In order to receive unemployment you have to be unemployed through no fault of your own.  If you get fired from your job your employer may have a valid reason for firing you, and thus it is your own fault that you are unemployed, and therefore you are ineligible to receive unemployment benefits.
 
There are, however, situations where your employer did not have a valid reason for firing you, in which case you may be found eligible for unemployment even when you get fired from your job.  These situations are rare, and the ultimate decision whether you can collect unemployment could be arbitrary - and often only settled by making an appeal, and having a a special eligibility appeal hearing.  If your employer violated the law in firing you, it may take a lawsuit in order for you to collect unemployment and be compensated for your lost job and wages.

Situations where you MIGHT still be able to get unemployment if you get fired?
  1. You might still be able to get unemployment if you were fired because you were asked to break the law, and did not do it.  It is illegal to ask an employee to break the law.  In this situation, you should consult an employment or labor lawyer.
  2. You might still be able to get unemployment if you were fired because you did not respond to innapropriate, sexual and/or romantic advances in the workplace.  Sexual harrassment is illegal and you should consult an employment lawyer.
  3. You might still be able to get unemployment if you were fired because you served on jury duty.
  4. You might still be able to get unemployment if you were fired because you were asked to violate professional regulations or code of ethics.
  5. You might still be able to get unemployment if you were fired because you were activated for military duty, or otherwise fulfilling your obligations to the military.
  6. You might still be able to get unemployment if you were fired because you were a "whistle-blower" or otherwise reported your employer's or workplace's illegal activity or conditions.
  7. You might still be able to get unemployment if you were fired because you filed a workman's compensation claim.
  8. You might still be able to get unemployment if you were fired because you talked about your salary or wages with a coworker.
  9. You might still be able to get unemployment if you were fired because you filed a safety complaint with OSHA.
  10. You might still be able to get unemployment if you were fired in a way that violates your employment contract.  Employment contracts do not have to be written down; they can be 'implied' through verbal conversations.  If you think this is the case, you should consult an employment or labor lawyer.
  11. You might still be able to get unemployment if you were fired for exercising your legal rights as they relate to the workplace.  If you think this is the case, you should consult an employment or labor lawyer.
Don't Sign Anything!
 
If you get fired you employer may ask you to sign some paperwork or documents before you leave.  DON'T SIGN ANYTHING!
 
If you believe that you were improperly or illegally fired, it is very important that you do not sign any documents that your employer asks you to sign while you're on your way out.  They cannot hold your last check unless you sign any documents - that is illegal.  They may try to tempt you to sign some documents in exchange for 'severance pay' - DON'T SIGN ANYTHING if you know you're in the right.  Some employers may try to get you to sign a statement that says that you know you were wrong, that the employer terminated you for a good reason, and essentially giving up any rights you may have to collect unemployment or sue them.
 
You Will Get Denied If You Get Fired For 'Just Cause'
 
Every state is different, and each situation will be handled on a case-by-case basis.  If you apply for unemployment after you've been fired from your job, and your employer had a valid reason to fire you, and your employer followed all of the laws and regulations in firing you, you will almost certainly have your application denied.
 
You Should File Even If You Get Fired
 
I believe that there are some situations where people who were fired from their job should still file for unemployment, unless you willingly and knowingly caused yourself to get fired.  Often employers will fire people for minor, but valid, infractions just so that they don't have to have to pay them anymore.  Some companies will go on a 'firing spree', by firing people for small infractions, right before a laying off lots of people so that they can try to get out of paying unemployment benefits to the people that they fired.  Also, you should still file for unemployment, even if you get fired, because your employer won't challenege your application.
 
File an Appeal If You Are Denied Because You Got Fired
 
If you believe that you were improperly or illegally fired, you should appeal the denial of your unemployment application.  After your claim is denied, you will have to file an unemployment appeal.  If you have to file an appeal - this means that you employer is challenging your right to collect unemployment because they fired you, and you will have to have a special unemployment appeal hearing.  Making an unemployment eligibility appeal can be a slow, complicated process.  It could take weeks or months for your appeal to be processed, and it could take weeks or months to get an actual eligibility hearing.  If your rights were violated or you were illegally fired, you should contact an employment or labor lawyer.
 
Situations where you WILL NOT be able to get unemployment if you get fired from your job?
  1. You will not be able to collect unemployment if you are fired from your job because you did not do your job correctly, or to the standards set by your employer.
  2. You will not be able to collect unemployment if you are fired from your job because you were drunk, intoxicated, or using alcohol or drugs in the workplace.
  3. You will not be able to collect unemployment if you are fired from your job because you failed a drug test.
  4. You will not be able to collect unemployment if you are fired from your job because you were insubordinate.
  5. You will not be able to collect unemployment if you are fired from your job because you violated company policy or the terms of your employment contract.
  6. You will not be able to collect unemployment if you are fired from your job because you were late for work or did not show up for a shift.
  7. You will not be able to collect unemployment if you are fired from your job because you were sleeping on the job.
  8. You will not be able to collect unemployment if you are fired from your job because you committed a crime on the job.
  9. You will not be able to collect unemployment if you are fired from your job because you stole money, goods, or property from your company or coworkers.
  10. You will not be able to collect unemployment if you are fired from your job because did not meet your sales or production quota.
  11. You will not be able to collect unemployment if you are fired from your job because did not know how to perform the requirements of your job.
  12. You will not be able to collect unemployment if you are fired from your job because you falsified your time card.
  13. You will not be able to collect unemployment if you are fired from your job because you lied on your job application or resume.
  14. You will not be able to collect unemployment if you are fired from your job because you were disruptive or hostile towards coworkers.
There Are Rules on How To Fire Someone
 
Just because you broke the rules, or did something wrong on the job, doesn't necessarily mean that your employer can fire you immediately.  In some states, there are rules that govern how and why and employer can fire someone.  This varies state-by-state, so it is best to consult an employment or labor lawyer.
 
At Will Employment States
 
If your state is an 'At-Will Employment' state, your employer can pretty much fire you for any reason, as long as it is a legal reason, without telling you why.

Non-At Will Employment States
 
If your state is not an 'At-Will Employment' state, employers have to follow a certain procedure, and have valid reasons, which are collectively known as Just Cause, in order to fire you.
 
There are seven principles or 'test' which determine whether and how an employer can fire someone:
  1. Did the employer warn the employee of the consequences of his or her actions?
  2. Are the employer's rules and regulations reasonably related to business performance and efficiency that the employer might reasonably expect from the employee?
  3. Did the employer make an effort, before firing the employee, to find out if the employee was guilty as charged?
  4. Did the employer conduct a fair and objective investigation into the charges about the employee?
  5. Did the employer find sufficient or substantial evidence of that the employee was guilty as charged?
  6. Did the employer apply the rules fairly and without discrimination?
  7. Was the severity of the disciplinary action or firing reasonably related to the seriousness of the employee's offense and the employee's past performance and employment record?  In other words, did the punishment fit the crime?

I was on the last chance plan for my attendance when I was fired from my job after 16.5 years. An altercation occurred where I used a profane word once, Because of this they denied me unemployment . Is this action legal ? I cannot find a job nor can I collect unemployment . What is my next choice ? I don't know .

I was on vacation at Disneyland for a week, and the day I came back, my GM called me in for my "Bar Assessment" (bartender). When I arrived, my GM, AD and I started to joke around and talk about Pujols going to the Angels. Then, my GM said "We know that you're going to be successful in whatever you do, and we wish you well.".. I started laughing because I thought he was joking still, and he had a serious face on. I asked why this was happening, and he nor the AD could give me a specific reason. I asked them "Is it because I just turned 30 (3 days prior)? Is it because I cut my hair (went from in the middle of my back to about 2 inches long, not by choice)? Is it because my full time benefits start in 20 days?" and both of them at that point said "NO NO NO Nooooooo". My GM said it was a decision was that of Corporate and then the management team.

I have worked for Chili's for over 4 years and 1 month. I won every contest my store had except for once, I came in 2nd. I had the second highest PPA (Price Per Average guest) when they fired me. I always had recommendation and guests commenting about how I was the best bartender and/or server that they have encountered anywhere. I always picked up shifts and stayed late when asked. I worked through breaks (every Sunday evening for over 3 months, my manager told me to sit at a nearby table during my unpaid break so I can make drinks when they came up). I worked 15 days straight and my manager told me not to clock in and he was going to add my hours to different days. Since I am a widowed single mother and my child needs regular inhalers and medication, and I was so close to receiving my benefits (Kaiser, great dental, great vision, life, supplemental life, a&d life, flex pay account and 401K), what can I do if I get denied unemployment? I've been sobbing non stop since they told me, and I'm always a happy-go-lucky person.

can I claim unemployment if I was let due to medical reasons. I was on a FMLA in washington and my 12 weeks is up 09/06/10 and my Dr has not released me until 10/01/10. They terminated me as of 09/06/10. I dont know what to do. This was not an on the job injury but the injury is agrivated by the work I do

I was recently discharged for allegedly falsefying company document.

I wrote up an employee for disciplinary action (I had written other employees for similar actions in past.

But this occasion, I did not have a witness to write up. Weeks later, the same employee had another write up, and my supervisor, upon presenting second write up was told by said employee, that she was totally unaware of first write up, and denied signature.

So I was fired....can I still collect unemployment insurance. I am thinking it is a case of her word versus mine.

FYI first write up, she "scribbled" her name (our company does not require a formal signature when write up is presented).

Your thoughts on this.

I was recently fired from a large shipping company in michigan. I had a couple of days where I showed up late. I did violate company attendance policy, but there are other workers who have way more attendance issues than I did, and they still have jobs. Also, they let other people know that i was fired before they informed me (my mother works at the same place, different shift, and she knew before i did). Ive been looking like crazy for another job, but its been a while and Im having trouble keeping my family fed. Would i have a valid unemployment claim?

I TOOK ALOT OF TIME OFF AND I WAS WRITTEN UP IN OCTOBER FOR MISSING TO MANY DAYS AND NOW HE IS ADDING NOT FILING TO WRITE UP. I AM VERY UPSET BUT I CANT AFFORD TO LOSE JOB SO I AM TRYING TO DO MY JOB WELL NOW HE COMES IN MY OFFICE AND DAMANDS TO KNOW IF I AM LOOKING FOR ANOTHER JOB I TOLD HIM NO NOT AT THE MOMENT HE SAID I AM NOT THE SAME AT WORK I TOLD HIM WHAT DID HE EXPECT HE DOESNT TALK TO ME OR MY OTHER CO WORKER WHO HE HAS TELLING HIM THINGS ABOUT ME. I worked for boa since 2002.After giving birth 2nd child and i went back to work on time and work stress made my postpertum depression worse.I talked to my manager and coworkers about my situstion,it was realy hard for me to do 3 people's job and after 8 hour work balance to the penny.I was terminated for force balancing is their anything i can do?

BOA is terrible. they let me go too for attendance and the other people there are late all the time and they dont get in trouble. also my boss yelled at me in front of our customers because i didnt notify him that i was going to the bathroom first before i went and the customer actually appologized to me and said thay he should never have talked to me or treated me that way. how embarrasing!! also he cursed at me all the time and told every one at work all of our personal stuff - everyone knew everyone else's business. how unprofessional and against the privacy laws. in addition he constantly made fun of the employees there because of their race and different things they celebrate and for people's haircuts and other things etc. on top of that they sent me to a center far away for a pay increase and a better position. after 5 weeks they told me they were sorry but they eliminated that position i was promissed and they should have told me sooner but that was all they could say! how terrible. this was the worst place i have ever worked my entire life. made my depression worst and everything. i went home crying almost everyday because of him.

That sounds just like a company I worked for. I liked the job except for the customer service manager who showed ALOT of favoritism towards certain employees. Those chosen few were always her snitches and loved spreading roomers and made fun of other employees whether it was work related or not. They did me a favor in firing me. I did collect unemployment because they had no justified cause.

I have been working as a medical asst.for 16months. I have had great performance reviews and raises. In Oct2010, I was approached by the doctor I work for and turned down dinner dates with,that the company was restructing and I would have to transfer to another city. I wrote a letter to HR and my manager on 11/08,that I had never been written up for anything and didnt understand why the transfer was taking place. Two days latter on 11/10/2010-the HR and office manager handed me a disciplinary action report for three incidents that I made on 9/27/,10/11,and 10/18. This were all false claims and I refused to sign it. After all, I had just two days prior given them a letter that I had never been written up??? I was given an ultamatum to turn in my resignation or take the job in the other city. Two days after that they handed me a termination letter stating that I was uncooperative and unprofessional and disruptive. So they fired me and wanted me to sign that paper too!!!! I refused to sign and cant help but think that its because the doctor I worked for was mad that I never accepted his advances. I filed for uc, and I'm scared that I might not get it. I have spoke to lawyers and they said touching me on my stomach and asking me out to dinner was not enough to claim sexual harassment...what kind of country do we live in???

Can I collect unemployment if my boss fired me due to personal reasons. IE: he claims we were "butting heads" b/c I confronted him about verbally reprimanding me in front of a clinic full of patients? I didn't say anything that night, but revisited the topic the next morning in a tactful way. I spoke to him in privacy and asked if the next time he felt I was doing something wrong, could he please pull me aside and not say detrimental comments in front of patients.

I was never told i was fired, just that this was my last day. My daughter in law came in to get a refund on some baby clothes. So I refunded the items and gave her a merchandise credit. It was only $8.00 and she didn't want it because she said she probably wouldn't be back in for a while so she gave it back to me to use. We argued, she insisted. So I turned around and bought my grandson a tshirt using the merchandise credit, never thinking anything of it since she gave it to me because she didn't want it. The store said that I didn't give the customer her merchandise credit and kept it for myself!! My daughter in law backs me up 100% and thinks she should go in and let them know, but i don't think it would make a difference now. Can I still collect unemployment?

I was fired for serving five days jail time for a domestic issue. I told my boss about it, but was told when I came back that I was fired for "no call, no show". I was not able to call out at all because it was a short time. Should I file for unemployment or am I wasting my time? Thanks.

I live in NYC and have been collecting unemployment for 3 months. I found a job but got fired in one week (I was told by the secretary "the chemistry isn't there" after completing a surplus amount of work (which no one else was qualified to do) they had waiting for me. What they needed was a full time temp.)

I asked the company of they could pay me as a consultant and not as a full timer and they said: "data has already been transmitted"

I have not yet reported returning to work full time or my earned income. I intend to report my income as temp work--but will this "transmitted data" raise a red flag?

Is there any way to keep my benefits without first losing them and then apealling to get them back?

Am fighting to get unemployment. Was fired for "just cause" but did not know that the action would get me fired until the day of the firing since there was no verbal correctives or write-ups. Also nothing in employee handbook about the violation. Am I crazy to pursue unemployment further and get a lawyer after reading all the WILL NOT situations for unemployment.

What did you find out? I am in the same position. Was fired for something that the bosses don't know others are doing as well. Borders on discrimination as well. No policies or procedures - let alone a handbook. How can an employer back up a dispute for unemployment benefits if there were no "rules" to begin with.

I was fired for absolutely nothing after 4 days. I did everything they told me to do, and I performed everything they taught me perfectly without any problems. I have a great upbeat personality, and was the only person polite to the customers there. I didn't even complain when they had be constantly running around all day with little to no moments of standing around, and they didn't give us breaks. We could only very quickly nibble on something we brought to eat, then run around some more. I was fired through an e-mail, and not even given a reason. I live in Nevada, it is an at-will state. Is there anything around that where I could still collect unemployment? Or am I screwed?

I was collecting unemployment and found a job(I live in Florida which is like your at will state) I worked there for 4 days and thought everything was fine until I was called into the office and let go. I asked why, he said for no reason..he just didnt think things were working out. So I left. Did you get unemployment? I hope mine is reinstated...Please let me know if you got it...Thanks Lisa

I am confused one of our workers made the comment a couple of days ago that she would like to gt fired so she could sit around and collect unemployment for the next three years. Today she showed up to work an hour late and was intoxicated, she was sent home but given a PTO day(paid time off).I think thats unfair to start with she should have not been given a days pay for showing up drunk. The manager did not write her up either but admits she should. If she is fired for this would she be able to collect unemployment with no written documentation against her?

I feel like I have an unfortunate and unfair case. Recently, I was let go from a hospital I worked in for 11 months. I was going to make a year there in May. In January I was promoted to a better position, although the pay and hours were basically the same. The work however was better and more convenient. A few weeks ago during my break, I got a huge migraine and decided to put my head down on my desk until my break was over. From what I am imagining, some of my coworkers took that idea that I was "sleeping" on the job, which I find is absolutely ridiculous since I would never in my life just "decide to take a nap" in the middle of work. I knew it was my break time and I put my head up as soon it was over. Whatever coworkers that told my supervisor I was "sleeping," made my supervisor report it to HR immediately, without calling me or asking me first--even though I have never been written up or warned. I thought this was unfair in it of itself because I've never had a violation held against me, so I couldn't imagine why my supervisor wouldn't try to clear things up with me first. HR called me, got my side of the story, and told me that all they had to do was match what I said to what my coworkers would say. Turns out some of my coworkers lied against me saying that when I put my head down it was not my break time and it CLEARLY was. I feel like I was corned against a battle of "he said/she side" and obviously no one took my side. To me, I feel that this is very unfair especially because they let me go immediately even though I know some of my coworkers lied. Can I collect unemployment even with my current situation?
My supervisor also wants me to come in to sign some "final paperwork," but I feel strongly against signing anything that I do not agree with, especially when someone lied against me. Please help! I don't know what to do!

I got written up because my drawer was off, but unlike every other store, we do not have our OWN specific drawer. It is shared between 6-10 people a day. They have no proof, no way of knowing if it was me or one of the other 5 people who messed up. I requested my own drawer before I got back on a register. They laughed at me and claimed that that isn't how their system works and sent me home. The next day they wrote me up for refusing to do my job.

Now they are telling me they will fire me if I 'refuse' to do my job one more time -- which I'm not. I'm asking for my own drawer to be held accountable for.

This happened twice and i was place on probation. during this probationary period i did not meet sales quotas although others did not also i waS FIRED.i pointed out that others in sales did not meet these requirements and i was told "but they are not on probation". I took my job very seriously and feel i was terminated because i was making a high hourly wage.

ive worked 4 a privately owned nursing facility for 2yrs and7months i am a qma and am very good at my job,a couple months back they took our pop machine out and after that forbid us to use the breakroom,the prior week to being fired my nurse said she was thirsty and i was 2 so i walked to the gas station on my break which is joined to our property 2 get us both a coke while there my administrator was there also she asked if i clocked out &i told her no and asked was i in trouble she just laughed and said no.the next week i got called in on my day off had left in a rush knowing it was already late and morning med pass is rough,well i left my cigs and money at home so on my break i called a friend and asked if he would get me cigs and a pop 4 my lunch he was not 4 sure exactly where i worked so i told my nurse i was going to lunch and i waited outside saw him pull in2 gas station so i walked in that direction to get my stuff from him we talked 4 maybe than a min i was in the road just barely off facility property administrater was sitting outside smoking she assumed that i had walked to the station this was a thursday i worked fri. had the wkend off was sick mon. and tues she fired me over the phone for leaving premises without clocking out.

I would add a 30 minute break to my two pregnant cashiers to their time sheet because i noticed they were taking breaks but not clocking out for them.So they fired me, can I get unemployment for that?

I was fired in June for Violating the Time Clock, but, I was actually following the rules that my Store Director had told me, which was that if I was scheduled until 10pm on a weekend, that I could not leave until 9:30pm to catch my bus. I finished my work, sat in the break room for the last 30 minutes and clocked out. But when he gave me my write up, he kept change the times I sat in the break room for. From an hour... to 45 minutes to 30 minutes... Can I still get unemployment even though I WAS following my Store Directors order?

I was apart of management on the job I was at. Was working there 2 1/2 yrs. Im now 4 1/2mths pregnant and I just got fired. They claimed that $ was missing and the store was robbed yet they have no proof or there just not showing me the proof that it was me and not another person of management. Iv never been written up or verbally warned and my boss even gave me a raise a few weeks ago. Iv been fired from the job now more then 30hrs and iv already been replaced. I think im being set up because im pregnant. This happended to another co-worker also apart of management when she was 3mths pregnant. A bunch of lies came about and she was fired but then re hired 7 weeks after her baby was born same pay and same position. I filed for umemployment but dont know if ill get it. I also notified the EEOC about this problem. Im being blamed for all this stuff I do bank runs and deal with the money all the time. And if they really think I would do something to lose my job while being pregnant why would they still allow me to close the store. Im just confused and uncertain of what to do.

ok. I've been workin for this company for about 10 months.my job was to ake boxes. About a month ago i had asked for a position switch. due to the fact that my left arm was hurting alot after work. i made sure to let them know about that. nothing was done and this is a job where there is alot of people working there. they have switched me before when i got hurt within a day so it was getting ridicoulos, i had made a 2nd request and nothing was done. the day before yesterday i reported to my supervisor my arm was hurting if i could be put elsewhere, but i coudnt make boxes. he said he would go talk to someone to see where they could put me. which was bull because company policy he was suppose to stop me imidiately. well hour went by and nothing im doing boxes in pain. so i get fed up when i see that people are going home when they could have easily switched one of those persons with me. so i left next day i go to work and im fired he said company policy anyone that leaves without clocking is an automatic termination. to be honest this wasnt my first time doing this and they knew i left before not once was i told anything and a buddy of mine had done the same thing a day before me he was not fired. if its conpany policy shouldnt he have been fired to. or was it that because i had reported an injury and was not taken kare of imidiately they knew they were in the wrong so maybe thats why they decided to fire me . i spoke with human recourses and she was even saying things didnt seem right. i was suppose to be sent to the company doctor the third time the made a report on my arm. which i had asked to see one but my supervisor was trying to talk me out of it he said he would fax paper to main office so they could call me in the morning. never got a called i reported it and nothing was done after that. well i come to find out yesterday that the main office has nothing to do with me being sent to the doctor they dont have that authority. i was suppose to be sent by supervisor kinda sketchy dont you think. i need advice should i get a lawyer due to the fact my hand and arm hurt still i think it was foul play maybe someone can help me out. thank you

When they would quit they gave me the responsibility to take care of the store and the team hire train and do everything that a manager would do and i didnt have the title or the pay. the first time i did it forcefully for 3 months . then they hired a manager and i return to my normal duties. the manager left again and they wanted me to do the same thing act the manager part. without pay. i felt like they were taking advantage of me and it was causing a lot of stress in my life. so i quit my job. can i get the unemployment benefits because of this ?

I was told not to give children under a certain age any food, when i did that a customer got upset with me and began to verbally abuse me! She informed the stores manager in which i don't work for the store and the he told my supervisor that they did not want me in there store anymore. Good evening everyone, i was fired from my job because they told me i stole from the company. My first week working i was given a check at the end of the week, i was never told how much i was getting paid until the next week. The enveloped i received had a check with a name that looked like mine ( actually the same first letters of the first and last name ) I cashed it at a check cashing place with no problems or questions at all. The receptionist called me friday night and left me a message stating i had to return that check, i sent her an email explaining i thought the check was mine and i already cashed it, she said ok and i didnt hear anything about for 2 months, all of a sudden i get a call from the check cashing place asking me why i cashed this other persons check, i didnt know what the hell this lady was talking about than all of a sudden it hit me! So we talk for a good 15 minutes and she said i need to pay this amount of $380 and if i dont than i will be reported for a criminal offense. I assure the lady i will pay the full amount and that was the end of the conversation. The next day i report to work and within the first hour the owner of the catering company i was working for requests i follow her to her office. She asks me why i stole this check and all of this other nonsense, i told her the receptionist gave me the check and the whole story, she tells me i am temporarily suspended and i cannont receive unemployment if i tried. I have never been fired before in my life and just finished serving six years in the Coast Guard. That was the last day i worked and after i talked to the owner i went to the check cashing place right away and paid the amount i owed, i got a receipt and a copy of the original check i cashed. Im sorry for such a long story but i am really frustrated and pissed off. I filed for unemployment last week and just got home from a long weekend and opened my mail from saturday. I was denied unemployment benefits because the catering company that fired me stated i stoled or posessed materials that werent mine. So my question is, am i eligible and should i appeal this decision the edd made or did i a break a law and dont stand a chance? Thank you very much for your time and effort with my problem.

I have been employed by the same company for some 20 years. For the past few years have been having trouble with a manager directly above me who seems to have a problem with everything I do. I have made several complaints to superiors as well as human resources but to no avail it is always some how my fault. I beleive what is occuring is harassment and am at my wits end. Ive been told recently that we are trying to avoid layoffs at hospital #1. I was than told after work that an individual management asked two employees themselves and another if I was working at hospital #2. Themselves was shocked an said I dont know. The other individual said yes. Management individual said thats against policy.
Can I be fired from hospital #1 when that hospital new when I submitted my application that I was still working at Hospital #2? When asked ive never lied an said I wasnt.

I was told it was too little too late. i am entitled to unemployment benefits, tey denied it and I am appealing due to the fact that there was improvement

Worked at assisted living facility. resident accused me of saying inappropriate things to her. the boss sent me home for two days, stating it was not a suspension, just to let things settle. The boss instructed me to return to work on a thursday, prepared to work. On Wednesday, she texted me to tell me that she had found several medication errors on my part. My duties would lessen so that I could focus on medication, medication records. I returned to work on that thursday, only to be fired after beening there a complete 2 hours. Other employees have medication errors that I personally fixed, as does the boss. Can I receive unemployment?

As an "at will" employee, you can be fired for any reason. Companies have the upper hand. Only a few exceptions such as race or age discrimination apply but you need to be able to prove that. For example, if you are over 40 and your employer doesnt think you are doing a good job, they can still fire you, and it would have nothing to do with age discrimination. Also, employers are not required to tell you why you are being fired. The law is on their side, like it or not.

I just got fired for "gross misconduct". My boss performed a finger stick on a resident and got stuck herself claiming the needle was left in the pen. Because I was the last one to document I had performed a sugar check, they assumed I left the needle, which I didnt. We worked by ourselves every shift and my voids was by herself when she got stuck. They said I had been counseled on my professional demeanor before, but I never had any write ups for medication issues. I showed up to work early, worked over and extra shifts constantly. Would I be denied?

I was given a warning letter (employed there a year and this was my 1st warning) that if I did not meet certain sales quotas within 2 weeks I would be terminated. I returned all of my supplies, filed for employment that following Monday, 5 weeks ago. Company sent a letter claiming that I was fired for insubordination . Another employee was fired after me for insubordination and has been approved for benefits, but I have heard nothing yet. My warning letter states that I will be terminated for lack of production, not insubordination . Will I be approved? It has gone to an adjudicator.

I finished my first month in training at number eleven out of six hundred i was handed off to my current supervisor and he told me he wanted me in the top ten my first month on my own out of transition. He told me to do certain things like upgrading phones as early as four months into contract when i Haag just been taught they had to be six months in. Well boss said to do it and notate approved by his name and since I'm there without him from four to ten pm daily just do it like he said and don't ask other bosses cause he doesn't want them knowing how he stays number one. I havea witness to the conversation. I did so well last month they audited my calls and my boss claimed he never said that. I went above him and complained and ever since he's been retaliating against me. If he fires me will i get unemployment?

I was "laid off" from my job two months ago. I was told I was being let go because business was slow. But my employer had threw in the comment that he had discovered I set up a freelance business. Mine you, to feed myself and daughter, to supplement the joke of a paycheck he was giving me. However he accused me of "stealing potential clients from them". I had no interest or ever did of solicting their clients for business. My employer stated they would pay me my "benefits" they owed me. I collected 2 weeks of benefits and then my loser employer filed a protest claim with employment, which stopped my checks. I get a letter in the mail from UNemployment saying that there was a "violation of company" and I wasn't discharged for lack of work. I was told to defend myself and the reasons for the violation. What violation??!! So I responded and say I could not comment on the violation because I didn't know what my employer was claiming. Surely, trying to generate extra income is not a crime. And I can not be faulted for their business not having any clients. Interestingly enough my discharge came two weeks AFTER I was involved in a very heated and insulting text message conversation with an ILLEGAL WORKER at the office. I politely reminded this person that I knew she was not a citizen of the USA and was undocumentated and being paid in cash and offered to call INS. She showed our text messages to our employers. I got yelled at by my loser employer. And two weeks later I got discharged while she still kept her job. After SHE started the text messages by insulting me, and once again my employers did nothing towards HER, when she offended me, or they told her to offend me on person. So now I sit waiting for a response from unemployment. And I can guarantee u if unemployment rules for the employer, I will advise employment that this employer has violated immigration and labor laws for over 5 years. They saw me as a potential whistle blower, and needed to get rid of me. I didn't sign any employment contract saying I wouldn't seeking part time work.

i was given warnings for certain infractions but not fired for them . The company decided to keep me on the job with a waring so weeks go by and i think everything is fine , the company had planned a meeting for a specific day , I missed the meeting due to a three day power outage and snow storm. on top of it everbody but one employee missed the meeting does anybody think i have a shot at collecting unemployment ?

i am a courier for a blood bank and on the back of the company vans is a sticker with 1800- hows my driving type thing..so anyone anonymously can cal and say whatever, if you get 3 calls your fired, i suspect the call that got me fired was a co worker, in any event what the caller said i did couldn't have happened, because of where and when they said it happened and the fact that when i signed in at my work, i tried to explain this while they were firing me but they didnt want to hear it the caller also said i was "talking on the phone" which i was not and i even offered to show my phone records.i had been warned and put on probation which i made it through that then this last call was what got me fired 2 months after my probation ended. im just wondering how can i get fired on the word of nameless stranger? it doesn't seem fair. is this considered "misconduct" or "poor work performance" and do you think i will get denied..im desperate!! please help

I am a General Manger and i was told on the 8th THE company had opted "At Will" separation . My direct report and Hr generalist came checks in hand, I am shocked and mortified, I DO MY JOB # 1 in sales comp any store i go to and It is documented how many asst. mgrs., 3rd keys, head cashiers I have trained/mentored.

Only reason for it sited by dm a new phrase this past week store "standards" not met. They are holding me responsible for unfinished tasks I believe he photographed in progress by my asst. mgrs. on 11/2 and 11/3 start of holiday conversion when I was off .

Can they do this?

For me to get someone fired these past years at my company took me a store level manger of 50+ assoc. at each str- numerous coaching and approvals.

But all Assoc. sign "at-will" doc. as well and I never got that approval once from any HR/DM/RM

seems unfair practice.

I filed for unemployment that day I hope they do not deny it - Irony i went to numerous hearings for this company to deny others unemployment I had separated from for truly were NOT DOING their Jobs.

I also heard from one of my asst, that day a new Man Manger was expected next day.

Sad and Disillusioned I thought this was a home :(

i was terminated for having only one write-up and no wite-ups for twe customer complaints which one said i saw a sexist but it was written on a piece of paper and that name was not the customers writing, another wrote that she heard an off color remark but that was not true.
i returned from my vacation and was told i was terminated but did not see any write-ups for this

i believe i was wrongfully terminated and for only one write-up. there were no other write-ups
i got an attorney and feel i was wrongfully term without just cause

I was terminated on Oct 31, 2011. The company came out with a new attendance policy when I was on FMLA. I had my 3rd daughter. The day I returned I signed a receipt of acknowledgement dated 9/19/2011. It stated the new policy would go into effect on Oct 1st 2011. It also stated since my date of hire 8/4/2005 my NEW effective date would be 11/1/2011. The disciplinary actions that apply for tardiness would be late 3 times- verbal conference late 5 times written warning late 7 times- 2nd written warning w/ possible suspension w/o pay late. 8 times- final warning and late 9 times - automatic termination. Well they only gave me a written waring after the 5th and that was give 19 days after it was issued. I had been late in between there but unsure how many I really had. After I was terminated I counted my days late and it only added up to 8. They were counting two days I was late on Sept 26 and again Sept 27. Those did not count because the policy went into effect on Oct 1st. They terminated me one day before my new effective date. I filed for unemployment but they denied it. I know I was tardy a lot, The new addition kept me up most of the nights.

I was recently fired....I was also denied unemployment. The reason that i was denied( absent for lack of child care & family illness, oversleeping, they also said i was warned prior to discharge)...I never had lack of child care....i was absent because no child care facility will take in a sick child. Also the family illness was my mother was taking care of my kids while i was at work and she fell. my 5 yr old called me to let me know what had happened. I informed my boss of what was going on and asked could i leave to check on them. He told me yes to go ahead. The following day of returning to work i was reprimanded by another boss because he said i didn't have the sick or vacation time to begone from work and also told me i should have had someone else to check on them....lastly i was never warned prior to discharge. the company i worked for has a points system for tardiness and absences. You are suppose to verbally warned on the earning of your first point. You are terminated after 5. I was never warned but told i had 6 points with out even knowing i had my 1st. so then i was wrote up for it. and it was sent to hirer management.

My minor daughter called the first day when I was able to get a collect call through to a coworker she explained the situation. The second day no one called in for me. I have worked there 7 1/2 years i have been denied unemployment and am on my second appeal. Any comments.

Hello I was fired yesterday. I was called into a meeting I was not told why. My boss started questioning me about an E-mail that I was supposed to take care of. I told him I had done it but I had ran into a problem so I gave it to my supervisor to take care of because my boss had told me if I could not figure it out to give it to the supervisor. Well my supervisor did not do it and I kept asking him to please take care of it I did not Want to get in trouble. My boss started screaming at me calling me stupid and saying I was worthless infront of my supervisor and the He manager.he did not let Me speak. I had just come back from medical leave due to my stress at work. He stormed out of the office. No one told me I was fired. I called today because j was sick. And that is how I found out. When I started almost 2 years ago I did sign an at will agreement. Do I have a case or can I collect in employment please help. I have no money at all.

I have been at my job for 9 months and in my interview I stated I was looking for morning shifts, I got the job and my shift was 6:45 to 2. Recently I had to accomodate another emoloyee and she need tuesdays and thursdays in tye morning so I did afternoon those two days. My new manager just came up to me and told me without asking if I was available to do it told me the other girl will be doing all mornings and I will be all afternoons, I told her I can do tuesday and thursday afternoon but I am not able to do the afternoons the other days. Can they fire me over that?

Another employee punch my tc, think she was doing me a favor since i just walked in. plus we just started the tc for over 2 months. It was an honest mistake and was not thinking this will happen since it was only 3 employees that punch in eventhough thiers 12 hourly employees in the office, others are just writing start time @ 8am and employers are aware of it. Since we have a new management and they have let go about several employees trying to find a caused.

I am depending on this job for living now with no unemployment and still have not find a job i am worried of being homeless and not having to provide food for my two young kids. Looking for a job makes it more harder since i have to full them out from after school program and daycare.

Please help!

They said since i was filing a complaint against my manager and not him telling us to falsify time cards im not protected. Basically i just added the falsifying time cards to the list of stuff he was doing to me and they said since it wasn't the main reason of my complaint....

I have been placed on investigative suspension with pay since the 3rd of this month
I am a sterile reprocessing technician and a load of instruments that i ran came out unsterile and was released as sterile by the person on the next shift, they came out unsterile because I had not started the sterilizer. I was distracted by an employee at the time the load went in..someone who should not have been there.
Sterility of surgical instruments should be checked by the OR staff before being used..since many people are involved and I am a link in this situation , what can i expect..termination/layoff

I was fired yesterday. I have been fighting for my pay to be correct for four months in a row. Well payday came and the woman who was supposed to give me my check. Was being rude and not giving it to me. I ended up complaining and swore. Not at her but about the situation. No one was around. She had given a written statement tho. I was very frustrated because it is my right to get my statement on payday. She also told me why does it matter to you? Arent you direct deposit? Well what does that matter. And she had no right saying or knowing that. She is not my boss.nor is she payroll. Do I have a leg to stand on for benefits?

I got let go about a month ago, not for my performance but for expressing how I felt because i was approached in a rude manner and unprofessional in front of patients and co-workers...i won the case but now she filed for an appeal, she had 4 co-workers write what happened to benefit her and not using there own language, and them signing it. now i have a hearing and she's saying I voluntarily quit, but in reality she let me go, why would i quit if i know the whole process of unemployment????

I was let go from my job for failing a drug test. The accident that lead up to me taking a piss test was because of faulty equipment. No fault of my own. The next night i returned to work and was told that i couldnt return to work until i took a drug screen. So after missing a whole night of work, i took the screening and took the paperwork to my employer i was told that my drug screen might not be valid through workers comp. because the drug screen was taken 48 hrs. after the accident occurred. do u think my claim for unemployment will be denied??

All these stories remind me of a former co-worker. She had a string of personal problems and I felt bad for her. Her personal problems were affecting her work performance. Consequently, she received a poor performance review and was very disappointed - especially in her skimpy pay raise.

Very seriously she said to me "I don't know how they can expect me to do a good job when I have all these issues going on!" It was an eye-opener for me that some people have such a warped perspective. Do a good job, and you will keep your job.

I have been off on a work comp injury since 7/19/11 I lost my voice from my job spraying bug spray while working and I had an asthma attack and severe coughing that hemorraged my vocal cords. I have been seeing a Voice doctor and they had me on complete voice rest for about a month and then returned me to work with restricitions of no excessive use of my voice and I did insurance collections which involved me to be on the phone 8hrs a day. My job adviced that I could not return until my doctor released me with no restrictions. Well I'm still off going to voice therapy and they mailed me my personal belongings in October and 2 weeks later sent me a certified letter stating that they needed to post my position and once the doctor releases me I need to call my supervisor to see if a position is open for me and if not will be seperated from the company. Well on 11/16/11 I received a Fed-Ex letter from my job stating due to contratual losses then needed to eliminate my positon effective immediatly. I am still on work comp and now what happens when I am finally released? Can I file for unemployment? I know that my job is lying since the are the worlds largest air ambulance company and are not contracted with most insurance companies and also just bought out another company in TX and havehad to hire more people. I found out that all people on medical leave for work comp or personal were all let go for no reason and received the same letter and their stuff mailed to them. The employees still their adviced that they are working overtime and they have hired more people. So how does this effect me to apply for unemployment once I am released from my work comp injury?

I was "dismissed " illegally as a teacher and the moron who did it was somehow allowed to keep her job though reassigned to another school. It was so flagrantly illegal, the district never challenged my application for UI despite the union having lied to me outright about my unemployment eligibility.

It had to do with an FMLA absence and a form. My "transgression" didn't even merit an oral reprimand, but this moron principal fired me because she didn't want me at the school.

Hi I used to work in customer service one time had a guest return something because wasn't working had free gift cards so when they bought another one in that same moment they got another gift card put it on the counter they didn't take it so when I was leaving I took the gift card I didn't think it was wrong I used the card at my job to purchase some stuff the card had a value of 20 dollars. So like to weeks later I'm called in to the office that what I had done was theft. I paid the money back at that moment I explained the situation I had no warning or nothing and they just fired me within a couple min. I have no money single parent can I file unemployment or there's no. Way I will be approved or anything that I can do. I did not kno I was wrong if I would have been planning theft I would have not used it there or atleast not with anything with my info on it please some advice I don't know what to do.

I left my job for another job that would offer me more hours and pay. I worked there for 3 weeks and all of a sudden they just handed me my final paycheck and told me I was not fast enough...the first two days I was there I was on my own and when I asked questions about how certain procedures were done I was ethier ignored or given conflicting answers. I later was told I would have someone train me for two weeks, but only got 5 days. Then when I filed for unemployment- which the state started paying me my prevoius employer appealed my unemployment benifits saying that I did not perfrom my job duties to their satisfaction. I then Appealed that in a written letter....now I have to appear in court for the appeal, I hope I win, but I am nervous if they will let me explain my situation or just ask me yes or no questions and then try to switch my words around and make it seem like what I said was different...

My daughter got fired from her job due to her (illness/sickness)being addicted to prescription drugs so she stole from her employer to buy more drugs.Isn't she still allowed to collect unemployment that she and her employer paid into? She has been clean for over 4 months.She can't get a job.If she doesn't pay her former employer $2500 in 2 months,she goes to jail.She should have been collecting for months.Then she would have half the money already,needed to pay him.Isn't she eligible to collect(Connect icut)because of her sickness(addict ion)?

I put my notice in on New Years,subsequen tly the fired me after my 10 am till 3pm shift and told me it was beacuse I was late which I was not and had not been for a week, however I had been prviously written up for tardiness...but not terminated...nor was there mention of termination...They waited a week later until I put in notice then they fired me! Is this Legal? Can you fire me because I put my notice in? That was his reason along with being late he just wanted to one up-me because I reported drug issues with other employees and theft.

They fired me 7 months after the situation actually happened, thay were going through a lot at the time, I think they were using me . In florida, is this legal?

I was just recently let go at my job. Which came as a complete shock. I was given a week off. And when I called to ask why they gave that week off to me I was told that it was my turn to take it off as others had already done. This was because of it being slow...I worked for a hotel. I accepted that answer tho not all to happy about it. I then asked when I would be returning to work as the schedule had not been posted. I was told to come in on Friday that week to check the schedule. I then asked if everything was ok and was told yes everything is ok no worries you are fine.Which I believed as I hadnt given any reason for things not to be fine. On Thurs that week I got a text from my boss asking me to come in at 10am on Friday. I went in to see her and she then proceeded to tell me that she had heard from other employees that I wasnt " HAPPY" with my job. That I had complained to several people about it. We were not getting any hours and I was upset as I have 3 children to take care of. I had already talked with my boss about this and she told me to hang in there and wait as hours would pick up. I was constantly being told that my performance was great! As she again told me the day she let me go. I told her she should fire the whole staff then as everyone was complaining. Anyhow I was shocked to say the least. I had never gotten any verbal or written warnings for anything. Always praised. My concern here is that she will make up something to keep me from collecting unemployment. Should I ask for a wriiten reason and a copy of my file? I have until Feb 2nd until I talk with the unemployment officer about the reasons for my separation. Just wondering if those 2 items would be of any help.......

i was fired immediately at work, they told me that i harassed an employee. they didn't do any investigations, or you can say it's one sided story. i even saw before in the rules on the board that they need to investigate first before firing out in the spot. can i get an unemployment in this situation? thanks

If you sincerely tried your best to meet the production standards and you could not meet the company expectations what makes it right not to collect unemployment if you are terminated? I find it hard to believe that you may run into a time in your life where you cannot meet production standards and you truly tried everything to meet there goals and fell short and caused your termination. Why would I not be able to collect my benifits?

They continued paying her as if she were there for about a month and then called her in to tell her they had to replace her if she could not return t owork. She then applied for unemployment, but has been getting the run-around and has not been told that she can draw benefits. Can you help?

well .. i worked at a chicken plant in shipping ... we load trucks and we got to use temp sticks to check the mdm combo's .. well i was in such a rush to get done cause they stay on our but about getting truck loadded i forgot the temp gage in the combo and the truck shipped with in still in the combo and i have been there for 4 years .. im only 21 i started there july 3 only three months after i graduated high school and the fired me .. and i really need unemployment so i can go to school ... anybody think i can

I was put on a 30 day probation, for having 3 incidents at work ,one was falling off a chair hurting by elbow, then rehurting the same arm again, then having been exposed to clorox spill. the other reason was a patient falling and said I left him on the floor, that is a lie. Then they complained about my attitiude. Then to top it off one of the dr. was yelling looking straight at me saying " they should fire her. I have worked for this company 3 years I have done nothing but bend over backwards for them. If I walk out will I qualify for unemployment or even if I wait will I still qualify. I was terminated without warning and with NO reason (CO is at will) I did my job well and all he said was it seemed like I didn't want to be there. This was just after my grandmother had died, I was very close to her, they almost did not let me go to her funeral. My boss had always given me stellar reviews, our new HR person asked him to rewrite his review. One of the partners gave me a horrible review and lied... regardless. I found a job in less than two weeks, but was there only 90 days before I was terminated again at my 90 day review. Can I qualify for unemployment benefits?

I was on unemployment for almost a year. I jumped on a work at home job with our cable company. I was doing ok, getting back on my feet when a 15 yr old student loan came knocking. Not working wih me, nothing, just garnishing my check. Now I only make enough for rent. I am having to take days off to go to food pantries to get food. I mean I cash my check and give the $300+ I made for the two weeks to my landlord with nothing for me. My hours were lowered and now I am not making enough even for my rent now. They are taking out the full 15% even when I am lower than the 30x min wage (like this past 2 weeks). Employers said they got a letter saying 15% and that is what they do. I am about to lose my place to live since I can no longer pay the rent, then I will lose my job. Can I go back on unemployment?

My employer did a mass hire months ago. Now that things are winding down and there is less hours to fill they are firing people in whatever way they can. Some for audits that they have upped requerments for. They have started to do random drug test/backround checks (in which I was one that be pulled). Firing people for points, such as having to leave early for emergencies/ having to pick up a child/ no childcare/ child being sick/ you being sick even with doctors note/ car braking down/ emergency surgery and so on, all of those you get a point against you, you get 8 points and you get fired. On the last QT they worked with me as far as my hours because I'm a single mom, they had to drop my hours to do so because they were unwilling to let me out early instead on coming in late like they had me scheduled. Now they refuse to work with me. I have tried even to see if anyone will swap shifts or cover hours but because they have a hold on over time right now, no one can.

If a person at this job goes to school they will work with them, even to the point of dropping them down to part time but the same company wont work with a parent.

Can someone collect unemployment for being fired for this?

If my employer specifically tells me to do something, I then do it and am fired because they say I should know better. Is there anything i can do about this?

I was terminated because I clocked in and out from my cell phone, I never received the handbook from this company on the correct protocol. It was an 800 number and was just easier for me to use my cell phone. I never received a warning I was immediately terminated, am I eligible for unemployment. If I knew this was grounds for termination I never would have done it or stopped my actions immediately.

Can I receive unemployment if I overslept for my job because of a documented obstructive sleep apnea. I have a doctor's note and proof that it was undiagnosed for years and that I attempted to resolve my oversleeping problem during that time.

I was taken from my Security office ( I am a coordinator)on New Years Eve to our investigator's office and a Union rep where they questioned me about removig food from our communal refrigerator a couple days before. First let me state that I have been there for 15 years and have an excellent working record. Because I virtually run the office area and also clean the frig, supply coffee whenever we run low, throw away old food every week ( with supervisor's permission)and order supplies, the lines between my kitchen and the office kitchen have blurred at times. We had a cookout and there were some loose pieces of uncooked frozen meat left for the next cookout along with boxed up meat in a common area of the freezer. One day I noticed that the loose pieces of meat were dwindling so I assumed that they were up for grabs, as we often were allowed cooked take-outs following a party. So, becuase I knew I wouldn't be here for the next one ( day off) I took my piece and put it into my tote bag whaich was on a table in the middle of the room in everyone's view. I never had any intent that it was stealing. I had also just supplied coffee that week and a ton of cooked food for the cookout so I felt justified in taking one. I was told by the investigator that the meat in question had been being audited daily and that someone wrote a statement on my actions. My Union rep went so far as to say that they had cameras in the area. Could have given me a verbal or written disciplinary but instead they just fired me. Of course all employees know that they start watching every thing you do after 10 years because 2 can do the price of 1 and they have been on a part time hiring spree for awhile. Of course I was denied unemployment because virtually everything falls under violation of company policy or misconduct. I have no other income and live alone (widowed). My Union says they will file a grievance and I'll have to go before a panel but I know my chances of getting my job back are nil. It used to be the only time you couldn't collect unemployment was when you quit your job...no wonder Florida has so many homeless.
