Nevada Unemployment If You Quit

You can not receive Nevada unemployment benefits if you quit your job.




In order to be eligible for unemployment benefits in Nevada, you have to have lost your job through no fault of your own. This means that if you quit your job, you can't get unemployment.

Be sure that you can not quit your job because you didn't like it, or it was too hard, or because it didn't pay enough, or because the hours didn't work for your schedule - and still expect to collect unemployment.

If you are in a hostile work environment, or otherwise feel like you have to quit for a very good reason (such a threat to your health or safety), please take the following advice:

The laws and requirements for unemployment eligibility vary from state to state, but most states do not allow you to collect unemployment benefits if you voluntarily quit your job. If a state does allow you to collect unemployment when you've quit your job - the requirement to do so will be VERY difficult to meet.

In most states, if you are fired for cause you may still be eligible to receive benefits - and the requirements in this case won't be as stringent as if you had quit.

It is my understanding that employers generally do not comment extensively on previous employees, or on the reason that they are not longer at their company, for fear of being sued. Most employers will generally verify employment dates and not comment on the reason you are no longer there, or offer any further details.

If your company fires you though, you can be sure they won't be writing you any recommendation letters.

I know how difficult a hostile work environment can be. I've been there. Still, I would suggest that you do not quit your job. If it is a large corporation, you should talk to someone in the Human Resources department about your situation and the hostile work environment. If you get fired and you have a wrongful termination case, it will be more difficult to appeal your case to the employment commission or more difficult to bring a wrongful termination lawsuit - as you will have willfully quit.

Millions of people are out of a job - so it looks like you'll be diving head first into a very difficult job market, no matter if your fired or quit.

Make them fire you.

Go on about performing your job duties, and do not do anything to provoke them to fire you. If they're going to fire you, they'll do it. If they continue the hostile work environment tactics, or increase them - you should contact the employment commission to see if you have any recourse or protections - as there are federal laws against hostile work environments.


Don't sign anything!

Don't sign any releases, forms, waivers, or anything.

If they present you with paperwork that has to be signed in order to receive a severance or your last check -- Don't sign it!

Take it to a lawyer, law school, smart aunt or uncle, or research and ask about the terms in the document online.

If you do end up signing it - remember that it is a legal document, so understand and agree to everything in it before you sign it. Also, remember that the terms are negotiable, because it is essentially a contract. If they want you to agree to their terms, you have the right to either:

a. Not sign it.
b. Negotiate the terms of the agreement.
c. Sign it.

Examples of ways you can negotiate this legal document, which is often referred to as a 'Separation Agreement':

a. Demand that the agreement state that you are being laid-off, not fired.
b. Demand that the company will not challenge your claim to collect unemployment benefits.

My job is basically firing me, but on the condition that I take another job that my employer gave to another company to handle their operations now. If I don't sign the agreement to go to that other job, they are basically saying that quitting. Is this possible? The problem is that company is only keeping us for 2 months.

I quit my job after they the company called the cops and put me in jail for theft. I pleaded innocent. Can i file for unemployment in las vegas.I have been denied once. I am going to an appeals on Sept. 2. Do I have a chance of winning. I was given false information by the management, misleading me to try to coerce me to admitting guilt. I felt I exhausted all remedies to resolve the situation but management became vindictive and made deceit lies to the detective on the case. After three days I bailed myself out and went straight to the casino and Quit not knowing that the due process was not finished. And the human resources dept/employee relations hadn't once told me that iI was giving up my rights to a due process as I signed the papers of seperation. please advise. thank you.

My fiance was offered a position with a company in another state so we will be moving. We cannot afford to maintain two households and I have been applying to jobs, but havent gotten any responses back. Am I eligible to receive unemployment if I am unable to find a job before we move?

i use to work 5 days a week and now every month she lowers a day and hours now im down to 2 days and only 8 hours meaning 1 day only 4 hours and the next only 3 ...i cant afford for her to keep doing this can i collect unemployment if i quit ? or do i wait until i get fired?

I currently work for the Nevada Dept of Corrections as a Corrections Officer. The working environment is becoming increasingly dangerous with a constant danger to my well being every day. There have been a number of Officer assaults over the course of the last month. Would I qualify for unemployment benefits under these circumstances if I was to quit?

My situation was very difficult I quit my job after a horrible breakdown that lead to a seizure that I never had before in my life! I am not diagnosed with bi-polar disorder or manic depressive but when this employee there kept harassing me to the point where shed provoke me to hurt her I would just leave it alone but at home it was another story. I got insomnia I was always crying I was always angry but little by little it got worse. I noticed slightly loud sounds would scare me, my legs and hands would always shake, when Id get angry my torso would shake and I would get mad at everything! I got sick every month where I needed to be off for 5-7 days and see a doctor!! Id stutter randomly, gained 60 lbs from stress eating, got migraines every week and Im only 24 years old!!!! When the co-worker and I would argue the supervisor always had to get called but nothing ever happened to remedy the situation! Finally last week I had my fill it got to the point where I wanted to hurt myself because I couldnt hurt her and I had a seizure I even woke up twitching still. I got referred to a neurologist, got prescribed pills that are anti-seizure and was told that later on I need to see a therapist. My family said enough was enough and took it upon them to tell my job because they couldnt do nothing to help me I quit then I called myself when I had the strength to talk I have never been so mentally exhausted I knew I couldnt stick it out at work and didnt want to risk loosing my job because I couldve come out short on my register. But I cant see the neurologist because I have no insurance now and need the money but almost on a daily basis I suffer from panic attacks and I dont know what to do I have never been this way. I just want to see a doctor so I can get the help I need that was brought on by the work environment I was subjected to because the manager or the supervisor didnt think it was a priority issue to deal with my situation on a more personal level.

I am a CDL driver. My company has us drive over our hours on a regular basis. This is not only concerning because it is illegal, but if I get in an accident and hurt somebody while I am "out of service" or over my hours I could face criminal charges.
If I quit my job because of this concern, could I collect unemployment in the State of Nevada?

I began collecting benefits after being laid off from my full time job. I was able to swecure a part time job making 50 bucks a week. I had to move home away from my job because i couldnt support myself on these hours and this pay. Isnt that good cause for leaving/quitting a job?

I recently just quit my job with the Nevada dept of Corrections due to a hostile work environment as well. My health and well being has gone down the year I was there as a result. The job is very stressful. I didn't want to get fired because it looks bad on a résumé. The commute was also too far and the pay wasn't enough for me to make ends meet. I worked at my job in.Nevada for 4years.. moved back home to Illinois and got a new job,well 2weeks later the new job fired me because I was not.a perfect fit. now Im cant get my unemployment benefits till after an.appeal in the mean time looking for another job is hard with no.income but im told to file for benefits.till a made... how am.I to live and survive

The bills are adding up and with no income we struggling. would I be able to get unemployment just till I could find work.

Im about to quit my job due to not recieving the proper training. I started last week &was only trained for about 30 minutes and was left alone ever since. They keep telling me "someone will be here to help" and no one has showed up. I come to work to an empty office and leave to an empty office some days. It is a very stressful enviorment for me and has caused to to feel depressed. There is so much more to this... Can i collect unemployment?

I traveled four and a half hours away to California because I was desperately looking for some type of employment I did not have a place to live I was living out of my car I only did 6 hours of orientation paperwork and Drug Testing but then realized I have no place to stay and was forced to come back home the next day will I still be able to receive unemployment because I had to quit that job or really didn't even work

My high stress job is making me physically ill. My employer has made it clear they are trying to fire me. Just to be clear, the illnesses happened before they said they are trying to fire me. My doctor wants me to leave that job, she says the stress will kill me if I continue. If I quit, can I get unemployment while I look for another field of work, since I have physical symptoms and a doctor who wants me to leave?

In Nevada if you are asked to resign due to situation that is beyond your control is there any chance of collecting unemployment. You are told to resign or there could be legal action.

I quit my job to have time to look for another one. We were recently told our company was moving to another State and the last day of work is unknown. I am trying to avoid having to look for a job "spur of the moment" when they decide to be done. We are not aloud to take time off because of the work schedule to find another job. I saw no other way to to have time to persue another job. Can I qualify for unemployment while I am looking for another job? Thanks is, Louie.
