemployment fraud and there are stiff penalties for committing unemployment fraud.

Unemployment Fraud Penalties include some or all of the following:

1. Fine. You may have to pay back the unemployment money you collected (this is called restitution) and pay a large criminal fine.
2. Jail. You may be sent to jail if you are found guilty and convicted of unemployment fraud.
3. Probation.

a friend of mine is collecting unemployment for supposedly being temporarily laid off. He has now moved out of the area, and if he is called back, he will not be going back to that company. Is that fraud for knowing moving and still collecting and not getting a job or returning when called back?

You have to contact them and let them you know you have moved out of state and they will inform you of where you need to mail your job checks back to.

I would like to report someone who is collecting Unemployment and should not be. He is turning down jobs and making up places to apply to. He basically blackmailed the employer to receive his benefits and will be seeking an extention. Is there a number I can call and report him?

My fellow employee was laid off recently and went to draw unemployment and found out the our employer has not ever paid any money in on her. My guess is they haven't paid it on any of us. Is that illegal and can my employer get in trouble for this?

I am being charged with Making False Statement for Benefit over 100 ...this has to do with a refile over 3 1/2 years I neglected to put down a employer and the state wanted the entire 6 month window of $6000+ interest. I didn't pay but did not realize as they have already put it against my credit that they would now look to put fraud charges. I am wanting to make this right the judge says the charge can carry 1-5 years in prison. Should I see if the attorney can make a plea deal with prosecutor to lower charges to misdeameanor even though I am facing a class d felony and I would pay restitution. Also if I do that would I be able to leave state if on a diversion program or paying restitution I have a job transfer in the works way before I received the summon. Please help in answering this question. Thanks!

# Kentucky ohio 2013-06-10 20:42
I'm wondering how filing a claim would work in Kentucky. I've never had to file a claim before. I worked at my last employer from October 15 th to yesterday. Before I went to work for my last employer i worked at wal mart for two days and left because i felt that i didn't feel comfortable preforming the task they wanted me too. This was September 2012. Now the two jobs i had before this was in ohio in a Mexican reastaurant from June to August 2012 and a fiberglass factory from feburary to June 2012. So I would file in Kentucky and not ohio right?? Since I'm a Kentucky citizen now and had my most recent job for 10 months.
