We are looking at cutting back our staff to 32 hours per week instead of 40 for a number of weeks. We would like for our employees to be able to apply for unemployment for this 8 hour shift per week. Is this possible?

I live in Indiana. I was fired on April 1st, 2011. "They" said it was due to work performance. I had been employed at this company for almost 5 years and all of a sudden... I'm just "not" up to par as they say. Three weeks prior to me being terminated, they had hired 4 or 5 people. I was actively looking at other jobs and I did tell that to a couple of people prior to me being terminated. I know that is the "REAL" reason of them firing me. As far as documents... I am not aware that they had ever written me up 3 times. I think by Indiana law, they are required to before letting someone go. I've been filing my claim every week... I called Unemployment and they said that they are still processing my claim. I know that my previous employer will deny it... because they have in the past with other people. I have turned in all documents plus I wrote a letter to the Unemployment office of what happened when I got fired. So, now I'm waiting in limbo... I don't know what else to do??? As I have been looking for other jobs and to no aval... I haven't had money coming in for almost a month... So, no money for bills, groceries. I had my phone turned off bc I couldn't pay for it. So, I am just STUCK! I have been employed in way or another for the past 10 years and this is VERY new to me... I'm about to go insane... I REALLY need the unemployment to help me get through... I guess if they deny me, I will appeal it... but that's going to take longer... and time is something I don't have... I had just bought a new car before getting fired... so NOW I have no way to pay my car payment.... THEY really screwed me over big time. Does anyone else have experience with any of the above... I just need some hope at this point that I will get unemployment.

Sarah, I'm very sorry about your situation and hope things are getting better for you. If you haven't done so already, I would recommend contacting an employment attorney for assistance in determining if you have a case for wrongful termination. Best of luck to you!

I had a similar problem. My company said they fired me due to job performance. This just happened to be when I was returning from a worker's comp. injury. My claim went to the adjudication center. The determination said that the company has the burden of proof to show you were fired due to WILLFUL misconduct. As far as I know, looking at other jobs is not willful misconduct! If they say they wrote you up three times ask to see your signatures. It took three months for this to be settled for me. I was lucky in that I am married and finances only took a medium hit. Any time I reached a real person at work one I was told to wait, and wait. If it helps any, I did get retroactive pay from the date of my initial claim. If I were you I might contact your bank re:the car and look into other sources such as food pantries. I know, you never thought you'd be in the situation when you'd have to do it, but these are the times we live in and we do what we must. I wish you the best. Don't let the idiots get you down.

my situation was simialar of losing my job I did however enentually get m y unemployment (it took maybe 3 months to get it , they did pay me back pay of my unemployment, but before this I emailed the state of indiana told the truth about job opportuities in indiana and they took my unemployment away from the klu klux klan is owning more than you know whioth others stolen vegas winnings

I am experiencing all the above i aswell got let go in Jan after being off for two wks due to a severe respitory infections which had collasped my lungs throwing me in a coma in the ICU the same weekend of my college graduation. I had to work with very harsh harmful chemicals plus I did way more jobs above my pay grade like all there IT work then boom i was let go for medical reasons before the end up responsible for my condition and herd it is months later i have no job no Ui pay no money with 5 kids and where wks from being homeless. I have been searching for jobs multi hrs a day for the past year since i got my honors degree and still nothing so believe i feel your pain and im drowning in this quicksand.

I was fired for "misconduct", however 2 months prior I received a raise for my excellent review. I had been butting heads with my boss and I had picked up a consulting job in the evenings two months prior to being fired as well. I also know that they did not want 2 people in my department. It seems coincidental that I was fired for misconduct for consulting with another unrelated company without given a choice to quit the other place. I also am continuing to consult with the other company part time. I am not sure if I will be eligible for benefits because I am considered self-employed even though I make less than what I was making at my previous job. Am I eligable?

I went out on fmla and have been out on disability for eight months. I was released to work with restrictions however they cut my position due to my physical restrictions. Question one is will I be able to use my last working paystubs prior to fmla for calculating my unemploment entitlements and question two, will my physical restrictions count against me in any way? One last question please, since I have physical disabilities does Indiana have any programs to assist me in finding a job. Thank you very much for you help

I work two part-time jobs, am a full-time student and single mom. I have just been notified that in two weeks I will be laid off from my main part-time job (my main source of income). Because I still have one part-time job (12-16 hours a week), do I qualify for unemployment benefits for the job I have been laid off from? I am about to have a baby but because I am only a part-time employee I do not qualify for FMLA nor do I qualify for short-term disability. Though my manager has agreed to rehire me, I will be without any income for 4-8 weeks, although I will still have bills to maintain. My daughter in Indiana is being laid off due being 6 months pregnant from a dry cleaners. They do not want her inhaling all the chemical fumes, which is understandable & the safest thing to do. She was told that once she has had the baby & is able to return, she can come back and work for them in the same job. She doesn't think she is eligible for unemployment, but I think she is. Can anyone answer this?

my employer does not pay on time and has placed me in a terrible financial mess. also, do employers have the right to continue smoking in the office when it clearly bothers the employee? they also take money from my check but are late paying taxes and unemployment insurance . when i asked about the no pay since they obviously do not have the funds, i said well then lay me off, they laughed and said you won't get unemployment because we don't pay....but they take it from my check. in a terrible quandry....any comments would sure help.

Part 1: I am a waitress in Indiana. The restaurant I've worked at for over a year has informed us there will be a shut down period for remodeling beginning in the next 4-5 weeks but no length of time is known (no return date). I am paid $2.25 an hour and taxed 15% of my sales on every pay check. Will I be eligible for unemployment during this shut down?

Part 2: If I am given a return date at the last possible minute does that mean I will not be eligible for benefits? If I am eligible how far in advance do they need to give a return date to cause me to be ineligible?

Part 3: If I am offered a few hours a week during shut down to help with clean up or set up but not enough to come close to my normal income will I be eligible for partial benefits beyond that income?

Well it means you were to go in for a meeting to review your employers that you did, and if you didn't show, they put your claim on hold. But guess what, they never sent out the letters to let you know about the employment. So guess what, we are left with our claims on hold because of their complete negligence until they can reschedule the meeting. Go figure, the state didn't send out the money correctly to the counties. Wouldn't figure they would get this correct either.....lol

Thank you Eric for posting the meaning of REA EUC PF. It showed up on my husband;s account under delayed payment today and he was informed that he refused to attend a meeting last week which he didn't get notice for until the day after the appointment. I can't believe they are delaying a payment because of something they did wrong. If he goes in tomorrow as now scheduled, I hope they take this garbage off since this is from their negligence, not my husband's refusal. Rent is due Monday, and we need his check in order to pay it.

I accidentally somehow put NO when asked if I was available to work when filing my voucher. I AM available to work and I answered what happened when the link came up asking why my answer was not a YES. I could not go back and fix it. I have tried calling, but cannot get through. I emailed what happened, I need the money, can this be fixed so I get my payment this week?

My husband has his own part time electrical, heating cooling business will still working at factory part time. when he is layed off from a factory he claims unemployment beneffits.. Is this agains the law.. In the last 7 years he has been unemployed 5 years.. given extentions and some months without pay.. just wondered if this was legal..

My employer (ground handler of major airline) of 13 yrs is going out of business (10/30). According to their manual, I am eligible to retire (age 52 + 10 yrs). Another company is coming in to take their place and has offered me a job with a 35% paycut plus 225% increase for health insurance. I cannot pay my bills with that. If I take their retirement package (which only includes flight benefits), can I get unemployment until I find a more financially suitable job?

HERES AN AWESOME FYI FOR ANYONE TRYING TO CONNECT TO A LIVE PERSON WHEN CALLING BOUTS AN ISSUE....when the little automated lady says "For english, press one...Prada prema dose" (or something like that )....DO NOT PRESS ANY KEY and just wait... it will take 5 to 10 minutes to get through and lil autolady will keep asking you to press 1 or 2...but if you just wait....SOMEONE WILL ANSWER....keep that between you and me ;)

Those of you who have had your benefits delayed because of the REA EUC RF. Just know that even after you go to the orientation and attend the meeting on how to do job searches, and after you sign up for their workshops, and after you spend your money driving to and from the orientation and the meeting......they will still deny you benefits for that week. Any way they can screw us out of money that we all desperately need, and some how it's our fault that we didn't get paid.

I truly appreciate the unemployment benefits that I have been given. This is a very difficult time in our country and the system that has been put into place is a great help........but! Either give it to us or don't! Don't give it and then talk it back and blame us for it. A lot of us are barely hanging on. Missing one week of benefits is a big blow to a lot of us.

I just wanted to let everyone know that if and when you get denied for that week because of a meeting you didn't even know you had to attend, YOU will be to blame for it.

Thank you so much for this information. My sister and I are both unfortunately on unemployment and started the EEUC extension within the past month or 2. What makes this even crazier is we have called and made visits to the work one office since we were close to ending the state benefits, as we we are only a couple weeks apart on our benefits. They continue telling us "don't worry.... Just wait.... You will get a letter eventually." REALLY! So like u said, we can be overly proactive and as we all know this is not the only time furring the benefits they have ruled us eligible for us suddenly held from us.
Don't get me wrong, as I too am VERY thankful for the benefits that I have received, but knowing it is most likely being taken from us in a week anyway one would think their would not be such a lapse on their part.
An FYI to anyone who is looking at this, watch closely because my issue showed up on Saturday where the offices are all closed until Wednesday now therefore you may not be given an option to inquire about it anyway prior to having your monies for that week held.

I know you can't get benifits if you quit your job but what about for a medical reason? I had to quit my job because my backwent out, a few discs herniated making it impossible to move, walk, or sit without pain. I was no longer able to perfofm my job duties. I have to see a neuroogist for my back, it has become that bad. Could i qualify? Do i have any other options to help my situation?

My wife has fibromyalgia and the pain made it impossible for her to work. She quit her job to apply for disability but was turned down. She will try to find some kind of work but until then could she qualify for unemployment benefits. To apply for disability you cannot be working and now she has no job and no disability.
