Florida Unemployment If You Quit

You can not receive Florida unemployment benefits if you quit your job.

In order to be eligible for unemployment benefits in Florida, you have to have lost your job through no fault of your own. This means that if you quit your job, you can't get unemployment.

Be sure that you can not quit your job because you didn't like it, or it was too hard, or because it didn't pay enough, or because the hours didn't work for your schedule - and still expect to collect unemployment.

If you are in a hostile work environment, or otherwise feel like you have to quit for a very good reason (such a threat to your health or safety), please take the following advice:

The laws and requirements for unemployment eligibility vary from state to state, but most states do not allow you to collect unemployment benefits if you voluntarily quit your job. If a state does allow you to collect unemployment when you've quit your job - the requirement to do so will be VERY difficult to meet.

In most states, if you are fired for cause you may still be eligible to receive benefits - and the requirements in this case won't be as stringent as if you had quit.

It is my understanding that employers generally do not comment extensively on previous employees, or on the reason that they are not longer at their company, for fear of being sued. Most employers will generally verify employment dates and not comment on the reason you are no longer there, or offer any further details.

If your company fires you though, you can be sure they won't be writing you any recommendation letters.

I know how difficult a hostile work environment can be. I've been there. Still, I would suggest that you do not quit your job. If it is a large corporation, you should talk to someone in the Human Resources department about your situation and the hostile work environment. If you get fired and you have a wrongful termination case, it will be more difficult to appeal your case to the employment commission or more difficult to bring a wrongful termination lawsuit - as you will have willfully quit.

Millions of people are out of a job - so it looks like you'll be diving head first into a very difficult job market, no matter if your fired or quit.

Make them fire you.

Go on about performing your job duties, and do not do anything to provoke them to fire you. If they're going to fire you, they'll do it. If they continue the hostile work environment tactics, or increase them - you should contact the employment commission to see if you have any recourse or protections - as there are federal laws against hostile work environments.

VERY IMPORTANT:

Don't sign anything!

Don't sign any releases, forms, waivers, or anything.

If they present you with paperwork that has to be signed in order to receive a severance or your last check -- Don't sign it!

Take it to a lawyer, law school, smart aunt or uncle, or research and ask about the terms in the document online.

If you do end up signing it - remember that it is a legal document, so understand and agree to everything in it before you sign it. Also, remember that the terms are negotiable, because it is essentially a contract. If they want you to agree to their terms, you have the right to either:

a. Not sign it.
b. Negotiate the terms of the agreement.
c. Sign it.

Examples of ways you can negotiate this legal document, which is often referred to as a 'Separation Agreement':

a. Demand that the agreement state that you are being laid-off, not fired.
b. Demand that the company will not challenge your claim to collect unemployment benefits.

hi, I'm a fragrance rep and we are off 3 times a year that my boss gives us unemployment.My boss left a message on my phone saying she going to let me go the first of the year, trying to threaten me if i dont make my numbers.She often calls every monday.I called her back and told her that if your letting me go, I will go now.She wants to use me for christmas and let me go.We collect in Jan because we stope working amyway.Can I collect or can she try to stop it?

if u do not reply to the ucb-412 they can receive unemployment then when u protest if they were at fault ur account will be credited then they have to pay it back to ur account.

my job is a hostile envirnment. the boss also treats women different than the men. my boss yells and has even put his hands on a female employee and shook her. this has happened a few times. i have a letter from my doctor stating the job is effecting my health. there are other thing but just wanted to know if this is a reason that i can quit my job and still get unemployment

I work for someone i've known for a few years outside of work and she hire myself and her son (that i was also friends with). my boss will fire and rehire her son almost every week and he can do what ever he feels like doing while at work. Because she has become very worried about her sons emotional state she has stop being on his case about what he does at work. And has directed her anger towards me. Giving me nasty looks having a bad attitude etc. but towards everyone else i work with she is nice and respectful. but to me she will get upset at me for going to the restroom. ive been told i can be replaced. i feel i havent done anything to her to deserve this and i do more work in a day than her son does in 3. Is this considered a hostile work environment or just a bad situation i have to deal with?

I was lay off from my job for the first time and I apply for unenployment and I look for job in the morning. At night I go to school part time and I report it to them, so they sent me the first check for one week only and now they stop my check because I report them I go to school at nite. I need to know if because I go to school , they will stop sending me my check. Please advice. I need to paid my bill, rent etc and not having a job or any unenployment check. I don't know what to do.

ok so i have been working for this medical office that does not give benefits but stated that we do receive raises after 1 yr.. this is going to be my 2nd year with them and they have refused to give a a review until 3 days ago. i went form my meeting and everything i thought went great until i asked for my raise! and he freaked! he screamed belittle me until i felt like nothing. and then to top it off he threatened me! he told me i needed to leave his office before things got real dirty! then i asked him if he was threatening me and he said like i said if you don't leave its going to get dirty in here!he was very angry! i am a 28 yr women and he is a 65 yr old man.(big man)i left in tears i am scared now. i feel very uncomfortable working with him. i don't know what he meant by it. i was being nothing but professional. and unfortunate i have nothing in writing and he even said to me "that is sux that i don't have anything in writing doesn't it" but i still have 2 vaca days left and they are refusing to let me take them at this time. and i think they are looking for an excuse to get rid of me so they don't. have to but all i want to do is leave. am i able to leave and them pay me for my vacation days? please help

I'm about to quit my job.
I'm very sick cand handle anymore ...
Just have my 3 syrurgia and I do have my right hole arm until shoulder with problem got joint efusion and something else..it's quite a be different things in my health .I'd like to know if I'm qualified for unemployed so I can still afford paid my doctors and medication ..I've been work for 6 y in this company .

I see that I can't receive unemployment benefits if I quit but what if when my contract is up in July my company is going to change my pay and decrease it by 75%? I will be doing the EXACT same job but be getting paid only 25% of what I am being paid now. This is a full time job.

I was laid off from my job in janurary and started recieving unemployment, i started a job at a mental facility and have been working two weeks and it is too emotionally stressful for me due to the mentally ill patients. Can i quit my job and still recieve unemployment from my previous lay off if i still have unemployment benefits available?

You can get unemployment in Florida if you have a good reason to quit. But just make sure you appeal and keep filing your weeks. This total process takes about three months. You will get a nice check if you win but you have to weather the storm.

I have for a fact, quit my last job and collected uneployment compensation from the State of Florida. You CAN quit and collect, it depends on the reason. One reason is if you quit because the employer changed your work hours.

My boyfriend had to quit because thave hinm one week noticethat he would be transfered to a location where he went form driving 58 miles roundtrip for work to 110. He did it for 3 months and filed a grievance because 2 women get 4 10 hr days one due to mileage. Comapny said no to him! Told him to mind his own business and suck it up...He quit. I cant believe a company can get away with thid. If you let one person do it then you must be prepared to let others in my opinion...

Hi i quit my job in florida due to the flooding my home was ruined and my only option was to move to kentucky with family, therefore i had to quit my job of 13 years because i could not transfer to a location here. Can i still get unemployment? Is that a good enough explanation?

i work for a cleaning company here in jacksonville and im the only male employ for this company i have not worked for a week now and my office sends me a text today saying that my boss wants to talk to me and for me to come in today so he can talk to me i go in to talk to my boss and he tells me that the other girls working there do not want to work with me anymore and that i might want to start looking for a new job is there anyway i can get unemployment since i am forced to find a new job

My office is relocating, I presently drive 40 miles round trip to work with the relocation I will be driving 70 miles round trip. If I do not relocate with them can I draw my unemployement.

Sales compensation just changed from salary to commission. I will lose money to work. I travel 100-200 miles per day in a car with 180k miles. Expenses (mainly gas) are a "maybe". I have to sell and than deliver. Delivery days will not be selling days. There is no time to seek another position and continue here losing time and money. I feel boxed in, in a no win situation.

I am in a hostile environment, intimidation, harassment, and they are trying to make me quit. It is causing major health issues my doctor has put me on medication for stress and anxiety. Can I quit with a doctor’s note saying that I need to and still get unemployment from the state?

I refuse an assignment on a job that I have done for the past 11 years due to the unsafe conditions that would occur and refused to clock in till it was remedied. Long storey short, I was put on suspension without pay pending investigation and was advised from my union rep to seek unemployment benefits for the week that has been lost of wages so far. Am I elegible, or would this be on a cases by case basis? Thank you.

I have worked with my employer for over 4 years, started as just small business, then over the years became very successful and many employees. I have never been given disciplinary actions, reprimanded, or told my work did not meet expectations. Since company was growing he hired another man to do pretty much what I was doing but gave him a CEO title. I was practice manager, and still no signs of anything wrong. Meeting was held stating to all employees not to be alarmed for I was not going anywhere. one week after the CEO started, my boss and him walked in to my office at end of the day when everyone was gone and told me he was going to accept my resignation letter. I was confused, and didn't understand. He said I didn't do a couple job duties and that was that. I begged him not to do this, and I did do those duties, but he didn't want to hear any of that. He wanted me to write a letter stating I resigned. I was crying and said please let me fix these so called allegations. He couldn't care less about anything I was saying. I didn't want to write the letter and didn't know what to say. I just sat there for 15 minutes, and finally just wrote, I resign and signed my name. I wasn't thinking about what I just did because this was all a complete shock.
I don't know if I list that I was fired or quit. Since legally I did sign saying I resigned, but it was very clear I was fired. I begged him to please let me stay working. I loved my job. I built that company with him all those years, we started it together. All my hard work and family missed for nothing in the end.

Was Fired on Mothers Day I was coached for absenteeism on April 22 Hadn't missed work since but management . Had 6 points when coached in April Was told Mothers Day that I had 9. Was told by management that I worked only four hours on 4/22 and was told that I had two incomplete shifts in May Which I did not I got rid of some of my overtrime those two days And on 4/22 I had forgot to clock out for lunch I fixed the mistake at a computer with another manager. Tried to explain to the manager that fired me that I hadn't missed work since I was coached He was rude and wouldn't listen to my side Kept cutting me off He told me I was fired, Then talked to upper managment and she looked into my firing . She told me it was a computer clinch. She told I could come back to work my next scheduled after being off four days without pay. Asked if I would get paid for the time off she said no use my vacation or personal time. I shouldn't have to use my time for their mistake. Now I'm upset and scared of the manager that fired me. Because he's so rude and I think he has it in for me. Can I collect unemployment if I don't go back to work there

My boss had a meeting and without letting me know about it( I basically run the warehouse, shipping, recieving, do po's,inventory, and organize two other companies that do work for us) tells this new part time employee he can stay longer so we can get work out but I was told that I can't work overtime and must clock out for lunch even though I'm doing one or two things of the many positions I do in my job. I went in to his office with his daughter who is suppose to be the president of the company and told him I would like to be told about things like this before he makes an anouncement like that and that the new employee is not worth having for even the hours he works. We also talked about this new incentive program that he made up about a check at the end on the month as to how much we get out. I didn't understand it and wouldn't know if this was better than a raise until the end of the month. He stormed out of his office and went to lunch and when he came back called my boyfriend in the office and said that I said I quit and was moving back to NJ and that he wanted him to stay and he could even live at his house until he got established and he would drive him to work. I went in his office and asked to speak to him after hearing this and my boss refused to talk to me saying that he was too upset and I asked when was this and where did I say that I quit? He said right here and he wouldn't talk to me about it until monday. My question is since I didn't even quit but he says I did can I collect unemplyment?

My husband hasn't received his last 2 paychecks. His employer hasn't paid any of their employees on time for the last 8 weeks. This is causing our family great distress. We can't pay our bills or buy food if he can't get his paychecks. Is there anything we can do? He's looking for another job. But we still have to pay bills & eat until then.
