New Jersey Unemployment Eligibility

In order to establish unemployment eligibility in New Jersey you have to:

1. Be a resident of New Jersey. If you are not a resident of New Jersey, but worked in New Jersey at your last job, you should still have New Jersey unemployment eligibility.
2. Have worked and earned income in New Jersey.
3. You must not be disabled.
4. You must be able to work.
5. You must be actively looking for a new job.
6. You must have lost your job through no fault of your own. If you quit your job or were fired for 'just cause' you may not be eligible to collect unemployment in New Jersey. Every case is different, so if you lost your job -- be sure to apply to unemployment in case you are indeed eligible to receive unemployment benefits.

There are special rules that apply to unemployment elibility for military personnel and union workers, so check with your mility or union representative for these rules.

I am having a situation at my job, I was hired for M-F 9-5, and my job was taken over by another dept. So my boss did not lose me to another dept, she pulled me out of that particular dept to keep me as her employee. After that, there was no title or set position or hours for me, and they started bouncing me around and switching my shifts and my days to work. I was promised a promotion and a raise which never came thru, and then we were taken over by another corporation. I was told to apply for another position, so I did, and I was never even interviewed for it and they gave it to someone else. Since then several positions have become available, and when I inquired about them, I was told they were not filling them as of now, but then they posted the job listing on the website. I have asked them several times that I need a steady schedule and hours because I have children and can no longer work all these different shifts due to childcare, that was why I accepted the Mon-Fri 9-5. When I refused to cover the other shift, I was told they could just change my schedule and I can either do it or lose my job. I am exhausted and ill from the changing of my shifts, they bounce me between 7am-3am, 9am-5am, 3pm-11pm, 5pm-1am, and 11pm-7am. I am starting to feel very ill and run down because my body does not get caught up between nites and days, and my boss does not care. I have been looking for work elsewhere, but I really want to quit. Thank You for your time.

Hello,i'Im currently working but Im going to start attending school soon in the state Pennslyvania, i currently reside in the New Jersey. Its going to be rather diffcult to work because my classes consume all of my time during the day, and the commute between my job and school is approximately 3 hours apart, resulting in inability to carry on with the both at the same time. My job requires me to work 40 plus hours a week constraining my time for studies making it virtually impossible to attend the school of my preference as a fulltime student, i have several responsibilties i must attend to such as a cell phone bill, car insurance, rent, cable, etc. I hope you can see and consider my situation.

I am enrolled in a master's degree program. For it, I am required to work an internship. My job just informed that I can stay but they will drastically cut my hours for work and consider me per diem. With a baby on the way, I can't afford to stay.
What are my chances of being eligible for unemployment in NJ?

I've been with my company for a little over 6 years, am in very good standing and got pregnant with tiwns, I was out on short term disability then FML. Before and during my leave I talked with my manager about coming back to work part-time. There is an employee who is leaving and therefore an open position. She had no problem with me taking it, until I the week before I was to come back to work. She wants me to stay fulltime becuase i'm good at my job, but the financial burden of daycare is ridiclous. I had twins and I'm working just to send them to daycare full time. I'd like to know if I can quit my job and collect unemployment until I can find a part time job. I do want to work, but part time. I do not need insurance, because i'm on my husbands. Can I collect if I quit?

Did you ever quit Laurie? I'm about to be in the same position as you were, being pregnant with twins, and I don't know if I will be able to return full time, therefore if my employer denies me to come back part time I will not be able to return due to childcare issues.

I quit my job in June of 2011, when my father passed away and I needed to help my elderly mother to sell her home and relocate to a senior community. My employer replaced me immediately. After I was able to situate my mother, i started to look for work again. I could not find employment by the end of the summer, and filed for umemployment. I was denied because I left my job. I have been searching for work for 7 months now, and have not been able to find anything yet. I have had my resume professionally updated, and I am working with a headhunter, but nothing yet. I have been living off my savings and am almost out of money. Is there any situation where I can now get unemployment while I continue to search for work before I use up all my savings? I'm not sure what else to do and am starting to feel desperation.

I'm in New Jersey. I was hired as part-time and promised 20hr/wk. Been working there since Sept 2010. Bounced back and forth between 12-24 hours for a while, then down to 7-10, then up to 30+ for 12 weeks straight. Then this past summer, went down to 12. I picked up hours in another department which gave me 24 -27. They hired someone else for that dept and i now get no hours there. The other dept cut me again to 7.5 hours. and then this week I was scheduled for 7.5 but they called me and told me they didnt have the payroll for me to come in. What can I do? This is ridiculous! Please help!

I'm currently on my 7th month and I asked my office to be roll-off from this engagement because of the commute but they have done nothing about it. Hi, I just had a baby five months ago, I was approached by my job via phone to see if I was coming back, I advsed yes but had to arrange my time due to babysitting situation,. They advised would work with me. I went back to work with condition that I would work three days at the job, one day from home and one day not paid under baby bonding time. Everything was working accordingly,.I was advised by the director that they needed me full time at the job and could not accomodate my hours,.I advised we discussed up to March I will work this way,. that same week I lost my babysitter,. I was forced to take the remaining babybonding time. I could get a babysitter nor pay the rediculously priced babysitters around my job, I advised my job and said I would be willing to work from home and or take a less responsible job so I can stay home, was advised they couldn't accomodate me. returned to work for two days, left my baby two hours away from my home and advised I couldn't come back to work. Would I be eligible to apply for unemployment? Currently I'm looking for a part-time or work from home job. Note: employer has other employees working from home.

# STRESSED 2012-03-15 20:31
I have been working at my company 15 months, the past 3 months my medical condition has gotten extremely worse. Much of which comes from my work environment, co workers and especially manager. This led me to have to take a medical leave for a few weeks. Everything is being taken care of through my Human resources department and doctor. I told my manager before I took my leave and he was well aware. At this point he started giving me a hard time about taking it and giving me incorrect information, being hostile, and making this situation more stressful. My manager told me the day before I left that if I took my medical leave he would assume my job wasn't "important" and he would terminate me. I got in touch with HR only to find out he was wrong and feeling like he is doing this to give me a hard time because he has been hostile to me prior to this and treats other employees different. I have been out of work a week now and have been getting calls from people at my work who don't work in my department asking me if I still work there and other things which makes me feel uncomfortable that he is giving information on my absence because there isn't another way people would know because it's an HR matter which should be private. My medical reason is getting worse from the stress and unnecessary aggravation and incorrect information I have been dealing with. If I loose my job because I can't go back due to my illness or quit because my conditions and health is getting worse and I cant work like this for my health anymore, could I collect unemployment while I look for a new job and take care of my medical condition? Could I collect if I quit for this reason? Worst case would be me going back to work and he may fire me for his own reasons eventually. Let me know ASAP PLEASE!

I am in a similar situation, only the hr dept is causing hostility also. The place I worked at caused medical issues, I took time off and was constantly harrassed thru email, phone, and letters being sent to my home. The gossip in the office was rampant, and coworkers would constantly txt me to see what was wrong because they heard blah blah blah. Constantly being threatened by management, as well as hr, the letters they sent indicated that I was a no call no show, but I called my manager all the time when I was out. They are trying to screw me over or something? I am following all the necessary steps in the unemployment process, but I feel like my ex job is going to lie or something bc that's what they are all expected to do to make the company look good. Hr only consists of a single person who is friends with the owner and is not about to take the side of an employee ever. I have been screamed at by her before previously. What can I do here? I feel trapped in the system

Go to an attorney and make sure that you have FMLA. If you are covered under FMLA you are under protected status and they can be sued for harrassment. Get a good attorney. Do research on line to find one in your area.

My boss recently pulled me aside to discuss my performance and in the process bluntly asked if I truly enjoyed my job and if I saw myself doing it forever. I honestly answered that I did not see myself doing it forever. Shortly afterward this was communicated to the owner and I was confronted again and was told that since I did not want to be there and was not willing to work at being a better employee they were searching for a replacement. I asked if I was being let go or if this was an ultimatum since I never told them I was going to quit. They more or less did not answer directly but said I was not being let go but I did not want to be there and they didn't want me to be unhappy working there. I am still confused and made it clear that if i would not like to quit because I need to work. They told me the replacement would be there in about a week. Now I am worried if I go along with this, (since I feel I don't have much of a choice) that if I do have to apply for unemployment they will say I left voluntarily or I was let go for just cause? Do I have any options? I did try to express that I would be willing to do more training in order to improve my performance but they would just answer by saying but you dont want to be here. I feel as if they took those words completely out of proportion, I did not tell them I wanted to leave my job, I need to work.

I had my first baby and was out on maternity leave, and then I asked for a 1 month unpaid extension from my work, which they granted. Then 2 weeks before I was due to return (1.5 months ago) I decided that financially I couldn't afford to return to work and pay for daycare based on my salary. I let them know that I would be looking for a stay-at-home job, which I have not found yet. Can I collect unemployment?

I work two jobs in NJ but live in PA. I will be getting laid off from my primary job (where I am almost full time and make a higher wage). Am I eligible for unemployment if I am still working at my "side job" which only brings me about 1/4 of my income?

I did almost the same thing as you. I left my job as a toddler teacher after 17 years to pursue a new career in a new field and it's not working. For the last 2 weeks they keep telling me to resign and every other day I am being threatened that I am going to the big boss. Did you find out if you are eligible or not for unemployment. I was told to just get fired don't quit. I would appreciate it if you have any information.

I was working full time and switched to per-diem. I have not worked for almost a year and have not been able to work the suggested hours my employer asked. They are letting me go because of this. Am I eligible for unemplyment?

I was with my former employer for over 1 year. I had to take some time off due to a temporary disability. 4 weeks before I was due to return to work I got a letter in the mail from my employer that stated they were no longer holding my position for me and that I could re-apply once I recovered from my disability. Due to the financial hardship of no longer having a guarenteed position I was forced to move out of state to live with family.Am I going to be eligible for unemployment since I did not voluntarily resign my position and was not fired for misconduct of any kind? And will it be harder to collect now that I live in another state?

For the past 9 months, i've been working for a trucking company in New Jersey hauling freight, since the last job in my state of residence (PA) didn't pay as much. I made more money in NJ (32,895) but only worked 10 months for the NJ company before being let go for medical reasons with the option of rehire once medically cleared. Will I still file for unemployment in NJ or PA since that's where I live and I didn't qualify for short term disability?

I was let go from my job of 20 years. I am collecting ui benefits. I have started a little business buying items at estate sales and selling them on ebay. Am I required to report this income or will I be committing fraud if I don't. It's about 1000 dollars per month of income about 750 is profit.

I've worked at my job for 1 month shy of 12 years. My company was purchased by a corporation 2 years ago. Recently, the corp. cut hours due to business being slow and profits falling. We were told if things don't change they would be forced to discharge employees. About one month into the reduction of hours my position was term. The reason I was told was staff issues. I was told by my former boss that would quailfy for Cobra and receive 2 weeks severance pay. I applied for unemployment. I yet to receive any paperwork from them. I go online and it say I qualify for monitary benefits, but its says I have a non-monitary meeting for 10/3. I applied for benefits 8/30. What does this mean? When will I get any payment? I call the phone # and never get through! I yet to get my severance pay. Hopefully it will come today because its a regular payroll date. I have very little $ and don't know if I will be able to keep a roof over my head without some sort of income. I've received nothing by mail yet. Any advice would be helpful. I've never had to apply for unemployment before. I've had 2 interviews so far. Crossing my fingers tightly!
