Is the following considered fraud by the employer for intentionally misleading employment information: a girl in my office is on unemployment benefits. she is working part-time 20 hrs.per week. The employer is paying her 10 hrs. per week and banking the other 10 hrs. When her benefits ran out the girl took a vacation with the money saved by the employer. (was banking for her) I know the employee is responsible for claiming the 20 hrs weekly while its happening but isn't the employeer intentionally misleading the Unemployment program and committing fraud?

I have worked for 40 years, I got injured on my job on 9-19-11,and have been collecting workers comp. My question is if I am out longer then a year and my work lets me go from my job am I eligible for unemployment ? Because if you go back 1 year for eligibility I have not worked but collected workers comp. Do you consider my 40 years of working or just the last year working?
