Florida Unemployment If You Get Fired

Generally, in Florida you have to have lost your job through no fault of your own in order to collect unemployment.

In most cases, this means that if you get fired, you cannot collect unemployment benefits.

If you get fired from your job, you should go ahead and apply for unemployment benefits, because there are some cases where you can be fired from your job and still get benefits.

If you feel like you were fired unfairly, or there were extenuating circumstances, be sure to tell you unemployment counselor about them. If your unemployment application is denied because you were fired, you also have the right to appeal the decision.

My FMLA is about to run out I have been on it for 10 weeks now but will have to have surgery on my arm which will lead me out of the 12 weeks that FMLA provides to you for keeping your job. Am I going to be eligible for unemployment when the terminated medically? Thanks is advance.

I worked for a restuarant for 3 years and was only written up once in that time period not relating to what I was fired for. It was fairly late and I was unaware there was anybody still sitting at the bar because there was a wall and I could not see, I was cleaning drop a broom hit my knee really hard and said the most inappropiate cuss word, the "F" bomb word. It was definitely a reaction and the people at the bar heard me and complained to the manager. Without a write up or warning they fired me the next day. I spoke with the district manager who investigated it and still upheld the termination. This is a fairly large corporation. I was a positive and great worker and under normal circumstances would of never cussed, but I reacted after being hurt and was wrongfully terminated. Is there a chance I can still collect unemployment? I live in the state of Florida

I was fired through an email, and was warned also through an email, is an email considered a legal write up even if i have never signed it, and was not able to defend myself?

i have worked for my employer for three years as a manager.He pulled me in the office last month when he found out I was in college and said since I'm in school and looking to move on he feels there should be a change.He also stated that if there is a position where I live I could move over there for a less postion less pay and probly less hours.I assured him that I was not going any where that I have another year of school.But I just found out he is training my replacement.I am the only provider in my house with a husband who is disable and a child and school. Cannot afford to lose my job or take a lesser pay.He assured me that I did nothing wrong.He owns multi businesses can he force me to change my profession and take a lesser pay?And if he lets me go at no fault of mine can I get unemployment?

I believe that upon my return from unpaid FMLA because I am a store mge,I am considered a "Key" employee and company doesnt have to give same position that I will be offered a much lesser position at a great decrease in pay;if I do not take it,is this quitting and I cant collect unemployment?Company is closing all but 3 locations in the area and at this time,are"down sizing" by letting people go under performance issues,ie,store appearance,smal l things to get around unemployment issues for company which is why I believe they will do the "key" employee thing,tho nothing has been communicated.Have commendable 10 year history with company,no writeups. If I go back and am fired for not getting weekly goals,appearanc e of store,etc,can I collet? Do not understand,if you quit or get fired you cant collect,so how or what do you do?The lesser position is also partime and I will loose my health benefits as well.I have never filed before but if I am to find another job,which is real bad right now,what am I susposed to do,I literally have no moneynow,single so no financial help and the 9 and 10 hour shifts without breaks and being able to sit at all caused the medical reason for the time off.I can work,tho same shifts,which will be required will put me right back where I was,unable to walk and drive,which is why I have been trying to find different job during this leave,but I have nothing now and must go back to work to eat.What are my options,what am I susposed to do? I dont understand,quit ,fired,what else is there? please help thank you

Hi, have been on FMLA for various reasons but mainly having surgery on my knee and the need to have surgery again soon on my shoulder. My job does not put me in a position where I can heal properly. As a supervisor I was advised to speak to the department manager to see if I could get an extended leave but that request was denied. If I go back to work now I will not be able to miss additional time that will be needed for my upcoming surgery in April. Am I going to be eligible for unemployment if I am terminated medically or if I resign medically?

i've been working for a company for almost 1 1/2 years and recently a couple weeks ago i've missed 3 day of work because my car wreck down , so i didn't have car at the time but they calling me now from work about this issue . if they fired me for this would i get unemployment ??? or what should i do ?

I was fired after 8 years of working for the same company. I was laid off for 2-3 months each year and always returned. The last time I went back a new system was in place. They gave me about 40 minutes of training and then explained I was not getting it,. They transferred me back to my old position and stated that clients were complaining. I had six issued over a 4 1/2 month period that proved the client correct I was paid half pay but continued working. I was retrained for another 40 minutes and went on. When they hire new people they receive 2 weeks training and are given 2 months to get the work. Can I still collect unemployment because I was improperly trained for the position.

I have been working with my present company for 11 years. Last year I reduced my hours and took a full time position with my local school board. However, I was laid off through budget cuts. I was told from my current employer that they can grant me 20 hours for the summer. So I filed for unemployment, when I did this all my benefits were taking from me without notice or any type of explanation. Then miraculously they found hours for me so I did not have to collect unemployment. Now they are reducing my hours week by week and gave it to an ex employee that had left without notification. Help,,,, what can I do. I believe they gave me the hours so they didn't have to pay my unemployment benefits and now that they don't have to they are reducing my hours and also other things to make me quit.

I put in my resignation because i have misssed alot of days of work due to my son being ill, on a particular day i had requested the day off and they told me that they would sign off on it on the same day beacause i might not have to use all 8 hours, when i came in that day the told me to go home, i thought they were going to fire me and i put in my resignation, a couple of days later i found out that they were going to give me a verbal because i never had a disciplinary action on my days, so i then resended my resignation and was told by the director that they did not allow me to resend my resignation because i missed to many days. I have never even recieved a warning and i have had Dr. notes for about 95% of the days that i have missed. I asked if there was anything that i can do to stay at my job even if they put me back on a probationary period and they told me no. Do i have a case and does it fit under me quitting or being let go? please help me my last day of work will be on June 22nd thanks

I was fired from my job because I was arrested. This was not job related and happened on my day off. I did not miss any time off work and was on time the following day. It states nowhere in my employee handbook that I must report this infraction. I was reading online because in the denial letter it states " terminated due to misconduct" but misconduct was defined as anything on the job or off the job while conducting business for the job. My arrest had nothing to do with nor would it affect my job. I have never been written up nor have I been verbally rapimanded. What can I do about this

I finally have reached the head of the company's list of employees to fire. I felt that over a year ago when the company merged that something was wrong. They began firing employees but recently they've cut our whole division by almost half in the past 4 months. The company is also getting ready to negotiate with the union for union employees and we all received heads up to get ready to be bussed anywhere the company choses to shore up the staffing when the union employees walk out. After the merger the company made no more attempts to fairly compensate it's empoyees, demanding mandatory overtime without proper breaks during the extra hours.I questioned that going from a 6 hour day to a 7 hour day meant I would need an additional break due to state law. They reluctantly gave me an additional 15 min break but this happened twice more the second time I again had to ask for the extra break but the third time I waited to see what would happen. I had a 7 hour day with only one 15 minute break. I even advised the company to be careful sometimes the government audits companies for proper record keeping and policies and that was my intention. I loved my job before they began demanding the impossible from us. I still do the very best I can in my job but I see the writing on the wall. They've covered themselves by requiring the impossible then when we can't do it they'll have every right to fire us. Just after the merger many of us had work many hard overtime hours to use for personal time the company said with the takeover all those hours would be eliminated and we would get no compensation for them. Under the new rules we can work "overtime" for vouchers to apply to "infractions" should we be over 2 minutes late reporting for work or have a personal emergency that needs taking care of. I see an uphill battle trying to get my unemployment when they fire me. I am the very last part time empoyee this company has the only other one left over 2 months ago. They've been working on automating our positions and have outsourced to overseas call centers already during evening hours which will pick up our slack. If I get fired would I still qualify for re-training if not actual unemployment salary?

I have worked at a company for a year and a half and I have got really sick, and have been out of work several days and weeks. I have been told that if I miss anymore days I will get fired. If I have all my doctors notes. Would I be able to get unemployment?

I am working for this company for almost three years. since last year I have been having certain problems so they given me a couple of warning due to errors. I was suspended for two days but I have never being late nor missed a day other than my vacation time or sick days that are part of my benefits. At the end of this year they suspended my bonus and they did not give me the rise that correspond to every employee. the are putting me under pressure to resign. I do not want to resign. If they fire me do I have right to collect unemployment?

I have been on short term disability due to an incurable heart condition brought on by stess and anxiety due to my job. My doctor released me to go back to my job, part time - 26 hours per week beginning in April. To do the job correctly, one needs, and is expected to put in over 40+ hours per week in high stress situations. If the company does not accept part time hours and terminates me, will I be able to collect unemployment from Florida?

I was terminated after 5 years of employment, for calling out ill on a day that my supervisor had not approved when previously requested as PTO. I have never had any write ups for or verbal warnings, had two years of perfect attendance and missed a total of 7 days in five years. Can I still collect unemployment until I find another job?

Hey y'all I got a question and maybe someone can help. I'm about to be 20 years old, so I don't know much about this. I work at Waffle House in Florida. I'm the new girl and haven't been trained that well. I'm kinda just picking it up as I go. There has been some talk that a lot of people are about to be fired. I'm not sure if I'm going to be one of them but, the only reason I would be is this: the other week my boss was on grill and in charge of pulling the meats. I had an order and said loudly PULL ONE HAM I had said it like 5 times and my manager wasn't paying attention. He was talking to another employer about something that had nothing to do with work. So I yelled RECALL PULL ONE HAM! he look at me and said " does it look like I have fingers in my ears I'm busy ok" so I said no you weren't you were talking to her about something not work related then I said I'm just being honest. He said " we'll go be honest somewhere else because if you keep that sh** up you won't be working here anymore. I left it alone and didn't say nothing more. A week later I called out of work for one day because I was very sick and since I handle food it's a health hazard. Since then he has taken me off the schedule and crossed my name off and put someone else's. I only work one day this week for 5 hours and I live an hour away. If he fires me do I have the right to file unemployment? I've only been working there a month and a week?

s working at a company for 3 years and making good money then it took a turn and money was bad so i went to work for a competeter and was only there 2 months and let me go for not enough sales can i collect unemployment or did i have to be working my 2nd job longer
