Georgia Unemployment If You Get Fired

Generally, in Georgia you have to have lost your job through no fault of your own in order to collect unemployment.

In most cases, this means that if you get fired, you cannot collect unemployment benefits.

If you get fired from your job, you should go ahead and apply for unemployment benefits, because there are some cases where you can be fired from your job and still get benefits.

If you feel like you were fired unfairly, or there were extenuating circumstances, be sure to tell you unemployment counselor about them. If your unemployment application is denied because you were fired, you also have the right to appeal the decision.

I work from home as a customer service rep and have Multiple Sclerosis. I have had health problems that caused me to get points and my internet drops intermittently which also caused me to get points. Recently, it dropped again for a few hours which resulted in my last point and being fired. I have contacted my ISP for documentation that I have tried to get it fixed but they wont give it to me. I also provided a doctors note for one absence but i still recieved a point. I cannot control how my internet acts or my condition. The company has an accomodation on file for me for the condition and they changed my schedule for that but still I accumulate points for an absence due to the condition. Could I recieve unemployment in this case?

I have been on intermittent leave for almost two years and was allowed to work from home when needed. In August of this year, we had a top management change and a new human resource brought in to the company. In September I was told that I could no longer work from home and when I asked why I was told because it was illegal. I have all the documents that gave me the instructions to set-up and work from home and emails where my boss and the finance manager were aware that I worked from home. I expressed concern that I was low on FML hours and this would cause me to use more FML hours and create a problem with completing job task on time. I never received any feedback. I have never been written up and have always had good job reviews. I have a chronic condition and was out a lot in October and used a lot of FML time since I could not work from home. Then I was told that I needed to file for short term disability. When I spoke to the doctor he stated that I may need to file for disability in the future but this was a flare up that I should go back to work. Well now the employer stated that since I was out over 5 days I needed a doctor to fill out forms. Back to doctor’s office and now they don’t want to fill out the necessary paper work. November 8, I was fired on the phone by human resources. I filed for unemployment using the reason exhausted FML time. The same day after I filed I received a separation notice stating “Unable to return from FML”. This is not what I was told on the phone. Do you think I can receive unemployment? By the way this is in Georgia.

I was flexed over 150 hours this year for lack of work but got fired after 10 years at the same company for a trumped up reason. can I get unemployment because the real reason was lack of work for full time.

I have been off work from 12/17/2010 due to a reconstruction of my right foot in July 2011 a cat scan was taken and I was told it was ununioned in 2 or 3 places causeing me to have to go under the knife again. I have been off all this time with none weight baring. A doctors excuse and noted were sent each time at the doctor. I even talked to my supervisor and ask if I still had a job and she said yes. Today 01/27/2012 I received a voice mail from her saying I was being terminated due to being on med leavce for a year or more. I just talked to her last week and she new my next appointment is Feb 09 and It is possible I will be released from my doctor. Can I get unemployment?

I've been seeing a doctor for a year for chronic migraines which has started to affect my job and work performance. I decided to take short term leave due to my health hoping I would be well enough to return to work. I have taken over 15 sick days last year in reference to my illness and was out 3 weeks due too depression /anxinety my doctors wants me to go back to work but I'm unable to go due to Migraines. What options do I have if I resign will I be able to get unemployment .

I work at Walmart and every 2 two weeks they threatened to write me up for productivity. I've been working here for about nine months and when I refuse to sign the write up the also threatened to suspend me for not signing it. I need help cause I need this job to pay my bills.

I live in Georgia, and today I received a separation notice indicating I was terminated due to failure to meet weekly productivity requirements after numerous verbal warnings from supervisor.

I did not receive any verbal or written warnings from my supervisor. Additionally, until the date of separation, I was not aware that I had to meet weekly productivity requirements before my job was consulting with clients who had mental illnesses. Please advise

I was told to report to the lumber area to assist & straighten up as needed. Upon arriving I was told that the lumber was stacked dangerously high I tried unsuccessfully to palliate the situation to the best of my ability, I only used the fork lift because it was necessary & I had taken all the test required by Lowe's Co.according to my supervisor. My loyalty to this Company has never been less than impeccable over the last 48 months.

Hi, I was terminated due to excess absenteeism/tardiness. My first time was a verbal, but I was told it was void because my company scheduled me outside my availability. Second time I was told it was void as well because my company had not been making sales and revised our weekly schedule, a day before our work week was to begin so I was unaware I had to work until last minute, but still came. The last time, and final, I was on my way to work and caught a flat. I still went to work and even several days later gave then info from my AAA bill!! But the following week I was fired! Can I collect unemployment still? Or am I to be out of luck?

As a gm I who has recently returned from maternity I come back to find my organization failing in many of its key measurements that being said both myself and boss agree that it will take lots of evening, weekend & ot time to turn the situation around. At this point i am just not able to amend my schedule as necessary due to child care issues if my boss lets me go due to these issues I understand am I still eligable for unemployment?

I was a manager at a hotel kitchen. I was demoted to line cook. A month after my demotion every cook including myself was written up for violating health codes because they could not 'pinpoint" who it was. The days these incidences occurred i was not scheduled. I was fired the day after my first write up. Could I receive unemployment benefits?

I am a waitress and the new manager is a jerk but I suffer through it last year for the holidays we were told if it was you regularly scheduled day you had to work christmas and christmas eve so I did under the understanding I would get it off this year now am told everyone has to work our they will be fired but I am a single mom and have my kids cause I planned not working so of I do not go and am fired will I get unemployment also I have been with this company 10 years thanks

Hi I was recently hired by a small company and I was receiving benefits going into my first extension , I'm in Georgia. The new company let me go after 3 days claiming I didn't catch on to the job quick enough , no training provided , so now I'm back out of work will this effect my benefits

I was just terminated after 22 years with no prior anything . We had a major computer issue at work and I worked non-stop for 36 hours getting the systems back online. I told my manager that I wasn't feeling well and was going home. The main system was going back online 4 hours later and there were personel there capable of overseeing this task. At 11pm I got a voice mail from my manager stating the the project was succesfull, thanking me for a good job on the project and have a 3 day weekend. HR call 4:30 the next day . They stated that they tried to call me 3 times and I did not respond so I was fired. I did not get any phone calls on either my house phone nor my cell phone requesting I help with anything except a request for a meeting and the congratulatory phone call @ 11 pm.

I have been at my current employment for 9 months and put in a schedule change due to i am starting my first year of college in January. Following my supervisor's advice I put in 2 different possible schedules for part time. Both were denied and we have a shift bid this month which I was trying to be exempt from but am now having to take part in on 12/14/12. What are my options if work will not work with my college schedule?

I have been working at my job for over a year. I was promoted to a permanent position from contractor. At the same time I began reporting to a coworker who became a team lead. I have an impossible amount of work. I'm giving 120%, work through lunch every day & don't eveb have time to use the bathroom. I work 13 hour days, including some work when I am supposed to be off (weekends, nights). My supervisor is constantly on me, stands over me & has recently started calling me on my personal phone at home. I was going to just quit but the economy is so horrible & I have to help my mom financially. I'm concerned this woman is going to get me fired because she points out every little mistake i make - minor, minor human mistakes. I have never been fired from a job in my life, I have never worked so hard to end up feeling I am at risk of being fired. Are there laws to protect me in this instance? I feel I am being mistreated & it is bothering me when I am off work, I have headaches & the stress is affecting my sleep.

I have worked for a company for 10 years and got a transfer for another position at the operation division about 2 miles from the office where I worked before. After working there a month I started getting sick with respiratory issues I continued to work for 4 months when 2 days after Christmas I was admitted in the hospital for pleurisy, bronchitis and pneumonia. My doctors say I can not go back to that environment. Now there is a threat of termination because there is not a job for me at the place where I left however there is a person that will swap with me. What recourse do I have?

Hello,
The job had no real training, so I had to take hold of the rains and learn what I could on my own. This is an extremely stressful job and recently I was informed that the the scope of the job would increase and add even more responsibilitie s. Such as knowing how to use architectural software (which I do not have any experience on) I have chronic diabetes which was made worse by job stress to the point where I missed work due to appointments and illness. When I was told I was fired they dmitted they were aware of my health issues but did not feel I was able to make things work because of the new responsibilitie s. I have doctor proof of job related stress issues.
Can I still get benefits?
