Indiana Unemployment If You Quit

You can not receive Indiana unemployment benefits if you quit your job.

IF YOU HAVE A JOB, AND ARE LOOKING TO CHANGE JOBS, DO NOT QUIT YOUR JOB UNTIL YOU HAVE A NEW ONE

In order to be eligible for unemployment benefits in Indiana, you have to have lost your job through no fault of your own. This means that if you quit your job, you can't get unemployment.

Be sure that you can not quit your job because you didn't like it, or it was too hard, or because it didn't pay enough, or because the hours didn't work for your schedule - and still expect to collect unemployment.

If you are in a hostile work environment, or otherwise feel like you have to quit for a very good reason (such a threat to your health or safety), please take the following advice:

The laws and requirements for unemployment eligibility vary from state to state, but most states do not allow you to collect unemployment benefits if you voluntarily quit your job. If a state does allow you to collect unemployment when you've quit your job - the requirement to do so will be VERY difficult to meet.

In most states, if you are fired for cause you may still be eligible to receive benefits - and the requirements in this case won't be as stringent as if you had quit.

It is my understanding that employers generally do not comment extensively on previous employees, or on the reason that they are not longer at their company, for fear of being sued. Most employers will generally verify employment dates and not comment on the reason you are no longer there, or offer any further details.

If your company fires you though, you can be sure they won't be writing you any recommendation letters.

I know how difficult a hostile work environment can be. I've been there. Still, I would suggest that you do not quit your job. If it is a large corporation, you should talk to someone in the Human Resources department about your situation and the hostile work environment. If you get fired and you have a wrongful termination case, it will be more difficult to appeal your case to the employment commission or more difficult to bring a wrongful termination lawsuit - as you will have willfully quit.

Millions of people are out of a job - so it looks like you'll be diving head first into a very difficult job market, no matter if your fired or quit.

Make them fire you.

Go on about performing your job duties, and do not do anything to provoke them to fire you. If they're going to fire you, they'll do it. If they continue the hostile work environment tactics, or increase them - you should contact the employment commission to see if you have any recourse or protections - as there are federal laws against hostile work environments.

VERY IMPORTANT:

Don't sign anything!

Don't sign any releases, forms, waivers, or anything.

If they present you with paperwork that has to be signed in order to receive a severance or your last check -- Don't sign it!

Take it to a lawyer, law school, smart aunt or uncle, or research and ask about the terms in the document online.

If you do end up signing it - remember that it is a legal document, so understand and agree to everything in it before you sign it. Also, remember that the terms are negotiable, because it is essentially a contract. If they want you to agree to their terms, you have the right to either:

a. Not sign it.
b. Negotiate the terms of the agreement.
c. Sign it.

Examples of ways you can negotiate this legal document, which is often referred to as a 'Separation Agreement':

a. Demand that the agreement state that you are being laid-off, not fired.
b. Demand that the company will not challenge your claim to collect unemployment benefits.

i put in my two weeks notice at my company and the day i put in my notice i worked half of the day as normal and then all the sudden my regional manager came in and went ahead and let me go. i wasnt able to finish my two weeks and the other job i had lined up fell through. will i be able to recieve unemployment benefits? or is it considered me quitting even though they let me go that day?

I am working full time putting in about 50 to 60 hours a week. I am starting school this fall as a full time student and I can not do both and still excel as a student. If I quit my job to be a full time student can I collect unemployment?

A lady harrassed me and another lady for a good while. She purposely started arguing with the 1 lady at work then when I opened the door she turned on me. We was informed earlier that day by the supervisor that the lady that started the arguing would be getting laid off in Sept. and she had already been informed of it herself. So she purposely did this all to try and get me or the other lady fired to keep her position. I did not quit my job but was fighting to keep my current position. The company put it under investigation which left me unemployed until further notice.[the owners ex husband and the dad of the president of the company is the investigater conflict of interest ] the lady that purposely started everything has a grandson married to the owners grand daughter and the president of the companys daughter Which is a conflict of interest. There was 3 in their working 1 lady started it all and I feel like they singled me out. Will I be able to get unemployment if they terminate me? The other lady and I both turned in several papers stating things that had happened against the 1 lady but as of right now it looks like they terminated me. Please help thank you

the lady also claimed she had a tape recorder hidden on me and the other employee. I thought this would be blacklisting??

I am a collage student when I started my job I was promised to have days off for class and out early on homework days for 7mos every thing was fine they are now not letting me have off class days or letting me out early on home work days I have been looking for a new job for around 3 mo and have not gotten anywhere w it and the hrs they are now working me just happen to be all the time I need for school or are crazy split shifts 5am to 8am then 4pm to 6pm but I'm not always able to leave on the split making it increasnling hard to get any home work or class time in is there any help for me I'm failing classes and can't miss any more class time or I will be kicked out and have to start over

my pay is being drastically change. we are currently paid 8/hr plus commission. they are changing to commission only. this is totally unacceptable and totally different from what terms i agreed to when accepting the job. can i receive indiana unemployment if i quit and refuse to work for commission only?

I was told Jan.1 that I would be laid off the second week of March. I had decided to sign up for school and use this as an opportunity to further my education while collecting unemployment. I just found out yesterday the company wants me to transfer to another location 15 miles away, demote me, reduce my pay by almost $5, and cutting my hours by 10-15 per week. They are also taking away my dependants insurance and reducing my benefits. If I decline the offer, which is not even comparable to my current position, would I still be eligible for unemployment benefits?

I asked my boss before singing up for my evening cna classes if I would be able to leave early. She told me yes so I signed up n paid 800 dollars out of my pocket. Friday before my class started on the following Monday I reminded her and she told me no I can't leave early so I offered to leave even ten to 15 min early and she said ought class is in ratio (i work in daycare) well she only said this because she doesn't want to stay for me for that ten or fifteen min and now I am late to class everyday and going to get in trouble. Plus I have to have certain amount of hrs n no make up time and its deducting time each day so basically I am going to be screwed n out my 800 dollars n did all work to find out I don't have enough hours . If I quit my job so It can finish these classes wich ends in may can I get unemployment atleast for a month until I am finished with my class because I am setting up jobs right now to start for right when my class is over.

I was accepted into the RN nursing program and my job told me that they would not work around my schedule and I needed to turn in my 2 week notice. I turned one in, I am a full time college student now. Will I be able to get unemployment?

my family doctor and my back surgeon have advised me to quit my job Ive worked for 24 yrs. due to a blown disc, bone spurs and chronic pain all which will only get worse if I stay there..this may or may not of been caused by my work but it is being made worse by my job...doctors told me if I stay Ill end up on permanent disability eventually... Ive had to tad medical intermittent FMLA due to the chronic pain which gets very bad after going to work... can I draw unemployment when quitting for a verifiable medical reason...surgeon says if he fixes my back it will be back in same condition in a yr. or year and half due to my work... thanks, Dean

I been filing for unempolyment for four weeks now and at first they say i quit but i didt my job called and told me they was taking me off the schedule because I need to renew my L's so I filed cause I don't have the money to pay for my test. They lower my balance but I haven't receive my card yet and now it say on my weeks is denied week ? I dnt understand cause they took money from my balance and they still let me file. Am I still going to get my weeks I file or I'm just denied ?

if me and my wife are working for same corporation and if I want to open my own business and due to conflict of interest they would my wife get fired for it. if she gets can she file for unemployment
as this is ridiculous as these corporations force you to work for them and not open your own business due to conflict of interest policy if you are husband and wife
what's the way out of it

Hello I'm 19 weeks pregnant and currently work at a pawn shop. At my job I have to move around generators, 50" TVs, huge miter saws and chainsaws as long as me. Also, we have riot gates over the front of our doors that weigh about 50lbs and has to be lifted each morning before entering the store. My boss nor co workers will give me any help at all and lately I've been having a lot of stomach cramps and back pain because of it. Everyone I work with is aware I am pregnant ( I am clearly showing and have told them). Not to mention I'm threatend everyday by angry customers. So my question is, if I quit due to these reasons would I be able to collect unemployment?

I took a job in Oregon and my wife will be coming out when she finishes her job for the year. She works with a company that places crisis counselors into schools and they work the school year. As she follow me to Oregon will she be eligibile for unemployment benefits since she is following her spouse.

I recently took a job that is 3 hours from my home with the anticipation of relocating. Having been there for three months Im not having much luck finding affrodable place to live.
Can I quit and still recieve unemployment benifites since relocation is no longer an opption?

I worked for a large corporation in Indianapolis for 4 years. I was an outstanding employee, won numerous awards for myself and the programs that I ran. Good regard with Sr. Executives, CEO, CFO, HR Director, co-workers, staff and community partners that I worked with at my company. I quit my job for numerous reasons
Frustrated by the lack of supervisory support, Very poor communication and lack of program awareness by supervisor. Lack of establish defined job roles. Over worked and underpaid, (I have documentation.) Did the duties of grant manager, program manager, activities specialist and community liaison\ recruiter. (Corporate\SR grant manager was aware.) Not given the title and didn’t receive the pay as stated in the grant. I was required to add 10 more qualifications to my job responsibilitie s for a .50 raise. I was the only staff member to have attend 8.00 am Monday morning meetings.
Maintained a constant level job performance, duties, always graded in top 85% in my branch for my annual job review. Superseded all requirements of the grants that I manage. The executive director was aware of these conditions. We tried to come up with solutions, yet I didn’t feel like it was my job to manage my supervisor. The only way i thought out of this situation was to quit. I loved my job and was good at it. The people I worked with and affected would say the same. It was very hard to leave something that I were good at.
I was offer a new job, starting in March but was push back to May, which made me get behind on bills. Can I qualify unemployment? I just want the unemployment for those 5 months. Thank you for any information that is provided.

I recently stepped down as Senior Manager of 16 years of a restaurant, due to not being able to for fill the requirements. I was told I would be let go if I stepped down, then I was told I could stay but it was temporary, and stipulation were attached to my staying. Now I am being mistreated by the GM, hours have been cut over half, while other employees ( with less then a week under their belt) have 10 to 15 more hours then me. I filed for unemployment, but do not feel I can continue being employed there. What happens if I quit due to mistreatment of upper management since I already opened a case??
