Do I qualify for unemployment benefits?

Benefits can only be paid to you if you meet all state legal requirements, and you are not under a disqualification. The most common circumstances that can lead to a disqualification are:

  • Quitting your job without good cause in connection with the work.
  • Being fired or discharged for misconduct.
  • Refusing to apply for or accept suitable work, or refusing recall after being laid off.

The circumstances of your separation from your last permanent job will be investigated by an DWS claims adjudicator. Both you and your employer will be asked to provide a statement regarding the facts. A Notice of Agency Determination will be issued advising you and your employer of the decision. If you are disqualified, the agency determination will explain the penalty imposed. Each section of law, such as quit or discharge, has its own penalty period.

Certain conditions must be met each week in order for you to receive benefits. To be eligible you must be:

You must also register with DWS Employment Services. You will be required to contact a specific number of employer seacrh week. The number of contacts assigned to you should be entered on the inside cover of this handbook. If you have not been advised of the minimum number of contacts to make each week and it is not listed on the inside cover, contact your local office for work search instructions. If you file an application for unemployment benefits by computer, the required number of contacts will be shown on your confirmation page. If you receive notice to start recording your contacts and have either lost or did not receive a handbook, report to your local office to request one.

Unless you are exempt from the work search requirements, you will be required to report your job contacts beginning with the 13th or 19th week of unemployment compensation. A notice will be issued to you alerting you when it is time to begin recording your contacts. (The 13th week or 19th are assigned depending on the area where you live or work.) You will need to refer to the section at the back of this handbook entitled Notice of Work Search Requirements for complete instructions on the work search requirements.

You will be required to begin recording your job contacts as indicated on the Job Contacts Log located in the back of the handbook. This can be printed from the electronic version. If you are a union member, you may have chosen to allow your union hiring hall representative to make your job contacts for you. When you receive your notice to begin recording your work search, refer to the Work Search Requirements for Union Members (Part B), also located in the back of this handbook. You must notify your union representative to begin keeping appropriate documentation of the weekly job contacts they make on your behalf.

Remember! Failure to make the required work search contacts in any week may result in an ineligibility for benefits. Your work search activity is subject to audit by the DWS Benefit Accuracy Measurement (BAM) program as well as the DWS Benefit Payment Control (BPC) unit at any time during the life of your claim.

How do I file for unemployment benefits?

Go to  www.accessarkansas.org/esd

From there you click on “Unemployment Services.” This takes you to a menu where you select “UI Claimant Forms.” From the list of forms on the next screen select “DWS-ARK-501,” “Application for Unemployment Benefits” and then “print.” The completed form should be mailed or taken to your nearest local office. You can locate your local office on page 4 to obtain their mailing address. Remember, your claim is effective when presented in person or postmarked if mailed.

I am helping a friend prepare for an unemployment appeal. He was disqualified for misconduct, specifically excessive absenteeism. The issue is that his wife was pregnant and had numerous complications throughout the pregnancy which caused him to miss work. Why don't those absences fall under the protection of FMLA? How should he appraoch this appeal and what questions should he ask. The absences were beyond his control and should have been excused since he was at the hospital caring for his wife and unborn child. His employer knew the reason for these absences. They terminated him when he called in sick from a heat stroke having spent the weekend in the hospital. When he came back to work Tuesday they let him go. This absence (which occurred in August) was the second call in since the birth of his baby in March. I don't consider missing two days excessive. Am I missing something? Any ideas and advice greatly appreciated.

he needs to get from her dr. that she was having issues even if she was not seen on the days in question just that she was having issues is enough to prove that they were there and in order for it to fall under the fmla act it has to have been done before now it would of been done when he was working its a form that the employer gives and it is taken to the dr and they fill it out and is returned to the employer. but in regards to the appeal get something from dr stating she was having issues just to prove what he is claiming. take all the right ups with him also and if their are only 2 i am pretty sure thier must be 3 for the same issue. any call outs that are backed with hospital paper work or notes from drs are things in his favor. he may not get his job back because they wanted him gone from the sound of it but it should help his appeal. good luck make sure he has all that paper to back his story up and that the appeal has copies also.

On answering the questions on the weekly claim for benefits it asks if you will receive holiday pay, vacation pay, etc. I answer yes and the next question is If yes, have you given a detailed statement to your local office? How do I answer that question and how do you give a detailed statement to the local office, I report the income where prompted.

Yes, it does favor you. The appeal process is for you and your employer to state their case. If they fail to state their case the unemployment agency should accept your claim.

I am wondering if I would be eligible for unemployment. I have worked for a local hospital for approximately 7 years, in a geriatric/psychiatric lock down inpatient unit. I have medical problems with my lower back, and have been under the care and treatment of a Neurologist since 2008. Over the last year, my job has caused recurrances detrimental to my health; at one time I had to take a medical leave and undergo physical therapy for 6 weeks. I returned to work, determined to maintain my job as my income was the sole income for my family. However, in October of 2010, my Neurologist suggested that I either take time off or relinquish my job position due to the fact that it continued to hinder my health and was worsening my back condition. I had taken out long term disability insurance through my employer, yet I had no vacation or sick time available to use, as to take advantage of this insurance it would pay nothing for the first 90 days...and my family could not make ends meet for such a time period without my income. For the same reasons, I was unable to simply take a medical leave (no vacation or sick time to compensate income) Also, at this time, my mother in law was diagnosed with stage 4 Lymphoma (cancer of the pancreas-spleen-stomach) and I was much needed to assist with her care, as my father in law was physically unable to stay with her in the hospital out of town. And on top of this, my mother, who lives out of town, is losing her eyesight due to Macular Degeneration and depends on me frequently to take her grocery shopping and to doctor's appointments, as she is now unable to drive. I gave my employer a written letter of resignation, including a 2 weeks notice, and did note that I definitely hoped to return to work in the future once my back was in better condition and more family could be able to assist in caring for my mother in law. Now I find myself unemployed; my husband is unable to work due to health reasons, and we have no income at all and we are relying on the assistance of my 22 year old daughter, who has moved back home to help with our household bills. As of today, my daughter is now unemployed. I have numerous outstanding medical bills that need to be addressed; and none of us can afford healthcare insurance at this time. My Neurologist has now dropped me as a patient due to my lack of insurance and inability to pay, and I just learned that he is closing his office. I have approximately 4 medications that I take on a daily basis, but now fear that I will soon have to do without my medicine as I cannot afford it. I am 46 years old, hold a license in practical nursing. I have applied for jobs at our local hospital but was told that they are not hiring at this time. I have also inquired at 2 local nursing homes, yet neither are hiring. My situation has reached a crisis level - thank goodness for my income tax return so that I am able to get caught up on some overdue household bills. Would I qualify for unemployment compensation? I am also considering filing f or assistance from social services, such as food stamps and medicaid, but do not know if I and my family would be eligible. I would greatly appreciate a reply as soon as possible, as I am very much depressed. At my age, I feel I am too young to apply for disability. I very much want to find employment.

I was terminated about 10 days ago and have filed my claim 2 Sundays and have recieved notice that my claim is pending. I realize that there is a waiting period however my question is 2 parts,First I was terminted for absenteeism after being late 1 day 1 hour because I had an accident the day before and had no transportation and he was going to write me up instead fired me I had no previous write ups.I also have some money from a claim from several years ago that I never collected what do I do about that?I also was wondering just how and what amount of the benefits the employer pays?

I was terminated due to filing an EEOC complaint. Of course my employer stated I violated policy and was terminated for misconduct. I had to work for almost 24 hours straight and had been up for almost 40 when I stated I was unsafe. I work in the medical field and I did the ethical thing. However, I was denied my unemployment even after I sent in 4 witness statements stating that that most people complained the the work environment was indeed hostile. I will appeal, but how can this happen!!!! Will the employer get by with this kind of treatment, I have been physically assaulted and nothing was done even after I went to HR.

I am sorry to hear this happened to you. I am currently entering into the nursing program and to hear this about a hospital is horrifying. PLEASE e-mail me the name of the hospital so I know not to apply. I am curious because I have been applying to a hospital for over 1.5 years, administrative work, and continually receive a notice "the position has been filled." Ironically, since applying for unemployment I have noticed the same hospital has the same positions still open and available for DWS applicants. This is my first time attempting to receive unemployment because you cannot attend a full-time nursing program and work full-time in order to keep your head above water. I have noticed DWS is more apt to award individuals money, who don't want to work and better themselves in the first place, than the individuals who actually deserve the money.

I work part time for 2 differenr companies. I have received notice from 1 company that I will lose my job, along with 2700 others, by March 19th. this company is telling us that we are eligible for benfits. However, most of us have other part time work. How does this affect are eligibility?

I quit my job to move to Texas in August. I first talked to my direct supervisor about transferring my job to a different military base in Texas. Unfortunatly for me, my supervisor's never gave me the time nor information that I needed to go to the main bldg to put in paperwork for a transfer, so when I went to do my resignation papers they would not help me do a transfer. Since being in Texas I have diligently tried to find a job, but am being constinaly told that I am not qualified or those choose another candidate. I filed for and appealed my first round for unemployment and lost. I am now approaching 6 months of still not being able to find a job. Am I able to refile for unemployment even after losing my appeal months ago???

I'm confused I made some inaccurate reportings of my income for a few months of my claiming unemployment. Now I'm getting this audit response and asking me to explain why I got over paid benefits. I dont know what to say. Do I say oops I misunderstood the amount they were asking me that I made over the phone? I mean most of the time I didnt even have a check stub in front of me and didnt want to wait for it to come in to file either on the phone or on the computer. I really dont want to go to jail.

I just got a letter from the FIRE unit in the State of Arkansas unemployment office. I was partially laid off Feb 1 2011 (10 hrs /week) and went back to work on 5-9-11. I was claiming my 10hrs and it was deducted dollar for dollar from my Unemployment. I received a letter today stating that I was UNDER INVESTIGATION FOR FRAUD! I have never been in trouble in my life! The discrepancy in the letter shows that my employer reported I made my regular salary on the week of 5-7-11 and I also filed for my UE. The last filing date I show is 5-8-2011 for the week of 5-7-11, but my bank statement shows that I didn't get my first pay check until 5-13-11. There was no hold back because I was on salary. Salary employees are paid current. So I did get 2 checks in one week. 1 from UE on Tues 5-10-11 for the week of 5-7-11, and one on 5-13-11 from my employer for the week of 5-14-11. I did not receive a check from UE for my waiting period, and I got a partial check from my employer. Did I commit fraud? If I did it was out of pure ignorance. I have never filed UE before and I answered the questions on ARKLINE as accurately as possible. What do I do? Am I going to go to jail? I am a mother of 2 little girls. I am worried sick. Please tell me what to expect. I can't get with my employer or the UE office until Monday. I am going to worry my self straight to the hospital if I don't find out something soon. This is going to be a long weekend.

Don't worry yourself to the hospital - I know you're freaking out, but everything will be OK.

While I can't tell you exactly what will happen, I would be shocked if you got charged with a crime or went to jail.

Most likely what will happen is that you will call the number on the letter you received on Monday, talk to them about the situation, and they will determine if there was an overpayment. If they determine that there was an overpayment of benefits, you should be given the opportunity to pay it back. If you can't afford to pay it back all at once, they should let you pay it back in installments.

I work for a federally funded head start program. The company failed to give me my paycheck but expects me to keep working with no idea of when or if I will be getting my pay. If I quit do i qualify for unemployment benefits until I can file another job. I have heard of constructive discharge but am not sure what to do. Bills are piling up and I have no way to pay them. They will answer none of our questions as to when we will be paid and have now worked another full week.

I am an lpn that started my first job a couple weeks after graduation last july in a nursing home. I was written up a couple times for errors, and not written up for errors the other times. I was told to report to the director of nurses if i found medication errors. I began finding lots of errors on a couple of the long term nurses and it wasnt long before i was terminated. The day i was terminated i did not sign the papers because the rn on duty that day was a witness to the fact that i did infact take the residents blood sugar and she administered the insulin for me. I am waiting on an answer from the adjudicator. I made mistakes as a new nurse but was told that was expected but i was progressing like i was suppose to. That is until i started pointing out the other nurses medication errors. Their disciplinary forms showed that i wold be suspended before terminated over a mistake made more than once. I was never suspended. Will i get my unemployment?
