You can not receive Colorado unemployment benefits if you quit your job.

In order to be eligible for unemployment benefits in Colorado, you have to have lost your job through no fault of your own. This means that if you quit your job, you can't get unemployment.

Be sure that you can not quit your job because you didn't like it, or it was too hard, or because it didn't pay enough, or because the hours didn't work for your schedule - and still expect to collect unemployment.

If you are in a hostile work environment, or otherwise feel like you have to quit for a very good reason (such a threat to your health or safety), please take the following advice:

The laws and requirements for unemployment eligibility vary from state to state, but most states do not allow you to collect unemployment benefits if you voluntarily quit your job. If a state does allow you to collect unemployment when you've quit your job - the requirement to do so will be VERY difficult to meet.

In most states, if you are fired for cause you may still be eligible to receive benefits - and the requirements in this case won't be as stringent as if you had quit.

It is my understanding that employers generally do not comment extensively on previous employees, or on the reason that they are not longer at their company, for fear of being sued. Most employers will generally verify employment dates and not comment on the reason you are no longer there, or offer any further details.

If your company fires you though, you can be sure they won't be writing you any recommendation letters.

I know how difficult a hostile work environment can be. I've been there. Still, I would suggest that you do not quit your job. If it is a large corporation, you should talk to someone in the Human Resources department about your situation and the hostile work environment. If you get fired and you have a wrongful termination case, it will be more difficult to appeal your case to the employment commission or more difficult to bring a wrongful termination lawsuit - as you will have willfully quit.

Millions of people are out of a job - so it looks like you'll be diving head first into a very difficult job market, no matter if your fired or quit.

Make them fire you.

Go on about performing your job duties, and do not do anything to provoke them to fire you. If they're going to fire you, they'll do it. If they continue the hostile work environment tactics, or increase them - you should contact the employment commission to see if you have any recourse or protections - as there are federal laws against hostile work environments.

VERY IMPORTANT:

Don't sign anything!

Don't sign any releases, forms, waivers, or anything.

If they present you with paperwork that has to be signed in order to receive a severance or your last check -- Don't sign it!

Take it to a lawyer, law school, smart aunt or uncle, or research and ask about the terms in the document online.

If you do end up signing it - remember that it is a legal document, so understand and agree to everything in it before you sign it. Also, remember that the terms are negotiable, because it is essentially a contract. If they want you to agree to their terms, you have the right to either:

a. Not sign it.
b. Negotiate the terms of the agreement.
c. Sign it.

Examples of ways you can negotiate this legal document, which is often referred to as a 'Separation Agreement':

a. Demand that the agreement state that you are being laid-off, not fired.
b. Demand that the company will not challenge your claim to collect unemployment benefits.

I have worked for 12 yrs for this company that is soon to merge with another one. according to the last meeting i attended - us 4 employees will remain on the job until all work (financials/documents/etc) have been merged together; then they will post our positions in the local newspaper and we were told we must reapply for our positions. But particular job title is not on the organizational chart and they are phasing my position out. They will have 3 positions available for 4 employees. My questions are:
1) if i dont apply for one of the other job titles can I get unemployment?
2) if I apply and dont get my job can I file unembployment?
Im confused of how they can post our positions when we are here to fill the positions. I have a strong suspicion that they are laying some of us off without actually laying us off - we will have reapply for our positions - we wont get our jobs and therefore legally they havent laid us off or fired us. what can we do?

I am having such a hard time at this place i work at, it is a very hostile environment and have not really checked in to it a lot, but am starting to here. It's just gotten so bad for me to the point where i do wanna quit, but can't. I have 6 children to take care of, and i know the employment market out there is one that is so much more complicated to seek another job, This was suppose to be a temporary job in the first place, i had graduated from college in 2009 for Medical Coding and billing specialist, it just so happens that even the medical field was effected by the economy as well, little did i thing about that, i figured everyone get's sick and needs to see a DR at one point or another so did not even question that part about it, I've been in the Medical field over 18 years, so thought this was the way to go, boy was i so wrong. Anyhow, that is how i ended up where i am now, and feel like i am in a tough spot and either have to take it and deal with it, or quit and not get anything out of it! It is just so unfair, this company i work for had a crooked district manager that is crooked and does things under the table. I have complained about my pay checks so many times, the hours i worked was not what i was paid for in a continuous basis and this happened consistently for about two months in a row. When i confronted my district manager about it, he told me in a threatening way that i better not call the payroll department to discuss my hours, that i will deal with him, i asked why, he had said it isn't their problem, so i have not yet called them to discuss my paycheck problems yet, but it's just so funny and weird how he got very defensive about it, i am not the only one whom feels this way, as i talked to a few other workers that had experienced the same consequences. It's a long story there is so much more i need to add, but want to know if i can get in touch with the right person in this matter first before i spill my guts and situation on here. I need to seek some king of professional advice in this matter before i continue, so if there is anyone out there that can help or at least lead me in the right direction on where to start, it would be very greatly appreciated. I just feel that i am stuck, and this is not right what he is doing to me and other at out place of employment, there has to be something that can be done with this. He has been with this company 29 years, so i know he thinks he is untouchable, as for everyone i complained to above him, i think they also see it that way as well. He's been with this company so much more longer that i have or probably most likely will ever be, so why even listen to me and hear me out? It would be so much easier to get rid of me, or turn the other cheek, since it's not even worth listening to as far as they are concerned, this is where lawsuits come in.
Please, anyone that's been in this situation or can give me some kind of advice whether it's legal of just personal, please do, i am so desperate to getting my head above water on this one, so please help!!!

In my home state of New York if an employer isn't paying you you can quit and receive unemployment. Well, my employer here in Colorado decided to spend my paycheck on having the shed removed from her back yard, among other personal things. Can I quit and receive unemployment in the state of Colorado?

My husband was relocated to Denver from Florida. I worked for the State of Florida so I was forced to quit my job or live in a separate state than my husband and daughters. i have been unable to get a job in Colorado. Can i collect unemployment since I had to quit due to my spouses job relocation?

My husband is working for a company and won a job bid to a better paying position. Hevwas cross trained for a few weeks then left alone or pulling count as they say. Even though he is pulling count he is not recieving the pay. He already talked to supervisor and was yold that he woulb be recieving it but has not yet recieved anything. This raise is very segnificant as is the job a lot harder. All of his nails have fallen as a result. He is very dicouraged and is wanting to quit a company he has worked for 9 yrs because he feels that they dont care sbout how hard he is working n they careless if he is being paid. Will he qualify for unemployment if he quits... we have 7 children and bills to pay. I need advice as to what we should do. He is in the process of getting cdl to change careers but it is a process that will take some time... let me know what to do plz..

I have been working a good job for a while. I recently had to quit my job due to a seperation and eviction. Due to this my inlaws that were watching my children got a job and wasn't able to watch them. I don't have any family here in colorado. I wasn't able to get ccap in enough time to keep my job. After that I came to find out they were going to fire me that day. After all this am I eligible to receive unemployment?

I was laid off from a Colorado school district in 6/11 but put myself on the sub list for the following school year. I applied for unemployment and began receiving benefits in 7/11. Well, when the new school year began, I wasn't getting many phone calls for jobs, and the calls I did receive were for jobs really far away from my home. At the time my son was 3 months old and i was also having a hard time finding day care for him and I certainly didn't want to be more than 10 miles away from him. Furthermore, the cost of child care far outweighed the income I was receiving from subbing so I ended up taking myself off the sub list. I collected benefits until I was hired with another school district - the new job was only for 1/2 year and so when that job ended, I reapplied for unemployment benefits and was once again approved. Now 6 months later the original school district is appealing the decision to provide me with benefits because I quit the sub position with them. What can I do?

I work for a company that says they are family orientated. I have 2 small kids and one of them has a Drs appointment. I asked for the day off to take them and they scheduled me anyway. My kids come first. I'm very tempted to quit!

I got out of the Navy in January of this year and moved to Colorado by myself. I got a job before I had a home and found out later that I could not afford to live where the job is located. Instead, I was forced to make an hour commute from a more reasonably priced area. Which was fine, until unprecedented circumstances arose and it will soon be impossible for me to make the commute to work. I will be forced to quit. I've already been applying locally, and talking to employment services but I haven't received any response. Am I eligible for unemployment?

I just went through a bitter divorce, I am losing my home and have no choice but to file bankruptcy. I have no choice but to move back to South Carolina with my mom. Will I be able to qualify for unemployment benefits? I have worked with this company for 13 years.

i've worked for a big bank in a ski resort town in colorado for 6 years.i decided to move to denver since my roommates left town and it was getting really expensive to live by myself. so i started trying to transfer with my bank to a branch in denver(they have at last 20 branches) but i never heard back for an interview. i already moved to denver and i am currently on a job search leave that expires on May 31st. would that be considered quiting and would and will i have any chance to get approved for unemployment?
