California Unemployment If You Get Laid-off

Generally, in California you have to have lost your job through no fault of your own in order to collect unemployment. When you get laid-off, it is not your fault.

In almost all cases, this means that if you get laid-off, you are eligible to collect unemployment benefits.

If you get laid-off from your job, you should immediately apply for unemployment benefits.

Getting laid-off doesn't mean that you were fired. Getting laid-off doesn't mean that you did something wrong. Getting laid-off means that they company that you worked for did not have enough work for you to do, and could no longer afford to pay you to do your job.

I'm a general contractor and I'm laid off by the elevator union. If I start my own construction job, can I still collect unemployment if the union still has me as laid off? I've heard that since I am union it is legal for me to still collect unemployment?

hello I recently was told by my employer that the role I was hired for has changed and that me supervisor has determined that I m not the right fit for the new role! I have been in my position for 5 years and always received very good performance evaluations! I feel that I was pressured to take one of two opions: take performance improvement plan (PIP) or consider alternative options! I asked me supervisor about the PIP and was told it they don't feel it is intended for me to succeed but if I want they will draft a separation agreement that states the separation was amicable and if I accept I will given 90 days to find an other job. I don't feel like I have any choice! Appreciate any advice.. I have been looking but no luck. Feeling Lost, tiny and embarrassed...husband and father of three.

I was "dismissed" due to financial reasons (my boss took 4 weeks of vacation last year) so she said she could not afford to keep me..just came back from disability leave, due to a foot injury... anyway this was SIX weeks ago and unemployment has given me the run around .. benefits were authorized but i guess my continued claim forms keep getting sent to China or somewhere i am not!! i have called 4 times to correct the problem and i went into a place they call a "center" (a bunch of phones on the wall) and still it has not been resolved. How am i supposed to find a job with no phone, no internet and PGE turned off?? cant pay these bills with a promise!! I have never seen soooo many people in one place who haven't any ideal what the left or right hand is doing!!
I called as the representative advise and again another ROADBLOCK i need to know what the weekly benefit is ??????? i would know this if i had received a check ..huh! or i guess it would've been too easy to give me that information before she hung up...
NOPE... as my mother always says, "that would be too much like right"..besides i think it would mean they are actually being human and doing their job or is it that it is a secret society that we outsiders are not allowed to know the answers ?? but i bet their paychecks are there!I haven't been unemployed for 19 years so i have contributed to UI by working for 19 years.. and now due to no fault of my own i walk into a termination only to have more stress and frustration THANK YOU UNEMPLOYMENT DEPARTMENT FOR YOUR SUPPORT!! oh and by the way .. NO i don't have a job .. my career i have chosen to work in the last 21 years only wants BILINGUAL workers .. adding insult to injury to an American Citizen!!!!Than ks...

Dear Ticked off, I feel your pain! Dont even get me started. Why is there no help for hard working citizens that want to work when we need the help!? I work in HR and all they seem to want to hire is bilingual people and ones with a college degree these days. ive been in this field for some years now, know my job and have delt with spanish speaking ppl just fine in the past and managed quit well. California especially is going to hell in a hand basket to say the least. Most of us are either unemployed or taking jobs making way less than we can live off of and losing our homes and going in debt with no sign of recovery. Its just all bad. Hopefully things r better for you now!

Is it legal for a construction company to hand out a letter asking you to either take a 10% pay cut or agree to be laid off without the possibility of unemployment? Can they do that?

I recently quit my job (as a pharmacy technician) and relocated to go back to school. I found a job as a hostess at a restaurant. The restaurant has since changed ownership and closed to re-model. Do I qualify for unemployment? My dad keeps telling me they go on a quarter system and I will get paid what I was getting paid this time last year (as a pharmacy technician and not a hostess.) Is this true? Does the fact that I am going to school going to hurt my chances??

I was 'replaced' from a part time nanny position this week. They hired someone else and 'informed' me that they had decided to hire a 'professional nanny' due to their odd and long hours of work, (which I had accomodated with no complaints). I worked for a distant relative, and only for 4 months. They paid me by check. As far as I know, never claimed me as an employee although I asked about how taxes would be handled several months ago. Can I apply for CA unemployment? How do I file my tax return for the year? Never work for distant relatives... I have never lost a job before this!

I work as a contractor for major cable provider in Southern CA, been here for 2 years. Since then, our pay system has been reduced, our hours went from 4 day, 10 hr shifts to 5 day, 10-12 hr shifts. After a year of slaving under these conditions I had to cut back to 3 days, working 30-40 hr weeks in June hoping to use the extra time to find something else more within my actual background/skill set (video production).

The company is getting less work and Im considering asking to be laid off. Co. says they dont pay unemployment OR disability since its contracted work, however we are treated like typically employees (punch clock etc). The company has an extremely high turn around rate (30-50% leave within first 6 months.

My question is, with the reduction of pay + work would I be able to file if I take their "lay off" offer-- how are my chances in receiving EU?

I have been asked to sign a document that states several thing I dont agree withfor conditions of employment. Such as if there is money missing from my cash drawer they will take that money from my next check.Or that that own me for purposes of making comercials and I dont have any right in regards to how my image is used. I was told that if I dont sign in 2 days I should just not come back to work. Can I collect unemployment if I dont agree to their new policy. They are very unprofesional and I am afraid they will say I left voluntarily.

I was working a popeyes for two months and then they decided to lay me off because they didn't have hours but yet they have enough hours to hire two more people. I was wondering if I can still receive unemployment. Because I do have to pay bills like most people.

Hello... I was placed on disability due to pregnancy complications on sept of 2011. After having my son, my doc evaluated me with post pardum depression and put me on meds. I have been on for almost ten months now and my manager told me that I have been replaced and could not have my job back although I transferred with the company from another city. Can I apply for unemployment?

My husband might get laid off in september. He owes EDD an overpayment of 13,000 from two years ago. He is making payment on the overpayment of $300 an month. If he gets laid off in September will he be able to file for unemployment and still make a payment of $300?

i have worked for a casino for about five years, I quit because i was joining the iron workers union. i worked for one day and there is no more jobs for now. who pays for my unemployment? does the casino pay or does the contractor pay? and also if do i qualify. I know the contractor, but i dont want him to pay for my unemployment. I only worked for one day or half the day. so yea casino pays or Contractor?

I was hired 4 months ago as a security/doorman for a small lounge/pub in Southern California. My boss was paying me $14.00 an hr cash, and I just got word that I've been laid off due to lack of business.

Am I eligble for any sort of unemployment benefits at all?

My company will be closed on September 30, 2013. I will be getting buy-out lump-sum and cashed out my annual leave. Will I be eligible for unemployment benefit right away after the closure of our company? Or EDD will calculate my buy-out lump-sum and leave cashed out first?

I've been working for my company as an operation manager for about a year (Jan. 24 will be my first year). However, this company used to relay more than 90% of income from a single vendor, and now they have moved to different company. I see this company is being down fall, and doesn't seems like it will last no longer than 6 months. In this case, if they ask me to leave the company because of my payroll is not affordable or something, will I still be able to request an unemployment benefit?

The restaurant where i was full time salaried manager for 2 1/2 years was closed for a remodel that was scheduled to 2 weeks beginning on 12/10. The work, salaries and revenue lost was to be covered by insurance. The remodel has be delayed and is ongoing.
I recieved the first schedules paycheck on 12/20. The next payday was the 5th which passed without word despite repeated calls and texts to the owner. I finally got a meeting with the owner on the 9th when he laid me off sighting lack of funds and cutbacks. I was giving a check for my vacation time and was told i was laid off on 12/16. My question is can he lay me off 3 weeks ago and not pay me and what are my options? I have filed for umemployment but not sure if it can cover the time before i filed. Any advise would be greatly apprecited, Thank you in advance.

I work for 20th century Fox currently as a personal assistant. I started work on June 24th-2013. The show Im working on ends on September 20th-2013. Im not sure what contract Im under with Fox but Im pretty sure it is a w9. Can I apply for unemployment now, so it is ready by September, and how can find out if I even can receive California UI. ?
