Do I qualify for unemployment benefits in Tennessee?

  1. You must be totally or partially unemployed through no fault of your own.
  2. You must have been paid sufficient qualifying wages during the base period.
  3. You must file an initial claim and continue to file your weekly certification as directed.
  4. You must be able to work and available for work. There are special provisions for individuals who become ill or disabled after filing an initial claim.
  5. You must make a reasonable effort to secure work unless you are returning to your employer in the near future, normally get work through a union, or are enrolled in approved training.
  6. Your first week AFTER FILING an initial claim that is approved is a waiting week, provided that any gross earnings reported do not exceed the weekly benefit amount. You must file weekly certifications for four consecutive weeks, meet all eligibility requirements, and not have earnings that equal or exceed the weekly benefit amount in order to be paid for the waiting week.
  7. Some claimants must have re-qualifying wages; your UI Claims Center representative will explain this to you if necessary.

The second is here:

Beginning Thursday, January 29, Tennessee workers will have another means for filing initial claims for unemployment insurance. This new service is a temporary measure to help relieve the state's overloaded telephone network for processing claims.

During the meetings claimants will complete their required forms.  They will be prepared to certify their eligibility on a weekly basis, either online or by phone, which is required as long as they are receiving unemployment benefits.  Staff will then approve and process the claims onsite.

In order to file during the mass meetings, the claimant must have been laid off from his job due to lack of work and must have a separation notice or letter from his employer stating that the separation was because of lack of work or reduction in force (sometimes written as furloughed).  Tennessee employers are urged to provide each of their employees a separation notice stating separation due to lack of work.  The separation notice form can be found at www.state.tn.us/labor-wfd/Employers/forms/LB-0489.pdf.

Requirements to participate in the mass claims session:

In order to participate in a mass claims session, there are certain requirements:
  • Must have been separated for lack of work or reduction in force
  • Must have worked only in Tennessee for the last 18 months
  • Separation notice or letter from employer stating lack of work as reason for layoff
  • Two IDs, driver's license or state photo ID card and another, such as birth certificate or utility bill in your name
  • Social Security Number
  • Address and telephone number
  • Separating employer's name, address and telephone number
  • Last day worked and places of employment for last 18 months

I was terminated from a position that I only worked in about three weeks. I was told that I was "not a good fit for the organization" I asked the supervisor specifically "Why am I being released?", her reply was, "I don't think that is relevant at this point" This came as a HUGE shock to me...considering just three days prior I was told that I was doing a good job "So far, so good". This is what I was told when I asked how my performance was. I am still waiting on a decision for unemployment. Is there any reason why my claim would be denied?

What is the "base period" in TN? How many months do I have to have worked in order to qualify for unemployment benefits?

When I get my wage transcription and initial determination in the mail, does that mean I am for sure qualified to recieve my unemployment? And if not, when exactly will I know?

No it does not it just outlines how much you could get if approved. Once you have filed they send a letter to the employer requesting a seperation notice the employer has 10 days to return it if its not sent back within that time a phone call is placed to the employer asking it be done at that point they either do not send it back and you are automatically approved or they fight it which can take a long time or they fill it out in your favor. It should take about a week to get the desision. Just remember to always do your call in every week even while you are waiting for the desision due to they pay back pay so always file. It takes about a month to get a desision. Good Luck!

I told my superviser 2 weeks in advance about my intentions.I told him I would be absent Thursday and Friday and would be back to work normal time Monday,he said it was ok to do so.
Reported back to work Monday and at first break was told "the company decided to fire me for attendance problems",by the Superviser.
I still filed for unemployment because I had gotten approval in advance.
UI rep called me and discussed the case with me and decided to spprove me for UI benefits, got several checks but have now gotten a letter saying my Ex-employer is appealing.
I prepared for hearing by what he said I was fired for which was due to attendace so I was surprised when they said they thought I quit and was a "No call,No show",in thus I was unprepared as I have a witness that saw me tell my superviser and he OKed it.Of course they denied that I told him when in fact he just forgot.
If they reverse the decision I will appeal it and have my witness present.(hopefully they belive me without having to appeal)
My question is what should I put as reason for my appeal?

Got a Decision letter.
It stated that Employer failed to show misconduct, fail ed to meet it's burden of proof.
The claimant(me) is eligible for benefits.
Simple enough BUT
under Decision: it says "The Agency Decision is reversed,The Claimant is eligible for Unemployment benefits"
They stated at beginning of letter they know I had been approved so what does the "reversed" mean?
Thier letter doesn't make sence and of course can't get through because lines are always busy.

I understand your pain and now it takes up to 6 to 8 weeks to get approved. What is the world coming too. How is a person to survive when the econcomy is like this and the unemployment dept takes a life time from you for receiving your benefits.

My workplace is shutting down around the end of February, although we don't know for certain at what date. What information or material can we obtain NOW that will serve the needs of workplace contact?

Personally, I am going out of the country on the second week of March for a week (these are plans I am unable to change), and I am concerned that this will effect my eligibility for benefits as I cannot accept work that week, unless I file a claim when I return (which is my plan). However, at that time, this contact information for my previous employment will not be available. What should I do?

I appreciate your quick response, so that I may share relevant information with my co-workers.

12 days ago I was terminated from my nursing career for a HIPAA violation. I worked for a smaller clinic that was absorbed by a major hospital chain here in Nashville about a year ago.

Previously to being part of the hospital the reason for my termination was common everyday practice by all of the doctors and nurses at our clinic. And, even after the merger...we 'all' continued this 'violation' as we were never instructed differently.

This past Monday I was called into the conference room were I expected a scolding for something my manager said the Hospital HR Department wanted to discuss with me regarding a HIPAA violation...only to be shocked with a termination. Even my manager admitted he had no knowledge of the actions being any type of 'violation'.

Encouraged to file a grievance, I did so immediately...only to now have the Hosptial HR not return my calls or emails asking for my allowed review meeting.

Furthermore the Hospital quickly rushed to action after my termination, to train everyone at the clinic about the HIPAA rule...yet they didn't say a thing about it for nearly a year after merging with the clinic. And, how ironic the hospital told everyone at the HIPAA meeting last week, that violating this rule would be reason for a call and reprimand [???]

Reprimand? Not a termination?

TN is a right to work state, that requires an employer under Federal Law to furnish a Seperation Notice at the time of termination or within 24 hours. To date I have not receieved any such notice. Nor signed anything at all.

All of my personal items are still at my desk, no-one in HR is communicating with me, and I have been terminated for doing what 'everyone' did on a daily as needed basis. My nurse friends call me daily and say 'sue' them...but, I just want my job back.

Could it have been my performance record over the past 16 years? Not sure how that can be - with never taking a sick day and ALWAYS at the top of the list in raises and performance reviews.

I was considered the perfect nurse. and my doctors and patients loved me as I do them.

There must be something more to this story that I am not recognizing. One would think I must have been sleeping around, or yelled at a patient or dis-respected a manager or came in late or stole drugs or surfed porn or threatend someone...and yet absolutely never did I, or would I.

So what do I do? And, obviously I expect to hear you say be patient, give HR time to respond. So let's say it is next week at this time or the week after...and still no word. What do I do then?

And, above all else I need a 'Seperation Notice' in TN to file for unemployment and I not only don't have one, but - can't get one.

I was in shock originally, then hurt, then embarassed, and now I'm getting mad. Never fired before, I'm not just going to let this go.

Please Advise.

Thank you.

I feel your pain; I got fired for "falsifying documentation"!! ie: filling in flowsheets 30-45 minutes late, which everyone I know has done at some point or another- if I was working with another patient and missed writing down the numbers for pressures and stuff that the machine didn't remember I went back and filled in the numbers based on what I remember seeing just didn't have time to write down or what the numbers are now to "catch up" on the flowsheet. I never even considered that to be falsification, to me that would be making up vs, pressures, outputs, etc for a treatment that didn't happen. One of my coworkers said even my supervisor had done this- she SAW it herself (year or so ago) I am now unemployed, considering fighting this but don't know if I want to work there again if this could happen, I'd be waiting for the other shoe to drop. AGAIN. I know I had one of my supervisors tell me I didn't need to worry about my job- I am a very good nurse, dependable, caring even though I am slow to finish assignments, he knows I will be where I am supposed to be and will get it done. This occurred only months after this, so I know the slowness played a part of the process but otherwise it came out of the blue. Right-to-work state so can't fight it

I understand!
I was involved in a simular situation, I was working at a clinic that is owned by a huge Hospital in Nashville.
The Clinic was taken over by what I would consider to be no less than a nut bucket!
The new office manager(nut bucket) had a PA from a clinic that was not affliliated with our hospitals bring us lunch and ask us to refer patients to her. When I asked the office manager if she was sure that was ok (because there was never a time the patients could be refered to our compatition) The office manager assured me it was fine(NUT BUCKET!!)
I refered 6 patients in 45 days to said PA and was fired for this!! GO FIGURE!!!!!!

Is a person eligible for unemployment if the former employer was deceptive in the hiring process? The employer advised a $1,200 bonus would be paid to me if "any growth" in the agency within my first 90 days of hire. I know from the employer that we had small growth within the first 90 days of my hire date. What the employer failed to tell me is that he is basically broke and could hardly afford to make payroll much less pay me a bonus as promised after 90 days and all other bonuses promised to me as well. If the employer had been honest about his financial situation I would not have taken the job. During the first 90 days the job also had a very negative effect on my health causing migraines almost daily and a pinched nerve due to stress. I quit the job after 4 months of employment due to health reasons, not being paid the bonus as promised, and the employer had no work left for me to do, but he refused to lay me off due to it would cost him more in unemployment taxes. I have since enrolled in school. I'm still looking to work somewhere at least 20 hours per week. Would I be able to file for unemployment?

I was disqualified from UI because I took a job for one day and then quit because the manager of the shop told me to violate several company policies. I explained to UI people that i did not want to work in an environment that caused me to do things I could later be fired for. They disagreed, said I did not do enough before quiting. - I have appealed - do you think I can win?

I am a salesperson recently laid off, but had existing clients with multiyear contracts from whom I receive a monthly commission in addition to my base salary. What rights do I have to those commissions? In my estimation these commissions are earned for selling the account and maintaining the account.
Shouldn't I be due a portion of those commissions? They are only offering a weeks pay for each of the 4+ years I have been with the company.

I was fired 3/1/2012 and called into the unemployment office on 3/5/2012 to report and that following day a lady from the unemployment office called and I had to give a statement by phone. I have ceritified for that last month now and still when I call in it states PENDING. So i called former HR person and she told me that since the employer was not contesting my unemployment they did not return anything or respond to the UI. What does that mean, do they have to respond to be approved or not?

Got fired 3/2/12, after 8-1/2 years, by new g.m., filed claim 3/6/12, still waiting - ex-employer has never allowed unemployment to be approved - ever, so . . . The 1st thing is this: This new g.m. called me & my co-worker - we'll call him BM, (yeah, just the 2 of us in this parts dept.) to a meeting (the only one we ever had) on 2/1712. I'm guessing that the "plan" had been to have BM there as just a witness, cuz all this g.m. did was to point out my supposed "failings"!

When I was allowed to reply, I pointed out that some of his statements were untrue; that those particular "failings" were things that BM did, but that I didn't! Other items, like calling (not screaming, mind you; calling out as in your home) to each other to or from the back warehouse were things we both did. Then we came to the mess beneath my parts counter, that I had inherited when I was transferred to parts in March of 2011: I had repeatedly asked BM and HIM for help in sorting thru & getting rid of this "stuff" and getting me some organizers and/or dividers to put beneath there for the huge amounts of paperwork & vendor catalogs required to do my parts sales job! His answer was, "We'll see after inventory on Feb. 24th."

This time when he brought it up, I clearly stated to him (where as in the past I'd only said it in an off-hand way, so as not to make a big deal out of it), "I'm ADHD and organization is very difficult for me. I really need your help to get my area better arranged by providing me with the organizers and places to put my paperwork at each stage of the sales process as I've been requesting for weeks, now. I need these accommodations to enable me to do what you're requesting!" He IGNORED me as if I hadn't spoken and then said I had to "get with the program", got up and left!

Now, when I got summoned to another g.m.'s office by my g.m. on the 2nd of March, he stated that I had failed to order some "Vendor suggested parts" in a timely manner.(background: I had given him the list, back in December, to get approval to be allowed to order them. He brought the list back & threw it on my counter on February the 16th and said, "You can order these WHEN YOU GET SOME SPARE TIME." Now I handled the entire parts department ALONE during the entire month of February, while the g.m. AND BM were "re-arranging" the warehouse(s) for inventory. I HAD NO SPARE TIME! I was finally able to get this huge {3-1/2 pages of parts, single spaced lines!} order in on Monday, the 27th, after inventory!) I refuted his allegation with the above mentioned facts. He refused to reply to that, but moved on to his next item: "There have been dock bumpers laying back on a parts shelf for four (4) days, unlabeled & unreceived, that I told you about." I reminded him that he knew I had been calling the vendor, since before inventory, attempting to get either an invoice or, at least, part numbers & pricing to enable me to put them into the parts system & receive them in! I had JUST SHOWN HIM the faxed invoice that I had JUST GOTTEN when he called me into this meeting!! His reply? "You're just not getting with the program, so I'm letting you go. Now go and get your flash drive and bring it to me." I asked him why & he said he was going to erase it, which he proceeded to do. (No, they don't have a "Non-Compete" policy. The don't want and have no written policies, whatsoever!)

The week after I was fired, my husband, who works at another location, up the street, but the same company, heard BM tell another employee that he (BM), the g.m., another g.m. at my location, & another co-worker, had "it all worked out. When [MJM] files for unemployment, we'll all testify that we had MULTIPLE meetings with her about the mess under her counter and that SHE REFUSED TO CLEAN IT UP. She'll never get a dime of unemployment." (I never did anything to this man, except stand up for him, when the service managers and the other g.m. wanted to GET RID OF HIM!

My Questions: #1 I never got a separation notice, so does that mean that it's my word against theirs about why I got fired?
#2a If the reason they give is about the mess under the counter / misconduct for my disorganization , wouldn't my requesting the accommodations due to my ADHD, be a mitigating factor?
#2b Wouldn't these managers & co-workers PLANNING to lie about the circumstances of my firing, constitute FRAUD, and the PLANNING part as CONSPIRACY TO COMMIT FRAUD, as well as a VIOLATION of the "FALSE CLAIMS ACT" Tenn. Code Ann. § 4, CH 18?
#3 Was it legal for them to threaten me with legal action if I didn't allow them to erase my personal flash drive?

Well, those are my question. I don't think anybody's actually still monitoring this forum, so I don't really think I'll get a reply, but I feel better, just being able to get some of this off my chest. Some, nowhere near all. Like how I never got a raise the whole time I was there and how they stopped paying or allowing me to even submit my overtime, beginning in November of 2007, but as I was the only Service Assistant they'd hire, taking care of 2 shops, plus accounting, payroll, creating spreadsheets & forms, and data-processing for requested reports, I was still having to work 60+ hours a week and would still get behind.

Yeah, lovely place to work and I was the fool for staying. I just turned 50 in December, as well. Who-hoo! Ain't life just grand!

How long does it take for them to make a decision on unemployment? It has been 5 weeks already and it is still saying a decision has not been made.

I'm leaving the military soon and I have been stationed in tennessee for the past 2- 1/2 years.. I am originally from Massachusetts and am planning to go back there.. Can I collect Massachusetts unemployment wages or does it have to be from Tennessee.. It's about $150 difference.. If anyone has intel on this I appreciate any feedback.. Thanks

I was terminated from my last job, and was denied unemployment. I am in the process of fighting it, but I took on a temporary job making 600 a week. I was recently let go from my temp job due to buisness hardship or they could not afford me. I was 1099 and worked for 90 days. Am I eligable? who will pay the beneifits my temp job, previous employer, or am I SOL?

Yea Ive never applied for unemplyment but its been over a month Ive certified 5 tmes which can be decieving and can make you angry whn you see your benifits (over $4,000) and cant touch it so I think everybody on here is pointing their fingers in the wrong direction which is unacceptable under any circumstance, but its the governor.AT a time when unemployment is higher then ever around the country, youd think they would hire more people beforehand.....yes before all the claims stack up and they become a year behind or more....dunno if ill be approved or not but the damage is done.Even if they pay me back-pay tht doesnt make up for late fees and all so thanks once again to our concerned lawmakers .......good luck fellow tennesseans

I did not receive an e-mail confirmation. When I tried to file my weekly claim, it locked me out saying I wasn't using the right PIN, which I am pretty sure I was. I called the number given to unlock my PIN and was told to enter my PIN. The recording said I had a 64 minute wait. I called back later and got the message that they could not take my call. This was my first time to file a weekly claim and it is now too late. What am I supposed to do in this situation?

My first question, is anyone from the Unemployment Office actually answering these questions? Second, its only been 3 weeks for me and when I log on I do not see a pending status, only my information and how much. However, I did recieve severence pay last week. So I must assume that since it was a little more than I would have made if I had actually worked then I don't qualify for that week. When I called the unemployment line they just said it was pending and that it could take 8-10 weeks. Is that just a general time frame to cover there butts in case? What are people supposed to pay in the mean time? In 8 weeks I will have no electricity or water! For those of us supporting kids yeah food stamps helps but that doesnt pay bills. So if unemployment is supposed to help people are they going to pay for me a place to stay if i lose my house? Are they going to pay for medical bills when my kids get pnemonia from no heat in the middle of winter? Life was hard enough while i was working but now you are telling me 8 weeks! I wasn't fired from job I was let go from lack of work. I faxed my seperation notice the day i filed for unemployment. I gave you all the information you needed! Including the date and the amount of the severance pay. You should really give people more definate answers instead of playing the waiting game. I wouldnt be surprised if someone died of a stroke from all this worry. But you don't care about that. All we are is a number to you. TDLWD needs to think of the kids who are going to be cold and homeless as a result of your inefficeiency!

Unfortuantely it is actually taking 8 weeks and lately it is taking them up to 10 weeks in some cases but since it sounds as if you were laid off you may be one of the lucky few who get their's a little sooner, but, you may not want to quote me on that because from the conversations I have had with them it seems they are just backlogged no matter what the reason is for the seperation, and since it has only been 3 weeks I can only pray you are a patient person because you may be in for a long wait. I don't mean to sound discouraging but it's the truth so you may as well go in with your eyes wide open. Good Luck to you.

Create and post a Backlog Clock or Expected Duration - for a determination. At least that way we would know how long to expect to wait. I sent an email inquiry a week ago and finally got a response today. Response suggested that my application has JUST been approved - 7 1/2 weeks. Still no ETA info on the actual payment.

TN unemployment is truly a joke, they expect people to be content with them saying when your claim is processed you will be back paid for all the weeks you certified. Now if only my utility company and landlord could understand this it might make this situation a little better. This is ridiculous I agree with everyone here when they found themselves falling 8-10 weeks behind instead of doing mass claim sessions they should have did mass hiring session. I just feel victimized twice, first wrongful termination and now being forced into homelessness for me and my children by the system that was supposed to provide a safety net for us. I am a college educated woman and truly thought I would have found employment by now but that isn't the case and this system they have in this state sucks. And then they tell me hopefully you will find a job before your claim is processed, I almost think they have such a long processing time in hopes that one will find a job and they won't have to pay. This is sad sad sad. I'm on my sixth week now and still nothing. Then the real trip is when I first filed I was told 6-8 weeks and now that it is almost that time they have changed it to 10-12 weeks. Some of our elected officals or some of these people in office should really do something about this because this is shameful. I haven't said this often but I am truly ashamed to be a TN resident because they clearly don't care about their residents at all but let an election be coming up you nearly get dizzy listeing to all the lies about how they are going to make our lives so much better. Thanks to the very sad job the unemployment office does my Christmas present to my family will be the lights being disconnected the day after Christmas because my utility company have worked with me as much as they can and since they do have a business to run so they can't wait on these slow people to feel obliged to do their job any longer. This is just a mess a real true sad mess.

I am curious does anyone know of a delay in unemployment benefits for the weeks of Christmas and new years. I transitioned to teir one this week and should be getting my first extended benefit payment this week and nothing so far. The unemployment website usually shows if and when the payment has been processed but it shows my last processed payment was last week 12/16/2012 and nothing for the week of 1223/2012.

I have worked at my job for the past 6 months....before that I was unemployed since april 2011 with no unemployment benefits. It seems from looking at the "BASE-Period" chart I wouldn't be eligable for unemployment??? Is that true?? I am laid off due to a reduction in workforce. Any advice would be helpful.

Going into week 9 now and no word whether or not this is going to happen. Several calls to my representative( or at least the lady who introduced me to the program after applying) and she hasn't replied to one call. So yeah it looks like its 6-9 or 10 or 11 weeks now. I was only on unemployment once before when I was 18 and that was for like 2 months before I went into the marines. Now after working for more than a decade I feel like I'm getting the run around. Thanks TN for having my back when I needed it most.

I did just that. After taking the time to read the novel I just wrote, I'm sure Mr. Corker will appreciate the situation that otherwise hardworking Tennesseans are currently in. If I can't benefit from any of my efforts at least someone else who is being ignored might.

I filed for unemployment, and I was approved for it. I was told I needed to contact the TN career center to take a 2 hour class, and won't receive benefits until I've done so. I've called the career center and they don't answe and just give me the number for unemployment. I just need to know what times and days the classes are and what all is required of me when I go.

I was terminated on 5/1/2013 after having worked a 13 hour shift. The company is understaffed and we worked many time 7-day work weeks 12-15 hours/day which made any leave impossible. I worked 3rd shift and went in at 9pm and many days didn't get home until 1pm the next day. I became sick and because I HAD to seek medical attention for a chronic fever of 100 and sinus infection that became bronchitis, I was given a POINT for the absence because they were short staffed. My 2nd point came from being exhausted after working 2 consecutive 16-hour days I overslept an hour. I was given another point. The 3rd point came when my relief didn't show and they made me stay until 3pm, leaving me with less than 4 hours after a 45min drive home to get sleep and shower. I overslept again by 2hrs. My job is HARD. I lift tons and work with dangerous equipment like giant 20'+ saw blades and high temps. I got the highest peer review and highest proficiency score ever-a perfect 100 minus the 3 points. I was told the points would roll off after 90 days but it didn't matter. A co-worker became hospitalized, one quit, and our supervisor took a 2-week hiatus. Lot if drama with a cheap company that cut corners and bullied workers putting our health and safety at risk and paying 40% less than other local firms for skilled labor. The day after I was terminated, my supervisor also quit. He said corporate forced his hand and admitted they were wrong to do so. He was tired of their inefficiency. My shift partner also put in his notice the same day.

I still haven't received a check and my Nashville UI case worker won't return my message. The system says my case is still pending. I have run out of funds. My MLGW bill is due and I've used all my savings were mortgage, taxes, insurance and tuition for my kids which was a contractual obligation. Thank goodness my wife is good with money. I've for 1-2 weeks if gas money and enough groceries thanks to her coupon clipping.

As I filed claim online on 7/17 (wed) the website screen "locked up" and I could not finish setting up security questions or PIN. I tried to set up PIN next day on phone and online and PIN was locked. I have called everyday and been put on eternal hold by automated system. I did receive Benefit determination letter on 7/22, but, of course, couldn't get through Sun/Mon to do weekly certification since my PIN is locked. So, how can I unlock PIN if I never get to talk to a real person?

Received "Acess Denied" when I clicked "submit" while filing on line, never received any additional screen. Received call from Doug at TDES several days later ( I verified where he calling from) and my claim was completed over the phone. He explained the call in process, told me about the TAP card (I received it that afternoon) and have now received the various letters re amount, etc. Problem is, I cannot get a pin number set up, my account is locked. I have tried calling (you need a pin to get through), I have sent 3 e-mails that have not bounced back, and have now sent a fax. No response has been received. I have to certify every Sunday. How can I certify without a pin...can't log in and can't call in. Will contacting a state representative really help? What happens to all the possible weeks that I am unable to certify? Another question...Could the TAP password possibly be the same as the site log in or is it totally separate. Haven't called to set my card up yet.
