You are eligible for benefits only for weeks in which you meet all of the following conditions and are not subject to disqualification:

  • You were unemployed during that week.
  • You were paid $1,600 or more in wages during your base period for insured work.
  • You were paid at least $440 of your base period wages at any time during the base period outside the calendar quarter in which your wages were highest.
  • During the week, you were able to work, available for work and actively looking for work.
  • You were registered for work with IDES.
  • You filed your claim for the week as scheduled using IDES' automated Tele-Serve system or as otherwise directed by your local IDES office.
  • You have served one waiting week.The waiting weekis a qualifying period required by law, and benefits are not paid for this week. It is usually the first week for which you file your claim. To obtain credit for the waiting week you must meet all the requirements listed above and not be subject to disqualification.

How do I file for unemployment benefits?

File a claim online, or visit one of the IDES offices located throughout the state where individuals can file an "initial claim" for benefits, or change their mailing address.

What information do I need?

  • Social Security Number and Name as it appears on your Social Security card
  • If claiming your spouse or child as a dependent, the Social Security Number, Date of Birth and name of dependent(s)
  • Employer's name, mailing address, employment dates, and separation reason for all recent employers
  • If you are not a United States citizen, your Alien Registration Information
  • If you worked since Sunday of this week, the amount of gross wages earned this week. (all gross wages for any work performed, full or part time, must be reported. Your gross wages are the amount you earned before any deductions, not your take home pay.
  • Wages in the form of lodging, meals, merchandise or any other form should be included. Gross wages must be reported the week in which they are earned, not the week in which the wages were received. Under some circumstances, partial benefit payments may be made.
  • You will need either a valid social security card or some other identification card which bears your social security number. In addition, you must present a second form of positive identification.

Why do I have to fill out the forms if IDES already has my information on the computer?

To accurately determine your eligibility, we need to have the most current information, including some that your employer does not routinely report to us. In addition to your name, address and social security number, we often need other information.

For instance, we need to know if you had multiple employers, the reason for your separation from work and the number of your dependents.

I worked for a company based out of Ill. but worked in NV. for them and they did something wrong with their paperwork and I can't collect here in NV. Why does the Gov. punish the worker and not the company? This is very unfair to those in this type of situation.

The same thing happened to me. It's crazy that they penalize you once you've paid, but you are not penalized if you didn't pay them back. They just keep your unemployment checks until they have re-couped their money. I didn't appeal the decision, but I should have.

You should have been notified of the amount that you are able to earn each week without it affecting the amount of unemployment benefits that you will receive each week. If you can't find that info in your paperwork, put a call in to your unemployment counselor and ask them.

Laura, I have the same question but so far have not been given a straight answer - even by the teachers union lawyers and the unemployment office.........needless to say its been very frustrating....but from what I have gathered on my own, in Colorado if you're a laid off teacher, which I am, you can work part-time however if you choose to sub you will not receive your unemployment benefits during teacher breaks and holidays because subs are not paid during breaks - its something called "reasonable assurance" meaning that if you sub before the break you're assured to continue subbing after the break. This "reasonable assurance" clause is built into unemployment law so that substitute teachers cannot collect unemployment during the summertime when school is not in session. I would suggest working part-time in a field other than teaching. I didn't know this and subbed 1 day for my old school district and now I can quit because i'll lose my benefits and i can't continue to sub because i can't afford not to be paid during breaks - i'm doomed :(

This is normal. From my experience this is the time they use to notify your employer that you are claiming, and also to generate the amount of your benefits. If you end up getting approved within 4 weeks of filing you should get your first check. *Assuming you filled everything out correctly that is!!!

ive been on unemployment for a few months. i recently moved and indicated a change of address while certifying. my claim was suspended until i contact my local employment services office to confirm my new address.i visited the office and they referred me to a phone number to call. the last 3 days ive been on the phone and literally called hundreds of times only to get the busy signal and the ONE time i talked to a representative they tell me the system is down and theyll call me back. is there another more effective way to change my address so i can get my claim activated? by the way the system is extremely horrible and frustrating. its bad enough being laid off now im dealing with automated voices and run arounds.

Same problem here. Tried to change from debit card to direct deposit and my claim was suspended. The instructions sent me to a general delivery mailbox which was full and would not accept any more messages. I tried pressing "0" to get an operator, the recording said the operator was unavailable and redirected me to the same general delivery mailbox.

We are on day two of this runaround, and starting tomorrow I will be donating my unemployment check to the bank in the form of overdraft fees.

you can earn up to 50% of your benefits. For example..if you get $300 a week in can work part time and earn up to $150 a week. If you go over, you must claim what your gross pay was and they will deduct whatever the amount is..for make $200 one week, then you will only get $250 in benefits, not $300 for that week. I highly recommend working pt..since I don't know about you..but UE alone isn't much..if you can work pt you can get at least an extra $400 a month in..if you get a job that pays tips..even better! since you don't HAVE to claim cash!

The first requirement on the list to receive benefits "You must be UNemployed". If you are WORKING (doesn't matter how many hours, you are still working) then you should not be eligble or benefits.

It's no wonder why the state is broke! Everyone is getting "free" money (from those of us that work) then earning more by working part time? That's messed up. We need entitlement reform NOW.

I think this guy is full of crap!! I have worked for 31 years and never been on unemployment. Going from 58,000 a year, and having bills to match down to barely 20,000 a year on unemployment doesn't cut it!!! If I can find part time work to help supplement the unemployment until I can find a full time job at somewhat close to what I was making, that is reasonable. If I can make 400 a week on unemployment, and I get offered a job making 200 a week part time, I wouldn't take it if I knew I was going to lose my unemployment benefit. While I agree that some people may abuse the system, not EVERYONE does!! I have worked 31 years straight since I was 16, and even before that with newspaper routes. I have earned the unemployment benefits.

Exactly! That guy is clueless! I am on unemployment but recently got offered a part time job working 10-20 hours a week. How can I live off $100 a week. So if someone works 5 hours a week at a job they should live off it? Get a clue! We are not getting free money. #1 our bosses paid unemployment insurance. #2 we can't live off so little pay. I worked full time for 6 years then the last bit-9 months I get put down to part time. Now my UI is based on my part time pay! I can't live off that. So we should be able to have a part time job if it doesn't make too much. I'd much much rather have a full time job than collect a very little amount on UI.

Even the "part-time" allowance is not enough to make ends's barely enough to keep us from starving. NOT TRUE AT ALL. As stated you can work PT to supplement the piddle shit money you will get from unemployment. This is so that people can survive. Many people work a FT and a PT job...and when they lose the FT job they are still eligible for benefits and can still work PT. IF you exceed 50% of what you recieve in unemployment, it is deducted from the amount you will recieve that week. IF you can earn the same amount, you are dropped. My question is: How long will I receive my benefits before I have to renew, and when I renew will my employer be able to see I'm still collecting? My husband worked in Missouri for 3 straight years. He was laid off in August 2010 and found a job in Illinois a couple weeks later. The company he is currently working for in Illinois lays off their entire staff from Dec. to March each year. He will be going back there. I have a seasonal job, I work six months per year and collect unemployment for six months per year. I am currently collecting unemployment. I worked a 100% commission job and was paid quarterly. I still collected unemployment while working, but i thought I could because when they asked if I had any earnings on teleserve I would say "no" because my earnings were deferred. I even asked an IDES rep about this and they said i was fine as long as i report my earnings when i get paid. I received a repayment notice and I owe $10k. I was honest with them and I'm willing to work out a payment plan. I just don't want to go to jail or get charged with a crime becomes i did not "knowingly" commit fraud. do they charge everyone with a felony they catch ? is there a way i can avoid jail and having a criminal record. i don't care about paying them back i just don't want a record. please let me know if you have any info to share with me. the lady said that i would definitely be suspended for "x" number of weeks i just don't want the state to file charges. as anyone on here been in this situation ? if so what happened. ?

My office closed after my Dr. resigned with the company I worked for, & I was offered 4 weeks of severence pay since there were no comparable positions available. I filed for unemployment on 09/01/11. If I filed unemployment in IL, & move out of state to something more affordable, do I still collect benefits from IL, or do I need to re-apply in the state I move to? I livre in Illinois. I've been on UE since july. I signed up for online college courses AFTER getting a flyer from UE saying Obama was providing incentives for those on UE to further education. I called local office they said yes going to school was allowed. Just filed my first certification since classes started and my claim was suspended. I finally spoke to someone and they told me it's bc i answered yes to the question. That I should have been told that my schedule required approval. He said I need to go to my local office and do so if approved payments will resume. Otherwise I'll lose them. He said most cases require a hearing but that "there is a chance that if I happen to no longer be in school on my next certifacation date and say so in my answer" payments will resume. He basically told me hey lie and say you aren't. Will that work or will I still need a hearing. Will they want proof that I dropped out? Can I just lie and tell them I went to some workshop and thought that counted as training? Everyone I've spoken to says they never answered yes to the school question and never had problems

I owe unemployment from a previous time about 6 years ago and my current part time job is laying off everyone due to selling the place and I was wondering if I still qualify for unemployment and just have them deduct what I owe from what I get this time around? I have about 5 weeks before we no longer have a job

I was terminated from my job on Nov 16th. of this year. I was overpaiid by unemployment back in 2008,2009.I called unemployment and was told that someone in their office made a mistake and over paid me.I have received servral letters since then stateing that this overpayment must be paid back and that they can recope the overpayment by taking future benifits. I replied to unemployment stating I would not pay for their mistake. Can I still file for unemployment.

I received a letter stating that since I haven't made such-n-such amount that my benefits were being suspended. I have been notified that the state thinks that they overpaid me $1700 for my unemployment from November 2010 to Feb 2011. They have my wages vastly understated, but rejected my appeal despite the pay stubs proving my salary. Do I appeal again ? Can they sieze my bank account to get the money?

i owe unemployment 1000.oo they were tking my whole check at first and thats fine. my last check says that a recoupment amount of 70.00 was taken out (i get 222.oo every 2 weeks) my net benefits were then 152.00, the payment amount is 0.00. my question is where did the 152.00 go??!! it was not deducted from my amount i owe unemployment, Ive tried contacting my local office and i have no luck with them! anyone ever have this problem?

My previous employer wants me to work two 4 hour days a week. I would have to put my kids in daycare just to work for 4 hours. I would only make enough money that day to pay for day care. He said if I didn't work that I am refusing work and I couldn't get unemployment. Is this true? Do I have to accept 4 hours of work?

I'm in IL. My UI benefits for the last 6 mos. have been calculated based on the income from my most recent employer that laid me off. I was actually unemployed before I got that job and used up all UI benefits and extensions a couple of months before I got hired. My UI weekly benefit for the last 6 mos. has been $325. I just noticed a reduction in my benefit amount. I now only get $255 per week. When I called the office they told me that no "New" extensions are in effect and my Tier 1 extension would be based off the income from the employer that laid me off before the most recent one, which was less money. Does this sound correct? Has anyone else had this happen yet?

My daughter began unemployeement benefits last fall She is currently a student (22 years old). I paid her back rent from the time she lost her job last year providing over half of her funds she lived on last year. If I claim her as a dependent will she lose her benefits.

I applied for unempoyment online a month ago. I still have not received an email or anything in the mail indicating that I was approved. I called tele serve number and it has my info in the system and how much my weekly payments should be. Am I suppose todo one thing else or do I just wait? I collect UI, I was let go from a job in September 2011. I just cashed out a 401k on the premise of using the money for 'survival' to pay basic bills because the UI itself doesn't cut it. Now I find out from the UI people that this is considered "income" (even though it's my money and I've already paid the state/federal tax and the early withdrawal penalty on it), and I can't use it??? I'm not taking a vacation to Europe with it, I'm using it for basic needs. Does your tax refund then count as 'income" as well?? I also found out I'm only eligible for the 26 max weeks, why are other people eligible for 99 weeks? I (my employer) paid into this system...

I just received the UI finding letter. And the employer who laid me off has $0 for qualifying quaters and wages paid. What does this mean ? I worked for 90 days for this company. It seems like the part time I had for a shorter period of time are listed with an amount. But not any of the jobs where I was there for a long period of time. Why would that be ?

I resigned my job in September 2011 due to having to remind the company owner to pay me my first paycheck, my two bonuses, having to work after hours, using my gas and cell to call patients with NO compensation. He's put my check into my account, removed it, then put it back (he said it was due to a holiday and he didn't put funds in--not my problem but it was) He kept threatening to let me go when he's in one of his many moods, then call and said what a great employee I was. He told me he was going to close the practice many times, sold illegal products from the office, then hired someone to manage who made unprofessional comments to me and about some patients. Would I be able to collect unemployment now. I used my savings to live on since I thought I wouldn't be eligible since I resigned. By the way, they shut down the business two weeks after I left anyway and the doctor I worked with left after me because of the abuse. What should I do?

It sounds like you may have good grounds for filing an unemployment claim - non-payment, hostile work environment, possible ethics/legal issues, despite having resigned.

I read the Dept. of Labor UI Comparison section on Non-Monetary Eligibility ( ), but couldn't find a clear answer.

The reason for quitting that really jumps out at me is that you weren't getting paid, or not paid correctly.

You should go into your local unemployment office and talk with a counselor there and explain your situation, and see if you qualify for unemployment. Because you resigned it is likely that you may get denied at first then will have to file an appeal, or have your application adjudicated (a determination process where they contact your prior employer, etc.).

Bottom line - when in doubt - go in and apply and give them all the details and correct information about your situation, because your's sounds like you may have a good chance - but they determine applications like these on a case-by-case basis.

Just so I understand correctly. Having a part time job won't effect your UI if you make less then 50% of what you recieve. Is that weekly. Or bi weekly. Do I have to make 50% less of $253 (weekly) or 50% less of 506 (bi weekly).

I have an unemployment question. I got laid off from my job a few months ago. I signed a contract with my ex company that I wouldn't collect unemployment until my severance was all paid up, which will be a few months. I've working with a recruiter to try and find a full time job, he called today to offer me a temp job for the next 4 months. My severance ends around the same time this temp job ends. Can I collect unemployment from my old company even if I worked these 4 months at a temp job. By the way, I would get paid thru the recruiters company, not the actual company I will be doing this temp work for. Ideally, i would find a full time job and have no need to collect unemployment at all, but the job market is pretty bad. I'm in Chicago Illinois.

Hello, I worked in Indiana for the past three years. In February 2012, I resigned from the job located in Indiana because I had accepted a new job in Illinois. Unfortunately, the new job in Illinois was a mistake. I received pay for two weeks and thereafer I was laid off. When I filed for unemployment benefits in Illinois, I was told that I did not have enough qualifying weeks in Illinois (I worked in Indiana for the past three years).

My question is can I file for unemployment in Indiana for the qualifying weeks, although I resigned from the Indiana employer. If I can file in Indiana, should I list the IL employer due to the lay-off situation. Also, when I tried to return to the Indiana employer, they claimed to have a new policy that does not allow them to rehire any previous employees (even if they left the company with a good record).

I worked for a temp agency for 10 months then got laid off due to lack of work at the assignment I was on. After receiving my last check I notified (in person) the temp agency that I was going to start working a new job I had found all on my own.
After 34 days at this new job I got laid off due to downsizing. I then applied for unemployment & was approved but now the temp service I previously worked for is fighting it.

I live in Illinois. Do I even have a chance.of winning or can the temp service stop me getting unemployment even tho I wasn't working for them when I got laid off?

Due to work reduction at my company I like many were let go April 2011 and I was on unemployment right away. I did eventually temp for four months during the summer of 2011 but that ended and I went back on unemployment. Now this past April 2012 I had to go through a one week waiting period and start again for some reason and was getting even less money on my unemployment benefits which hurts. But was told I had that until October.

Now I just got a letter saying that my benefit year is ending April 2013 BUT that my maximum benefit amount balance is only $834.00 which would end my benefits this next paycheck! So I am confused does this mean I get nothing at all after this? what happened to October or April? I have been looking hard for a job even though I have also been going to the hospital due to health issues I have had this year. I don't know what is going on or what to do? Does anyone know please let me know, thank you!

All you have to do is turn him in to the IRS to be 100% sure he doesn't do it again. If he was truly your friend, he wouldn't have done it to begin with. The IRS will make him pay them back the amount he got for claiming your child and honestly, I'm not sure what else they'll do. Or, if you really don't want to do that then let him know you recorded the conversation and if it ever happens again, you're turning him into the IRS right away & he not only has to pay them back but can get jail time for fraud. Maybe that'll scare him enough to not do anything stupid like that anymore.

Illinois IDES Unemployment has mailed me two letters after my phone interview, the first one dated the 28th says; I have been found ineligible for these reasons (none listed), then to my surprise I recieved a letter dated the 31st titled Determination; the claimant is not ineligible for benefits. Then I went ahead and certified online on my scheduled day, and I have not recieved any payments. I have tried to contact the local office by phone and after going through the five minute automated prompts I finally was given the option to speak to someone, I pressed the #1 to speak with a rep, the phone made a ring sound twice then said all reps are busy try again later and hung up. so why the contradictory letters, why the half assed trying to sound intelligent double negative redundant determination letter and why can I not get a a hold of anyone in a local office? who can I contact to figure this out? is there a main office for the state of Illinois that I can contact? a known number that may lead to some human assistance? Help Please before I get evicted!

I just recently got hired for a job and started the following Monday on 3-18-13. When I certify for my two week time period, the first week I was still unemployed, and the second week was my first week of my job in which I was on the clock getting paid. First of all, I can't find where to report to the unemployment office that I have been hired. Is there a place on the website to do it? I went ahead and filed my certification since one of the weeks I was still unemployed and need that week's worth of money. I did report on there for the second week what I made from my new job. Hi, I have a sort of general question.

I was placed at a job thru a temp agency and the client's policy states that contractors can only work for a 12 month period and must take a 90 day sabbatical before being "rehired"
So I am taking my 90 days but the temp agency is saying they will contest my unemployment if I do not go on the interviews they set up for me, as it would appear I am not actively seeking employment.
My question is, how can they legally do that? If I am seeking employment on my own or thru another agency, can they successfully have my UI benefits revoked before they even approve them?

Please Help!!!
