How to File a Arizona Unemployment Appeal

If you feel like you need to file an unemployment appeal, you can do so by:

1. Go to the Arizona unemployment website and click on 'Appeal'.
2. Contact your unemployment counselor.
3. File a claim directly with the Arizona Board of Labor.
4. Contact a labor attorney.

What are some reason that you might need to file an unemployment appeal?

1. You feel like you did not receive the full amount of your unemployment benefits.
2. You feel like you were treated unfairly or discriminated against.
3. You feel like you were denied for unemployment benefits inappropriately.
4. You feel like your employer is trying to block you from receiving unemployment benefits when you are legitimately entitled and eligible to receive them.
5. You think that your unemployment benefits ran out too soon.
6. You believe that your unemployment application was incorrectly or unfairly judged or handled.

The staff of the Arizona unemployment offices are very diligent and professional counselors who genuinely want to help you, but sometimes mistakes are made. I filed an unemployment claim and was denied after leaving safeway whom i had been employed by for the past nine years. I filed a charge against Safeway for breach of contract through the NLRB. Since then I suffered retaliation, hostile work environment , harrasment . and unfair treatment reduction in work hours which is why I went to the NLRB in the first place. I have provided sufficient evidence. I have filed for an appeal meanwhile i llook for work but im about to loose my home and everything else. what can i do to speed up the process.

My question is somewhat lengthy because it entails a difficult situation, but I do need some help in finding out if there is anything I can do at this point. First of all it has been almost three years since my hearing in which I was denied any future benefits and told I had to repay the 8,000.00 already paid to me + interest totalling over 10,000.00 to date.
Here's is the truth about what happened; I was working alone at an offsite location for a rental car agency. The time was approximately 3:45 on a Sunday afternoon. A woman came in to return a vehicle, okay no problem, however, she was the rudest customer I've ever encountered. She was mad about her charges and kept questioning me why is it this way or that way etc. The she began to literally call me names and degrade me as a person. I was so dumbfounded about what was happening that I began to shake uncontrollably and had to walk outside to think straight. She followed me out and was still yelling at me. I finally went back inside and gave her the receipt and told her to call the main office. When she left I was crying and just wanted to quit. I called the main office looking for any manager but couldn't get a hold of anyone. I even tried my boss on his cell phone, but also no answer, so I left him a message stating I probably wouldn't be there after that day, explaining what happened and then I proceeded to go home (about an hour early). The following day, which I was not scheduled to work, I called him at the office. He was aware of what took place because the woman had also called an complained about me. My boss said, are you sure this is what you want to do...meaning quit. I said, NO, I don't want to quit. I was upset and couldn't get a hold of anyone to talk too, so I acted irrationally. Long story short, he said okay, however, the fact still remained that I did leave early and he needed to take that into consideration as he reviewed everything, and that there was a good chance he may have to let me go. Three days later my boss called me at home. He had me meet him and my supervisor at a different location to discuss letting me go. He had a file folder with him and in it was a "letter of resignation" written by him, but was to have been from me. In other words he was bribing me into what was to happen next. Mind you they were letting me go, firing me. He said, if you sign this letter stating that you were sorry to leave abruptly, but had personal circumstances you needed to deal with, then we will give you a good recommendation when you look for your next job. Otherwise if you don't then you will be considered fired and that is what we will tell who ever calls about you. Being the naive person I am I accepted their bribe, signed the letter and left under what I thought was a positive sever of employment. I had no idea that they had this all planned out and that they were going to burn me at every turn thereafter. I filed for unemployment and after a long waiting period I was accepted. I started receiving back pay for over three months and so forth. About six months later I was in an accident where I received a brain injury. I was a student attending online courses at the University of Phoenix and had to take a leave of absence because of the injury. Basically, my brain wasn't able to comprehend a lot of information, I had no short term memory and became disoriented very easily. It was then that I got the letter stating my benefits were frozen and that I had a court hearing over the phone two weeks later. I was terrified simply because of my circumstances, and whether or not I was going to be able to accurately defend myself in this case. Well, obviously I wasn't because as I'm sure you could have guessed I lost my case. This is because despite everything that had transpired, my boss had kept the message I left him stating, "I may not be there after that day." He used this against me even after the other conversations we had following that message where I said I didn't want to quit, I needed my job and that I was wrong to react the way I had. And that he had said he was glad I didn't want to quit and that is was okay, except of course about the leaving early, which again they did let me go because of. So, this is where I'm at with this. I did file an appeal and because of that stupid message he used against me I was denied again. It's as if nothing else mattered, when in all actuality it really did or does matter because it involves the truth of the matter.
Well, after just receiving another statement from the Arizona Unemployment Office saying that they have kept my state return and federal tax return to pay this back, I'm very upset. I do not feel that I was wrong. Stupid, yes, but not wrong. The company I worked for straight up lied to me, bribed me and lied to the judge about what took place following that call. I would have never even filed a claim for benefits had I known this "billion dollar" enterprise rental car company was going to screw me over like this. Is there anything, anything at all I can do or that you can suggest I try regarding this. Thank you so much for the time you took to read this, it is greatly appreciated.
