New Mexico Unemployment

Q. If I was fired or quit my job, can I collect benefits?

A. Only if it is determined you were not fired for misconduct connected with your work, or if you can prove your reason for quitting was due to an unresolved work-related problem caused by the employer.

Q. How long do I have to work before I am monetarily eligible?

A. In New Mexico, your claim is based on the first 4 of the last 5 completed quarters. For example, if you received wages from January, 2001 through March 2002, your claim and monetary computation would be based on wages received between January, 2001 and December 2001 (4 quarters). There are also monetary requirements that must be met during this period. You must have the minimum wages required in at least one quarter and $1.00 of wages in another quarter to be monetarily eligible.

How do I file for unemployment benefits?

Apply By Phone

Dial (505) 841-4000 to apply for a new UI Claim

You will be asked questions about your previous employment. You will be instructed to answer these questions by pressing the correct numbers on the phone

Your call will then be transferred to a Customer Service Representative (CSR) who will complete your claim over the telephone

You will be given additional instructions by the CSR if required.

Instructions

1. Information needed to file your claim.

  • Social Security Number
  • Mailing address and phone number(s) of employer(s) you worked for in last 18 months
  • The starting and ending dates of your last job (or jobs if more then one employer in last 18 months)
  • If non-citizen have your alien registration number and expiration date
  • If you worked during the week you are filing your claim, be sure you know the gross amount (total dollars and cents before any deductions) of your pay before filing.
  • Pencil and paper to write down questions and instructions

2. To register with the New Mexico Department of Workforce Solutions, you will click on Claimant login

Registering and Filing your claim will take at least 30 minutes!

If this is the first time, you will enter your social security number and select a personal identification number called your PIN. Your PIN must be (4) numeric characters. Also verify your PIN.You will then enter your mother's maiden name. Your mother's maiden name is necessary to verify your identity.

3. After registration, you will click on continue and then select File Claim to begin the process of applying for benefits.

4. After applying for benefits and completing the requested information, you will be presented with confirmation page. Your confirmation page contains basic instructions about your claim. Print and read the confirmation page. It is your proof of filing a claim.

ADDITIONAL INFORMATION PERTAINING TO FILING YOUR CLAIM

The Internet Unemployment Insurance On-Line Filing Claims System for applying for benefits is available 24 hours a day, except between 2:00 AM and 4:00 AM Mountain Time. In future, you may also use the Internet Unemployment Insurance On-Line Claims System to file your weekly claim (see Filing for weekly Unemployment Insurance Claims Benefits), respond to request for information, review and request benefit information and file appeals.

To file for Unemployment Insurance via the Internet you must first register with the Department of Workforce Solutions by entering your social security number, select a personal identification number(PIN) and also enter your mother's maiden name. Your mother's maiden name is necessary to verify your identity.

The effective date of your claim will be the Sunday of the week that you file. Do not delay applying for Unemployment Insurance Benefits. Once your claim is submitted you will be sent a Notice of Initial Determination which provides you with the following information:

  • Your weekly and maximum benefit amounts.
  • The beginning date of your claim.
  • Your wages that are to be used for computing for UI Claims Benefits.
  • The amounts of wages reported by each employer during each of the four specific quarters are used for computation of UI Benefits.

Request for Reconsideration of Wages

If you believe wages are listed incorrectly or some of your wages are missing, you must request to initiate a review of your records. If you did not request a review (Request for Reconsideration of Wages) at the time you filed your claim, you can initiate this request by contacting a Customer Service Representative @ (505) 841-4000. You will be asked to provide proof of wages, such as, check stubs, W-2 statements or other documents. You will be instructed to either mail or fax a copy of your documents to the Department.

You must continue to file for claim benefits while your wages are being reviewed unless you return to work. If you fail to file for claim benefits each week you will be required to re-open your case and may not be entitled for benefits during the week you did not file.

Your PIN Number

The Unemployment Insurance On-Line Claims Systems require you to enter a four-digit Personal Identification Number (PIN). Your PIN is your electronic signature and it will help protect you from another person obtaining information about your claim or filing against your claim.

BE SURE your PIN is easy to remember because you must use it each time you use the Internet or telephone, to file your weekly claim or inquire about your benefits. DO NOT use numbers in a sequence (such as 1234) or numbers in the same sequence (such as 1111 or 2222). NEVER tell anyone your PIN because you are responsible for its use. You should not use any part of your social security number, telephone number or any numbers that could be easily guessed.

If you forget your PIN, when inquiring about your claim or filing your weekly certifications, you will have to establish a new PIN before you can continue. You will have to speak to a Customer Service Representative @ (505) 841-4000. You may also send a request in writing to delete your PIN. If writing, you must provide information to identify yourself, name, social security number, birth date and your signature.

I didn't recieve the new Wells Fargo card in the mail, but I still certified and now I am not able to recieve my funds.
How do I contact somebody to let them know that I am not able to acsess my money, I have tried calling several times but the lines are constantly full, so how do I fix this problem?

I am 19 years old. Recently, i was accepted to a private Nursing School. I would have been able to afford it which is why I registered, but once I told my boss about my school hours, he has cut me from avg. 36 hours a week to now 10 hours even though I do not start for about another 3 weeks. Can i still qualify even though I am going to a vocational school?

i recently moved to new mexico and have been working full time for the last 19 weeks. prior to that, i was self employed for 2 years in another state. i'm going to be laid off due to lack of business at my job. am i able to collect unemployment during my layoff, which will probably be for only a month or two, and then return to my job? is 19 weeks of work for another company long enough to qualify for unemployment?

I am 20 years old and unemployed. I have been collecting unemployment benefits since 9/2010. Recently, I've enrolled in a community college part time to get a better job. I answered "Yes" to the question "Are you in school or training?" Now my benefit has stopped. I have no money coming in to help pay my bills. I would like to know what I need to do now to continue to get help/benefit.

Friend was terminated. Employer denied unemployment. She did not appeal in time frame allotted (she got a letter). Is it possible to file a late appeal based on any theory (not be represented?)? Based on her information, the discharge looks suspect and may involve wrongful termination.

this is 05-08-11, have been trying by phone to re-certify my weekly claim, keeps telling me my info does not match, changed my pin , and system tells me it still doesn't match, will not let me by internet address...now what? will keep trying by the phone, can never get a "live" person to talk to !!!

Tried certifying on line several times online finally it said I did it. Called to be sure and it said I could not so assumed that it was done. Then no funds in account now it says I have to reopen my claim. Should have known something was wrong the web page had been changed and updated. Been trying to call and nothing not even the automated call back system working.

If you mentioned "pregnancy" and you meet the work requirements for the Family and Medial Leave Act; your employer could be in violation of FMLA policy if they do not hold you position and you could be eligible for unemployment benefits due to an improper discharge.

My son filed for extended benefits (has a claim number) and has filled out his weekly claims for 6 or 7 weeks. It says online that he will be notified of the outcome or I presume any additional action he must take. No news! More important, no money! What could the problem be? Is a delay like this typical? How can we find out his status.

I was helping my fiance file her weekly certification and our cat had ran across the keyboard and changed one of the selections made for weekly certification, I did not notice that one of the selections had been changed, I proceeded to select that I certify that this information is correct, it then sends me to a form indicating that I had selected something indicating that she was working that week. I had closed out of page but it now will not allow any modification and does not provide a help or faq to remedy issue. Any idea what needs to be done to correct this?

My boss told me to go home because he had no work for me, and had given my job to someone else. Later he called to say that HR would be sending me an email. The email stated that due to medical reasons I was being laid off, since I had used up my FMLA. My question is can then change the reason I am sent home per my Boss originally, and now say I left my job unprotected as I ran out of FMLA, when i had Dr reasons. But he sent me home saying he had no work for me...isnt that first ....what h e said..can they change it now...

I had gotten laid off from my job in Calif after 16 years. A few months later, I found they had opened the same position here in NM and I was re-hired. Now, after 3 years, all of NM operations has been shut down and I'm out of work again. I've applied for UI but I'd like to get back to CA where all my family is located. Can I move there to look for a job and still get NM UI as long as I follow all the procedures? Or better yet, would I be eligible for CA benefits?

Im almost 9 months pregnant still working and my boss is still having me close. Lately everyone has been leaving me all the work that they should have done during their shift. I recently complained to my boss about it and his response was that its been busy and if I need more time to close that's its ok. It's becoming too stressful for me to close because there are heavy things I have to handle and there's too much work. Even though I have bills and need to save for my family they have cut my hours to about 12 hours a week even if I ask for more. If I quit, would I be able to qualify for unemployment? I will have worked there for a year next month.
