New Jersey Unemployment If You Get Fired

Generally, in New Jersey you have to have lost your job through no fault of your own in order to collect unemployment.

In most cases, this means that if you get fired, you cannot collect unemployment benefits.

If you get fired from your job, you should go ahead and apply for unemployment benefits, because there are some cases where you can be fired from your job and still get benefits.

If you feel like you were fired unfairly, or there were extenuating circumstances, be sure to tell you unemployment counselor about them. If your unemployment application is denied because you were fired, you also have the right to appeal the decision.

I was fired from my job because I didnt show up.. My reasons for not showing up was because I got arrested. I called my job to let them know what had happened but they would hear me out.. I dont have a history of no call no show before. I worked my ass off for that job.. I just wanted to know if I stand a chance of getting unemployment?

I'm currently being fired from my job of 4 months, completely unfairly! I refused a promotion bc i dont have the advanced qualifications. If they offer me a position for 1/2 the amount I was hired for, is there any chance of collecting?

I am a New Jersey resident. I worked in New Jersey at the same job from July 2007 to August 2011. On August 9, 2011, this same job relocated all employees to their New York office where I continued working from Aug 2011 to Aug 3 2012 when they laid me off. QUESTION: Do I file for unemployment benefits in New York or New Jersey?

Hello! I took a contract position (W2) to perform a specialized piece of work. After I started, the company gave me more and more work outside of what I was hired to do, but I was okay with this. My weekly hours started creeping over 50 hours per week but I was told I could not put more than 40 hours on my timesheet. Again, I was glad to have a job and didn't fuss (and got excellent feedback about my work). And then I was told I would be working in yet another area (outside scope): when I asked how my work was going to be reprioritized (could not get in all done at the same time) I was told "we expect you to complete all of this at the same time." (And again, I was already working over 40 hours per week without ANY pay over those 40 hours.) I politely said "I cannot take on this extra work. I can take on SOME of it and can split it with someone else." I went home that night after work and received a call - that I should consider myself done there and to not show up On paper, I guess this is being fired (I hate even typing that word - never happened to me in my long career); but do I have ANY chance to collect unemployment? I currently have a unemployment claim that I stopped drawing on when I found this contract job. I did not re-open my unemployment claim at the time I was "fired" because I was sure I would get another contract pretty quickly (I always keep irons in the fire even when I have contract work). But it's not happening. Thank you very much for your help. Brad

Hello I have been working for my job for seven years. I Just started nursing school this year however my job is making me use my vacation time to allow me to come into work later than what I am usually scheduled.my supervisor has told me that when I use up all of my vacation time they will fire me do to my school schedule conflicting with their program schedules. And he stated that the company has changed their policies to where if your fired for attendance or school it's noted as a voluntary quit. I would like to know if I would still be able to collect unemployment if I can't find another job

I have a feeling my job is about to fire me for being late every morning. I requested a schedule change, and they allowed me to switch, but I am still having a hard time getting here. I explained on several occasions how stressed I've been, and how hard it has been trying to take care of my kids, because I don't have any help from anyone at all. I have to do everything in the morning myself before heading to work. Then I asked my job to send me to a less-stressful department that I have several years experience, but they are making me stay in this stressful department where I have no experience. I am having panic attacks left and right, still coming to work and doing my best job while I'm here. Even though I arrive late, I still make up the time and still work a full day. If they do fire me, will I qualify for unemployment?

Can I collect if I have a workers comp case going on and the reason they fire me was because my doctors papers didnt give me a full days off so my points aciumilated am I still elegible to collect

It has been over four weeks since I've lost my job as a dental asst. This week I had a telephone appeal where I explained I called out of work due to lack of child-care and that I am a single parent I was put on hold while the unemployment examiner spoke to the Dr I worked for she came back on telephone with a much different tone in voice said that the Dr had warned me of absences in office could result in termination. I in then return with the Dr told me sometime last year and I had straighten out my attendance. Examiners response to me was that a decision was already made to continue to call in weekly. And I have the right to appeal. So did I lose. Killing me to wait to know if I can receive benefits.

I work in a bank and they are becoming very commercialized with increasing goals all the time. I am putting a lot of time with late night call nights to increase production and bring my numbers up. Due to economy, a lot of people are very skepticle about banks and investments. My manager told me if I don't make my goals I can get fired. I am trying my best and everything to make my numbers. In case I get fired based on low production, would I qualify for unemployment so that I can go back to school to change my career?

I was terminated from my job on June 20, 2012 for theft of a customers cellphone that I turned into the Verizon carrier on June 8,2012 the same day I found the phone. After waiting 6 months for my first appeal my employers testifies under oath I turned in the phone which he later found out but claims I violated policy by taking the phone from the store to the carrier. I wrote home office who sent me copies of both lost and found polices which prove I did not violate any policy..so why is it taking the Board of review 11 months to reverse this decision and pay my benefits when I should have never lost my job in the first place. I worked for this company for 9 years and 4 months with not write up,no violation of any policy in my entire length of employment. The Board of review remanded my first appeal hearing on 12/19/12 back to the Appeal Tribunal for rehearing from the employer to prove as to how I violated any policy on 3/27/13 I was given a second hearing where the burden of proof was on the employer who was not even on the call . My biggest question is How did I get the same appeals examiner for the second hearing when he messed up the first hearing that was remanded...how is that even ethical??? The appeals examiner was obviously prejudiced against me for getting his first decision overturned. So the second hearing on 3/27/13 was a joke to this guy because he entered the same ruling from the first hearing when I clearly provided proof of the company policy into evidence showing I did not violate any policy. It's almost a year later. I was fired for stealing a customer's cellphone that was never stolen. Falsely accused and no one in the Department of Labor and workforce development can see that I have been wronged here or is the process to constantly send the employee through the appeal process so that the lawyers continue to make money and I need my money. I have waited long enough now it's time to turn this over to the local media. I have written emails to the board of review, commissioner wirth ,Joseph seiber, governor christy office, just to mention a few and justice has not been served. The bottom line is the board had more than enough time to review my case how much time does Louis Vargas need to see my employer wrongfully accused me of stealing and wrongfully terminated me after 9 years and 4 months with a company. No call outs, no lates, no violation of any policies, no written warnings, no threats or physical assault on anyone, no theft of anything, never falsified any company records. I do not fall under any category of misconduct. No simple, no severe, and no gross misconduct so why am I sitting here unable to find a job with theft on my record when potential employers are calling my previous employer being told I was terminated for gross misconduct for theft and I am not rehire able and I never took anything from anyone. I am not some teenager who does not know right from wrong. I am a 44 year old mother of 4 grandmother of 1 who is a college graduate and has 2 kids in college and one in HS on the honor roll and track team. I have worked 30 years with an excellent record and only quit one job to go to the next for career opportunities with 2 or more weeks notice. I need to know why is it taking so long to get a decision that should have been made in my favor back in December of last year ...I need a response now

I have been out on medical leave..I was to return at the end of the month since I used all my time they sent me a letter to reapply for a position at the bank..since the dr was to release me back to work and now have no job am I entitled to receive ..I reapplyed for a job and no answer as of yet
