Georgia Unemployment Fraud Penalties

REMEMBER:

IT IS NOT ILLEGAL TO WORK WHILE YOU ARE COLLECTING UNEMPLOYMENT BENEFITS.

You are able to work at a job and make a certain amount of money while still collecting unemployment benefits. When you apply for unemployment, this amount will be determined, and how this works will be explained to you by your unemployment counselor.

ALSO REMEMBER:

IT IS A CRIME TO COLLECT UNEMPLOYMENT BENEFITS WHEN YOU ARE NOT ELIGIBLE FOR THEM

If you willingly collect unemployment benefits when you are not eligible for them, and when you don't meet all the requirements - this is considered unemployment fraud and there are stiff penalties for committing unemployment fraud.

Unemployment Fraud Penalties include some or all of the following:

1. Fine. You may have to pay back the unemployment money you collected (this is called restitution) and pay a large criminal fine.
2. Jail. You may be sent to jail if you are found guilty and convicted of unemployment fraud.
3. Probation.

Hi - I was laid off and received full UI benefits but child support was being taken out at a salary I no longer made which caused me to make the wrong decision and not claim income earned while working in a restaurant. Now said restaurant was notified of a audit on me and I am not sure what I have to do fix this. I believe I need a attorney who will help me find the resolution without jail and charges applied. I was wrong and my life is crashing in on me right now but I want to make it right but I need guidance and someone to talk to who is experienced in cases like this. Thank you for any feedback.

Hi. I may have gotten myself in a similar boat. What was the outcome of your situation? I'm trying to decide if I should go ahead and notify them or what I should do.

I received unemployment or 20 weeks after I had become employed. I kept applying for it because I thought since it was an option to continue to apply online, it was an option to continue to receive while being employed. I want to figure out how to be able to pay it back without receiving any jail time of convicted of a felony.
